A view from education and employment law
This chapter identifies parallel themes in two of the welfare state's pillars: education and employment, as a matter of substance and law. In both, power dynamics are apparent, long-term relationships need to be cultivated, and thus the potential for social, economic, cultural and technological impact on the professional - education or work - environment may be significant. The chapter draws on five themes for a research agenda on social welfare law and policy. These are the choice between discipline and power, on the one hand, and democracy and partnership, on the other; the blurring of boundaries between the public and the private; conditionality; access to justice; and outsourcing and the technological revolution. Juxtaposing the two realms highlights areas of confusing legal inconsistency and potential cross-fertilisation, whilst acknowledging where differences in context merit a distinct approach.</p
