Unmanly Diversions: The Construction of the Homosexual Body (Politic) in English Law

In this article, the author interrogates the construction of gay male sexuality in legal and popular discourse. Focusing on two events-the decision of the House of Lords in Brown which upheld convictions of sadomasochists for assault, and publicity surrounding a serial killer of gay men in Britain-he argues that gay men are discursively constructed around the concepts of addiction, seduction, and contagion. Through the manipulation of these concepts, a linkage is created between sexual acts, sexual identities, the destruction of the gay male body, and a threat to the health and safety of the body politic as a whole

Bad Attitude/s on Trial presents a critical analysis of pornography in the context of contemporary Canada, \u27 with a particular focus on the impact of the Supreme Court of Canada\u27s decision in R. v. Butler,2 and its reformulation of the basis of obscenity law. The book is co-written by four Canadian academics: Brenda Cossman, Shannon Bell, Lise Gotell, and Becki L. Ross. Each has contributed a separate section of the book, along with an introduction by Cossman and Bell. The result is a vital, theoretically sophisticated addition to the literature on pornography; a vivid documentation of the impact of obscenity law on the lives of lesbians, gay men, and others in Canada; and a scathing and powerful indictment of the complicity of anti-pornography feminists in the maintenance of the heteronormative moral order

A Postmodern Constitutionalism: Equality Rights, Identity Politics, and the Canadian National Imagination

In the 1990s, identity has become the centrepiece of theoretical work in a variety of disciplines. We now know that, in the conditions of late modem (or postmodem) society, identity is complex-it is fragmented, intersected, subject to alteration, socially constructed and it exhibits only a partial fixity at any moment. Most important, identities are to be valued, respected, and understood on their own terms. However, we also have relearned (if we ever forgot) that identities can be dangerous and fatal, especially when they coalesce in the form of nationalism. In this article, I will explore the intersection of nationalism and identity in the Canadian context and will use as an example to explore these broad issues, the constitutional recognition of sexual orientation as a prohibited ground of discrimination

Living With/Out Proximity: Comparing a Contested Concept in Tort

National audienceCertaines femmes victimes de violences conjugales s’inscrivent dans un parcours de résilience et manifestent une attitude positive, voire passionnée, vis-à-vis de l'apprentissage de connaissances et de capacités nouvelles. Cette observation renvoie au concept d'apprenance proposé en sciences de l'éducation (Carré, 2005).Cette attitude d’apprenance, s’exprimant par différentes pratiques particulièrement autodidactes, orientées vers la compréhension de l’événement traumatique (telles que la lecture d’ouvrages spécialisés sur les violences, l’Etat de Stress Post-Traumatique, la résilience, des récits de vie, mais également des recherches sur internet, le suivi de conférences et de stages en développement personnel, …), pourrait-elle favoriser la résilience ? Ces pratiques sont- elles uniquement le fruit de dispositions apprenantes antérieures au traumatisme ou pourraient-elles émerger à la suite de ce dernier ? On peut par ailleurs s’interroger sur les usages et bénéfices personnels et sociaux que ces femmes font de leurs expériences, de leurs nouvelles connaissances et capacités.Cette recherche en cours tend à répondre à ces questions par une étude à la fois qualitative (par des entretiens autobiographiques) et quantitative (par questionnaire), auprès du public cible. L’enquête exploratoire a consisté en des entretiens autobiographiques auprès de 5 femmes ayant été victimes de violences. Ces entretiens ont montré que ces femmes ont multiplié les ressources afin de comprendre leur histoire, pouvoir mettre des mots sur l’événement traumatique et ainsi pouvoir progressivement s’inscrire dans un parcours résilient. L’ensemble de ces ressources les a conduites non seulement à se rétablir, mais également à développer une véritable expertise. Certaines d’entre elles souhaitent, aujourd’hui, mettre à profit leurs connaissances et compétences acquises de manière expérientielle et didactique, afin de soutenir et accompagner d’autres personnes vulnérables.L’objectif de cette recherche sera, d’une part, de comprendre le lien entre l’apprenance comme ressource et la résilience comme parcours. L’apprenance pourrait ainsi être intégrée parmi les facteurs de résilience. D’autre part, cette recherche sera susceptible d’apporter un élément intéressant au domaine de la victimologie et de la psychotraumatologie, en proposant des pistes complémentaires dans l’accompagnement des anciennes victimes de violences, notamment par le rôle facilitateur et incitateur d’apprentissage du psychothérapeute et du travailleur social

Pluralism, Equality and the Challenge of Faith Based Services

This article interrogates the increasing role of faith groups in the delivery of public services in England pursuant to the Big Society agenda. Specifically, it examines the potential impact on competing values such as equality between citizens. After a historical survey of the role of faith communities, the article reviews an example of protracted litigation in which the clash between faith based service provision and equality was at the forefront. It then adopts a comparative approach, turning to the extensive American experience of Charitable Choice. Finally, the issues are situated within a broader theoretical frame. The author concludes with recommendations for policymakers in what will likely be a field of growing importance
