ПРОБЛЕМИ ВИЯВЛЕННЯ ОБСТАВИН, ЩО ПІДЛЯГАЮТЬ УСТАНОВЛЕННЮ ПРИ РОЗСЛІДУВАННІ ЗЛОЧИНІВ, ПОВ’ЯЗАНИХ ІЗ НЕВИПЛАТОЮ ЗАРОБІТНОЇ ПЛАТИ

In the paper we considered the features of organizing investigation of crimes related with non-payment of wages, namely a problem of revealing the circumstances subjected establishment. Having analyzed the proposed circumstances subjected to ascertainment during investigation of this category of crimes, let us generalize and distinguish, in our opinion, the most significant: 1. Existence of non-payment of wages to concrete employe- es/employee. 2. Availability of labor relations on the basis of an employment contract with enterprises, institutions, organizations of allforms of ownership and management, as well as with individual citizens. 3. Establishing of a period and amount of non-payment of wages. Determination of non-payment of wages is realized in following way: firstly, the total amount is established for the enterprise, institution, organization of all forms of ownership by periods, and then for a concrete employee. 4. Establishing of the fact of non-payment of wages by a concrete person - special subject alone or in accomplices. Obligatory feature of the subject of non-payment ofwages is the administrative-legal and functional statuses, which are ensured by the legality of the appointment or election of the head. 5. Determination of the method of non-payment ofwages. 6. Study of the causes ofwages non-payment occurrence. 7. Revealing the facts of using assets for other production needs, as well as the use of funds for unreasonable expenses and purposes not related with own economic activities. Consideration of the proposed list will allow to conduct the most complete and objective investigation of this type crimes, to obtain information relevantfor qualifying the actions of criminals, and to conduct timely and in a tactically correct manner investigative (search) actions, that in its turn, will positively affects the effectiveness and performance ofpre-trial investigation of crimes related with non-payment of wages.Розглянуто особливості організації розслідування злочинів, пов’язаних із невиплатою заробітної плати, а саме проблеми виявлення обставин, що підлягають установленню. Урахування запропонованого переліку обставин дозволить найбільш повно й об’єктивно проводити розслідування, отримувати інформацію, яка має значення для кваліфікації дій злочинців, своєчасно та тактично правильно проводити слідчі (розшукові) дії, що, у свою чергу, позитивно відбивається на ефективності й результативності досудового розслідування злочинів

ОСОБЛИВОСТІ ВИЗНАЧЕННЯ РИНКОВОЇ ВАРТОСТІ ОБЛАДНАННЯ, ЩО ВИКОРИСТОВУЄТЬСЯ НА АТОМНИХ ЕЛЕКТРОСТАНЦІЯХ

Execution of examinations to determine the market cost of the equipment that is used on Ukrainian nuclear power stations is quite complicated process, since this equipment is unique, manufactured to individual order. For today practical aspects of the specified property estimation, unfortunately, researchers were not properly shined. Considering expert practice at definition of market cost of the equipment used on Ukrainian atomic power stations, merchandising experts face the following problems as identification of research object, choice of research method, substantiation and choice of methodical approaches to an estimation of such property. Since the equipment is specific, its full-scale investigation should be carried out jointly with specialists of specialized enterprises for technical identification of the used property (description of the commodity nomenclature, packaging arrangement, real state). The methods used in performing this type of examination are both general and a separate method of commodity research. We recommended using the cost approach in calculating the market value, namely the application of the method of price actualization. The cost approach is mainly used at estimation if it is impossible to find object-analogue, there is no experience of realization of similar objects or the forecast of the future incomes not stable, the environment of estimated property realization very uncertain and success depends on a significant amount of factors. Therefore, in determining the market value of equipment used on Ukrainian atomic power stations, merchandising expert needs: conduct a full-scale investigation together with specialists from specialized enterprises for technical identification of the investigating property; use both general methods and a separate methods of commodity research; apply a cost approach to valuation, namely the method of price actualization and used price indices of industrial producers.Выполнение експертиз по определению рыночной стоимости оборудования, которое используется на украинских атомных электростанциях, является довольно сложным процессом, поскольку оно является уникальным, изготовленным по индивидуальному заказу. На сегодня практические аспекты оценки указанного имущества, к сожалению, должным образом исследователями не освещались. Учитывая экспертную практику при определении рыночной стоимости оборудования, используемого на украинских атомных электростанциях, эксперты-товароведы сталкиваются с такими проблемами как идентификация объекта исследования, выбор метода исследования, обоснование и выбор методических подходов к оценке такого имущества. Поскольку оборудование является специфическим, его натурное обследование должно проводиться совместно со специалистами специализированных предприятий для технической идентификации исследуемого имущества (описания товарной номенклатуры, комплектации, фактического состояния). Методы, использованные при выполнении этого вида экспертиз являются как общие, так и частные методы товароведения. Нами рекомендуется использовать при расчете рыночной стоимости затратный подход, а именно применение метода актуализации цены. Затратный подход преимущественно используется при оценке, если невозможно найти объект-аналог, отсутствует любой опыт реализации подобных объектов или прогноз будущих доходов не стабильный, среда реализации оцениваемого имущества очень неопределенная и успех зависит от значительного количества факторов. Таким образом, при определении рыночной стоимости оборудования, используемого на украинских атомных электростанциях, эксперту-товароведу необходимо: проводить натурное обследование совместно со специалистами специализированных предприятий для технической идентификации исследуемого имущества; использовать как общие методы, так и частные методы товароведения; применять затратный подход к оцениванию, а именно метод актуализации цены и использовать индексы цен производителей промышленной продукции.При визначенні ринкової вартості обладнання, що використовується на атомних електростанціях, експерт-товарознавець наштовхується на дилему з обранням і обґрунтуванням методичного підходу. Запропоновано інформаційну модель, яка дає змогу вдосконалити та підвищити якість виконання експертиз цього напряму дослідження

ОБГРУНТУВАННЯ МОЖЛИВОСТІ ВИКОРИСТАННЯ ПРИРОДНОГО ЦЕОЛІТУ ДЛЯ ОЧИЩЕННЯ СТІЧНИХ ВОД МОЛОКОЗАВОДІВ

The article examines the hydroxy propionic (lactic) acid sorption process by natural zeolite of Sokyrnytskiy field. Sorbing agent porosity and its impact on sorption properties have been investigated by physical and chemical analysis methods. Sorption process of the interstitial lactic acid molecule zeolite pores surface presence has been confirmed by IR spectroscopic and electronmicroscopic investigations. Natural zeolite usage opportunity for milk processing plant wastewater purification has been confirmed by experimental investigations.Розглянуто процес сорбції оксіпропіонової (молочної) кислоти природнім цеолітом Сокирницького родовища. Методами фізико-хімічного аналізу вивчено пористість сорбенту та її вплив на сорбційні властивості. ІЧ-спектроскопічними та електронно-мікроскопічними дослідженнями підтверджено наявність процесу сорбції поверхнею внутрішніх пор цеоліту молекул молочної кислоти. Експериментальними дослідженнями підтверджено можливість використання природного цеоліту для очищення стічних вод молокопереробних підприємств

The paper suggests a new indicator of natural water quality a coefficient of identification as a slope of the relationship inverse electrical conductivity from degree of research water dilution by distilled water to establish the fact that bottled drinking and mineral waters do not comply with normative requirements.
