Hong Kong, la Chine et la démocratie

Analysant l’évolution politique de Hong Kong depuis la crise du SRAS, au printemps 2003, l’article montre que le territoire se situe au confluent de trois transitions majeures (démocratique, économique et culturelle, dans sa dimension de société postcoloniale) dont la conjonction nourrit une crise de la gouvernance. Cette situation facilite la diffusion d’une culture de la mobilisation politique. Inversement, les élections législatives de septembre 2004 ont révélé un réel désenchantement à l’égard des organisations politiques les plus instituées, notamment le Parti démocrate. Un tel sujet soulève celui, plus général, des perspectives de changements politiques dans le reste du continent chinois car, à la complexification de la culture politique locale, s’ajoutent des conflits croissants entre les modèles constitutionnels de Hong Kong et de Pékin. EU election: low-key campaigns from big two give FN a chance to win in France

1st lines:: France’s relationship with the EU appears paradoxical given the contrast between the traditional pro-EU involvement of French elites and regular expressions of reticence, such as the opposition to the Draft Constitutional Treaty rejected by referendum in 2005. As a result of this paradox, the national narratives for supporting French membership to the EU suffer from progressive erosion and Euroscepticism is subtly gaining ground. Support for the EU also has suffered, as in most of the other member states, from the on-going economic and financial crisis. The difficulties to overcome, as well as the growing gap between France and Germany, have been pointed to by Eurosceptic forces who criticise the lack of genuine protection offered by the EU. The argument is two-fold: globalisation is generally perceived as being as much of a threat as the enlargement of the EU

Environmental governance in the People’s Republic of China: the political economy of growth, collective action and policy developments – introductory perspectives

The special issue is introduced here by considering the state of the environment and environmental governance in the PRC. While significant, substantial developments in legislation and policymaking remain insufficient to tackle the degradation of the environment and the increasing saliency of environmental issues in Chinese politics. Tremendous challenges remain in the areas of natural resources governance, environmental health, and transition paths in agriculture and urban development. They need to be addressed by an even stronger commitment of the Chinese leadership, accompanied by significant reforms in the areas of environmental litigation, the transparency of local government decision-making, and the capacity of the self-organisation of Chinese citizens in mobilising on environmental issues

The Politics of Constitutional Reform in China: Rule of Law as Condition or as Substitute for Democracy?

In the People's Republic of China (PRC), dynamic policy evolution and related socioeconomic changes strikingly contrast with the absence of any democratic transition similar to those most communist countries have undergone during the last two decades. Nevertheless, policy reforms of the Chinese government entail a number of important administrative and legal developments, among them a series of amendments to the Constitution. This contribution analyses whether and how constitutional reforms are to be interpreted as part of the PRC's modernisation process. It is shown that the constitutional changes so far have not departed from a traditional communist approach but have been used to legitimise fundamental policy changes initiated by the Chinese Communist Party. At the same time, however, this accommodation of the fundamental law triggered a genuine constitutionalisation process that has been subject to severe limitations, while also signalling important changes in political culture and imposing significant tensions on the whole political system. Therefore, recent constitutional developments in China go far beyond the mere window-dressing that is frequently associated with legal practices in communist regimes.In der Volksrepublik China kontrastiert die dynamische Entwicklung der Staatstätigkeit und ein entsprechender sozioökonomischer Wandel deutlich mit dem Ausbleiben einer demokratischen Transition, wie sie die meisten kommunistischen Staaten während der vergangenen beiden Jahrzehnte erlebt haben. Gleichwohl zieht die Reformpolitik der chinesischen Regierung einige rechtliche und administrative Entwicklungen nach sich, wozu auch eine Reihe von Verfassungsänderungen zählen. Der vorliegende Beitrag untersucht, ob und inwiefern diese Verfassungsreformen als Teil des chinesischen Modernisierungsprozesses zu interpretieren sind. Es wird gezeigt, dass die bisherigen Verfassungsänderungen nicht von dem traditionellen kommunistischen Ansatz abwichen, sondern dazu dienten, die substanziellen Veränderungen der Staatstätigkeit zu legitimieren, die von der Chinesischen Kommunistischen Partei initiiert wurden. Zugleich jedoch hat diese Anpassung des Grundgesetzes einen genuinen Konstitutionalisierungsprozess ausgelöst, der zwar deutlich begrenzt blieb, aber bedeutsame Veränderungen in der politischen Kultur widerspiegelt und erhebliche Spannungen im gesamten politischen System bewirkt. Von daher gehen die neueren Verfassungsentwicklungen in China eindeutig über rein symbolische Maßnahmen hinaus, die häufig mit der Rechtspraxis in kommunistischen Regimen assoziiert werde

Les conséquences des choix politiques : choix rationnel et action publique

Cet article cherche à dégager les partis pris de méthode essentiels dans l’approche de l’action publique par le choix rationnel. Il rend compte de quelques travaux récents sur une série de questions cruciales pour la compréhension de l’action publique contemporaine : les déterminants des politiques de privatisation, la convergence des politiques macro-économiques, la maîtrise des dépenses de santé, et enfin la production des normes dans l’action publique. Ce que démontrent ces travaux, c’est qu’une part significative des variations fines des politiques publiques se comprend comme la résultante de choix raisonnés. C’est moins le calcul d’optimisation, empiriquement très imparfait, que l’anticipation par les acteurs des conséquences de leurs choix, qui fonde l’originalité et l’apport du choix rationnel. La Chine est en train de changer la politique mondiale. Comprendre les formes de son gouvernement relève d’une impérieuse nécessité. Le 4e plénum du comité central du Parti communiste chinois (PCC), réuni à Pékin fin octobre 2014, a consacré ses travaux à la promotion de l’État de droit. Le document issu de cette réunion indique qu’il s’agit « d’accélérer l’édification d’un système de gouvernance par la loi », en réponse aux dérives attestées de celui-ci : inégalités sociales, corruption, abus de pouvoir et dénis de justice.
