    Abstract Bridal shower is one of the current trends in wedding ceremony. It has been adapted from a western culture and practiced by some community in Malaysia. Basically, it has celebrated specially for the bride who will step into the wedding phase. In the practice of bridal shower, there is an issue of Islamic law that needs to be distinguished as this practice is copying from foreign cultures. Thus, this study discusses a practice of bridal shower that is increasingly widespread among the Malaysian Muslim community and its relation to the aspect of tashabbuh (imitation) to a western culture because it’s originally has practiced among western community. To achieve this objective, a library-based and qualitative study has used to collect data on bridal shower practices. The result shows that there is an issue of tashabbuh (imitation) to western culture in practising bridal shower by the Muslim community. The existence of this issue has an influence on Islamic law in the practice of bridal shower whether it should be practiced or prohibited. Keywords: Malay, culture, wedding, imitation, Islamic law. Abstrak Penganjuran bridal shower merupakan salah satu trend terkini dalam majlis perkahwinan yang diadaptasi dari budaya barat dan diamalkan oleh segelintir masyarakat di Malaysia. Lazimnya, ia disambut bagi meraikan bakal pengantin perempuan yang akan melangkah ke gerbang perkahwinan. Kajian ini membincangkan tentang amalan bridal shower yang semakin menular dalam kalangan masyarakat khususnya di Malaysia dan kaitannya dengan aspek tasyabbuh (penyerupaan) terhadap budaya barat. Hal ini berikutan amalan bridal shower merupakan sebuah praktik budaya barat. Bagi mencapai objektif tersebut, kajian kualitatif berbentuk kepustakaan digunakan bagi mengumpul data dan maklumat berkenaan amalan bridal shower. Hasil kajian mendapati terdapat isu tasyabbuh (penyerupaan) terhadap budaya barat dalam amalan yang dilakukan oleh masyarakat Islam. Kewujudan isu ini memberi kesan terhadap penentuan hukum Islam bagi amalan bridal shower sama ada ia harus diamalkan atau haram.     Kesan Pelaksanaan MS ISO 9000 Terhadap Kepuasan Bekerja dan Komitmen Organisasi Pasukan Logistik Pangkalan Tentera Darat Malaysia

    Kajian ini adalah untuk menilai keberkesanan pengaruh melaksanakan MS ISO 9000 ke atas kepuasan kerja dan komitmen organisasi di Pasukan Logistik Pangkalan Tentera Darat Malaysia (TDM). Kajian ini penting kerana ketiga-tiga pasukan yang terlibat merupakan pasukan perintis dalam melaksanakan MS ISO 9000 bagi pasukan logistik TDM. Di dalam menilai kesan MS ISO 9000, sampel kajian dibahagikan kepada 2 kategori iaitu pasukan Logistik Pangkalan TDM yang telah melaksanakan MS ISO 9000 dan kategori kedua ialah pasukan logistik yang tidak melaksanakannya. Bagi organisasi dari kategori pertama, pasukan tesebut ialah 91 Depot Bekalan Pusat, 91 Depot Pusat Ordinans dan 91 Worksyop Pekilangan AT. Sejumlah 650 responden diperoleh dan dari jumlah ini, 466 responden adalah di kalangan pasukan yang tidak melaksanakannya. Bakinya 184 adalah dari organisasi yang melaksanakannya. Untuk tujuan menguji kebolehpercayaan ketekalan dalaman secara keseluruhan, pengkaji menggunakan metod Pekali Alpha Cronbach kerana kesemua persoalan menggunakan kaedah pemarkatan skala Likert 7 mata. Secara keseluruhan dapatan daripada kajian diperoleh dengan menggunakan ujian statistik yang terdiri daripada Ujian - t tidak bersandar digunakan untuk mengukur hubungan antara komitmen organisasi kepuasan kerja aspek tugas dan hasrat pekerja. Khi kuasa dua digunakan untuk mengukur hubungan antara faktor demografi terpilih dengan komitmen organisasi dan kepuasan kerja. Tiga persoalan telah digunapakai oleh pengkaji sebagai petunjuk dalam proses pengumpulan dan penganalisian data-data. Persoalan berkisar kepada sama ada terdapat perbezaan atau tidak antara kedua-dua jenis organisasi dengan tumpuan kepada aspek kepuasan bekerja, komitmen organisasi, hasrat para pekerja untuk melakukan pusing ganti dan ciri-ciri tugasan. Oaripada keputusan analisis ujian-t tidak bersandar yang dijalankan didapati bahawa persoalan yang menumpukan kepada aspek kepuasan bekerja bagi subjek yang melaksanakan MS ISO 9000 dengan pasukan yang tidak melaksanakan menunjukkan terdapat perbezaan yang signifikan. Persoalan lain yang memfokus kepada aspek komitmen organisasi antara pasukan yang melaksanakan MS ISO 9000 dengan yang tidak melaksanakannya adalah ditolak

    The indigenous people are rich with unique customs and culture that have been passed down through ages. These people are deeply influenced by the beliefs of animism and nature. They uphold the custom practised in all aspects of life. The presence of Islam at the centre of their lives brought significant changes in the framework of religious life to the belief in the Oneness of God and at the same time clashes occurred with local custom. To oppose the tradition means to create disagreement with the locals and erode their identity which will lead to conflict if it is not managed in harmony. Nevertheless, Islam is a universal religion which is able to play a role in interacting with local customs through various instruments, including the `urf. In this regard, this study aims to discuss the role of `urf in managing the culture of the indigenous people. To achieve the objective, the researchers have utilized the library research by referring to the literatures related to the discussion of Islamic scholars in various disciplines of fiqh and usūl al-fiqh. The research found that the tradition of the indigenous people can be maintained, either to be fully accepted when it is not contradicted to the Islamic law, or to be modified so it will be parallel with the standard of the `urf. Whereas, tradition which violates the law especially the practice of animism is intransigently rejected. Masyarakat orang asli kaya dengan pelbagai adat resam dan budaya unik yang diwarisi sejak turun temurun. Tradisi mereka banyak dipengaruhi oleh kepercayaan animisme dan alam semula jadi. Mereka menjunjung tinggi adat yang diamalkan dalam segenap aspek kehidupan. Kehadiran Islam di tengah kehidupan mereka membawa perubahan yang signifikan dalam kerangka kehidupan beragama kepada kepercayaan Tuhan yang Esa dan pada masa yang sama berlaku pertembungan dengan adat masyarakat setempat. Menentang tradisi bererti membawa kepada permusuhan dengan warga setempat dan menghilangkan identiti mereka sehingga jika tidak dilestarikan secara harmoni akan menimbulkan konflik. Namun begitu, Islam sebagai agama yang universal mampu berperanan dalam interaksi dengan adat setempat melalui pelbagai instrumen antaranya adalah uruf. Sehubungan itu, kajian ini akan membincangkan peranan uruf dalam menangani budaya masyarakat orang asli. Bagi mencapai objektif tersebut, pengkaji menggunakan kajian kepustakaan sepenuhnya dengan menelusuri literatur berkaitan dengan perbincangan sarjana Islam dalam pelbagai disiplin ilmu fiqh dan usul fiqh. Hasil kajian mendapati tradisi masyarakat orang asli boleh dikekalkan sama ada diterima sepenuhnya sekiranya tidak bertentangan dengan hukum syarak atau dilakukan modifikasi supaya selari dengan piawaian uruf. Manakala adat yang menyalahi terutamanya fahaman animisme ditolak sepenuhnya tanpa kompromi

    The spread of Islam in the Archipelago especially in Sabah has produced two forms of interactions which are Islamization and sincretizing. Islamization process that occured subtly and gradually at that time caused Bajau community easy to accept Islam without being forced. However, there are some practices of Bajau community that closely linked to the animism belief still being practiced to produced a process of syncretism. The objective of this article is to introduce Islamic methods by suggesting guidelines or legislation parameter in interacting with syncretism in traditions of Bajau community in Sabah. In facing syncretism between the traditional practices of Bajau with the teaching of Islam, there are at least three Islamic approaches towards the developed culture among Bajau community which are to accept, modify or reject. Therefore, an appropriate method of Islamic law need to prevail to handle the phenomenon in ensuring the balance between idealism contained in Islamic law with the reality of its implemantation in Bajau community. The study found that there are many symptoms of syncretism occured in tradition and culture of Bajau community which are difficult to know whether it is a genuine Islamic teachings or a relic of pre-Islamic tradition

    The issue of inheritance is constantly being debated especially pertaining to the 2:1 ratio of division between male and female. This article tends to focus on this inheritance polemic in the perspective of Islamic jurisprudence, either the 2:1 portion of man and woman is a rigid allocation, or there are another kind of apportionment that prioritise woman rather than man. It also discusses wether the inheritance rights might change according to the change of socio-cultural context to the equal division for man and woman as an alternative solution for the issue in Malaysian society. In order to achieve this objectives, the researcher had been pursuing a qualitative research which was focusing in library data collection. Result from the research shows that Shari`ah is just enough in handling this particular issue, in the meantime the Malay culture also manage to balance the portion of distribution 2:1 with an alternative solution called musalahah. The 2:1 division is also not a uniform in nature, even there are some other kind of divisions that prioritise woman over man in their inheritance.   Keywords: Inheritance, Female, Shariah, Gender Inequity, Islamic Law.   Isu hak pusaka wanita sering diperdebatkan terutamanya melibatkan pembahagian dua nisbah satu (2:1) antara lelaki dan wanita. Artikel ini akan memfokuskan kepada polemik pusaka wanita dari perspektif hukum Islam sama ada nisbah lelaki wanita 2:1 bersifat rigid, atau ada peruntukan lain yang melebihkan kaum wanita berbanding lelaki. Artikel ini turut membincangkan sama ada hak tersebut boleh berubah dengan perubahan sosio budaya masyarakat dan berubah menjadi hak yang sama rata antara lelaki dan wanita serta penyelesaian alternatif kepada isu tersebut dalam konteks masyarakat Islam di Malaysia. Bagi mencapai objektif tersebut, pengkaji telah menjalankan kajian berbentuk kualitatif melalui proses pengumpulan data yang lebih memfokuskan kepada metode kepustakaan dan dianalisis secara diskriptif. Hasil kajian mendapati syariat Islam bersifat adil, dan budaya masyarakat Melayu mampu mengimbangi kadar pembahagian 2:1 dengan penyelesaian alternatif melalui kaedah muafakat (musalahah) dan kadar 2:1 juga tidak bersifat menyeluruh, malah ada kadar yang melebihkan wanita berbanding lelaki.   Kata kunci: Harta Pusaka, Wanita, Syariat, Ketidakadilan Gender, Hukum Isla

    Peralihan negara memasuki fasa endemik dapat menyaksikan perubahan norma baharu yang diamalkan oleh masyarakat sebelum ini sudah mula dilonggarkan dan kembali kepada tatacara kehidupan yang asal susulan kejayaan program vaksinasi COVID-19 negara dapat dicapai. Peralihan fasa endemik ini telah memberi peluang dan kemudahan kepada manusia untuk merancakkan kembali kegiatan ekonomi, politik, sosial, pendidikan termasuk aktiviti keagamaan. Setiap fasa peralihan daripada normal kepada pandemik dan daripada pandemik kepada endemik telah memberi kesan terhadap perubahan hukum Islam. Ia melibatkan perubahan yang bersifat sementara dan kekal. Antara perubahan hukum yang bersifat sementara adalah berkaitan hukum penangguhan ibadah solat jumaat dan solat jemaah, penjarakan saf, pengehadan bilangan jemaah, larangan merentas negeri, nikah atas talian, kaedah tayamum ke atas jenazah COVID-19 serta penangguhan ibadah haji dan umrah. Manakala hukum yang masih kekal sehingga kini seperti hukum penggunaan vaksin COVID-19. Justeru kajian ini akan menganalisis perubahan hukum dari fasa pandemik kepada fasa endemik COVID-19 di Malaysia. Pengkaji menggunakan pendekatan kualitatif melalui data-data perpustakaan yang digunakan sepenuhnya dan dianalisis secara deduktif. Hasil kajian mendapati perubahan hukum yang berlaku dalam fasa endemik membuktikan hukum islam adalah bersifat fleksibel, mempunyai ciri al-murunah dan menepati kaedah “tidak diingkari hukum dengan perubahan zaman”. Ini kerana penetapan hukum yang berlaku semasa pandemik hanyalah bersifat sementara dan akan kembali kepada hukum yang asal apabila keadaan kembali normal. Following the success of the nation's COVID-19 immunisation programme, the society's new rules were eased as the nation entered the endemic phase and returned to the previous way of life. This endemic phase transition has provided opportunities and facilities for people to revive economic, political, social, and educational activities, including religious ones. Each phase of the growth from normal to the pandemic and from pandemic to endemic impacted changes in Islamic law. It involves both temporary and permanent changes. Among the temporary legal changes are related to the law of suspension of Friday and congregational prayers, safe distancing in prayer rows, limiting the number of congregations, cross-state bans, marriage contract through a virtual conference, performing tayammum to the deceased person and postponement of Hajj and Umrah. While the law that remains now is the law on the use of the COVID-19 vaccine. Therefore, this study will analyze the change in law from the pandemic stage to the endemic phase of COVID-19 in Malaysia. The researcher used a qualitative approach through library data that was fully utilized and analyzed deductively. The study results found that the changes in the law that took place in the endemic phase prove that Islamic law is flexible, has the characteristics of al-murunah and complies with the method "the law is not disobeyed by the changing times". It is because the stipulation of the law that applies during the pandemic is only temporary and will return to the original hukm when the situation returns to normal

    Dalam masyarakat Islam, sering timbul polemik antara adat yang diamalkan dengan syariat yang diwahyukan. Kerap kali dalam interaksi yang berlangsung akan berlaku proses penyesuaian agar adat yang diamalkan tidak bertentangan dengan syariat. Dalam kajian ini, pengkaji memfokuskan terhadap analisis adat perkahwinan masyarakat Murut Tahol Islam di daerah Nabawan, Sabah menurut perspektif hukum Islam. Asasnya, terdapat dua bentuk perkahwinan masyarakat Murut Tahol yang beragama Islam, iaitu pertama, berasaskan syariat dan yang kedua, berasaskan adat. Dalam perkahwinan berasaskan adat ini, terdapat empat bentuk adat iaitu pakalangan, limpuhu, bului dan tinauh. Justeru, bagi mencapai objektif yang ditetapkan, kajian berbentuk kualitatif ini mengaplikasikan kajian perpustakaan dan kajian lapangan. Pengumpulan data dijalankan melalui metode dokumentasi dan temu bual separa struktur. Data yang dikumpulkan telah dianalisis secara induktif. Hasil kajian mendapati terdapat adat perkahwinan masyarakat Murut Tahol beragama Islam yang menepati syariat seperti adat merisik, pemberian hadiah, kaedah pembayaran beriansampai mati dan poligami. Di samping itu, terdapat adat yang bertentangan dengan syariat seperti tamong pengayangan (tunang angkat), perkahwinan dengan sepupu dan sogit. Sehubungan itu, masyarakat Islam Murut Tahol perlu berhati-hati dalam pengamalan adat berkenaan agar tidak bertentangan dengan syariat Islam

    The foraging tactics of chestnut-winged Babbler (Stachyris erythroptera) and Abbott’s Babbler (Malacocincla abbotti) in a Lowland Rainforest, Malaysia

    Foraging pattern of Chestnut-winged Babbler (Stachyris erythroptera) and Abbott’s Babbler (Malacocincla abbotti) was studied in Lenggong Valley, Perak from July 2010 until July 2011. The study examines the patterns of foraging height, foraging substrates and attack manoeuvres of two babbler species (Family: Timaliidae), to explain how these trophically similar species can coexist in the same habitat; a central question in ecology. Information on the foraging height, foraging substrate and attack manoeuvres was collected independently for each foraging bird. Principal component analysis and Pearson’s correlation analysis showed that these two species used similar proportion of foraging height (>0-2 m above the ground) and foraging substrate (dead leaves), but differed in the use of attack manoeuvres. The Chestnut-winged babbler used primarily stretching manoeuvre, whereas the Abbott’s babbler used primarily gleaning manoeuvre. This niche separation allowed these species to coexist in the same area, thus follows the Gause’ Law of competitive exclusion, that states two species occupying the same niches will not coexist forever

    This paper discusses al Qaradawi’s perspective on several issues in zakah of agricultural wealth. It analyzes his juristic views on the issues as reflected in his master piece Fiqh al Zakah. This paper focuses mainly on three issues, namely, nisab of agriculture, deduction of debts and expenses and zakah on rented land. It is found out that al Qaradawi’s perspectives on zakah of agricultural wealth based on the maqasid and he goes beyond the typical approaches of many Muslim scholars who only rely on the usul fiqh methods in deducing the rulings from the legal texts in Al Quran or Al Sunnah
