Konstitucinis Teismas kaip žmogaus teisių apsaugos institucija
The aim of this article is to highlight the role of the Constitutional Court in strengthening the protection and defence of the human rights in Lithuania. In order to achieve this aim, the following tasks are raised and addressed in the paper: 1) to reveal the forms in which the Constitutional Court contributes to the strengthening of the human rights protection; 2) to analyze the most important constitutional justice cases in the field of the human rights decided by the Constitutional Court and the most important principles of the official constitutional doctrine of the human rights; 3) to reveal how the Constitutional Court contributes to the protection of the human rights by examining the applications of courts and natural and legal persons.

The article analyzes the temporal effects of the Constitutional Court of the Republic of Lithuania’s rulings, i.e., ex tunc, ex nunc, and pro futuro elements of judicial decisions in the constitutional justice model of Lithuania. This article aims to reveal the development of the doctrine of exceptions of the constitutionaly established rule, that the force of the decisions of the Constitutional Court is directed to the future, in the jurisprudence of a Constitutional Court and further development of this institute inter alia in light of the 2019 amendment to the Constitution of the Republic of Lithuania, which introduced a mechanism for lodging an individual constitutional complaint.Straipsnyje nagrinėjama Lietuvos Respublikos Konstitucinio Teismo nutarimų teisinė galia laiko požiūriu, t. y. ex tunc, ex nunc ir pro futuro sprendimų teisinės galios elementai Lietuvos konstitucinės justicijos modelyje. Straipsnyje siekiama atskleisti Konstitucijos 107 straipsnio 1 dalyje įtvirtintos taisyklės, kad Konstitucinio Teismo sprendimų galia yra nukreipiama į ateitį, išimčių doktrinos raidą Konstitucinio Teismo jurisprudencijoje, ir tolesnes šio instituto raidos perspektyvas, inter alia, atsižvelgiant į 2019 m. priimtą Konstitucijos pataisą dėl individualaus konstitucinio skundo įtvirtinimo
Emotional Intelligence as a Key Concept to Successful Police Leadership and Cooperation in the Global World
The new realities of police cooperation and leading in the international level ask for culturally attuned and emotionally sensitive global police leaders who can react to the challenges of the particular foreign environments of various countries and complex interpersonal work situations. Also for police leaders with the different frame of responsibility, it is important to be self-aware and empathetic and be able to read and regulate their own emotions while intuitively grasping how others feel and gauging their organization’s emotional state. The most gifted leaders accomplish that by using a mysterious blend of psychological abilities known as EI. Економічний вплив організованої злочинності на державну безпеку
Organised crime is changing and becoming increasingly diverse in its methods, group structures and impact on society. This article aims to research, on the one hand, the impact of organized crime on state’s economy, on the other hand – to analyse the possible legal and economic measures tackling and preventing organized crime activities. The article contains results of the analysis of international, regional and national legal acts and the secondary analysis of statistical data of European Union agencies and international organizations. The author used a variety of methods: from selection and analysis of primary and secondary sources to descriptive, comparative and synthesis methods. Such analysis required multitudinous, broad and diverse base of empirical data, which were collected from the international, regional, national organizations and agencies, as well as scientific, operational and theoretical reports related to the issue of organised crime and impact of this phenomenon to the state and the society.Организованная преступность меняется и становится все более разнообразной по своим методам, групповым структурам и влиянием на общество. Целью публикации является исследование, с одной стороны, влияния организованной преступности на экономику государства, с другой – анализ возможных правовых и экономических мер по преодолению и предотвращению такой деятельности. Статья содержит результаты анализа международных, региональных и национальных правовых актов и вторичного анализа статистических данных органов Европейского Союза и международных организаций. Автор использовал различные методы: от отбора и анализа первичных и вторичных источников до описательных, сравнительных и методов синтеза. Такой анализ проведен на многонациональной, разнообразной базе эмпирических данных, полученной от международных, региональных, национальных организаций и ведомств, а также с научных, оперативных и теоретических докладов, связанных с проблемой организованной преступности и влиянием этого явления на государство и общество.Організована злочинність змінюється й стає все більш різноманітною за своїми методами, груповими структурами та впливом на суспільство. Метою публікації є аналіз, з одного боку, впливу організованої злочинності на економіку держави, з іншого – можливих правових й економічних заходів щодо її подолання та запобігання організованій злочинній діяльності. Стаття містить результати вивчення міжнародних, регіональних та національних правових актів та вторинного аналізу статистичних даних органів Європейського Союзу та міжнародних організацій. Автор використовував різноманітні методи: від відбору та аналізу первинних та вторинних джерел до описових, порівняльних та методів синтезу. Такий аналіз було здійснено на багатонаціональній різноманітній базі емпіричних даних, які містилися у міжнародних, регіональних, національних організаціях та відомствах, а також результатах наукових, оперативних та теоретичних доповідей, пов'язаних з проблемою організованої злочинності та впливом цього явища на державу та суспільство
INVOLVEMENT OF SCHOOLS IN THE PROCESS OF PROTECTION FROM DOMESTIC VIOLENCE
Specific activities of the schools, functions and responsibilities delegated by national and international laws lead to an obligation to involve in some criminal proceedings for violence against children in close environment, for example reporting about domestic violence against children to competent authorities, providing them with the relevant data, etc. The aim of this work is to establish schools’ obligations relating to information about the possible violence against child in the near surrounding. The tasks were achieved using the following methods: method of analysis of scientific literature, a comparative analysis, method of systemic analysis, the traditional method of the analysis of documents. Additionally, the empiric method was used and deep one-on-one interview with the experts was implemented. The aim was to identify the approach towards the need of school's participation in criminal proceedings regarding violence in the near environment of the persons who are directly familiar with the examined problem. The analysis suggests that the duty to report is often performed defectively, and the application of legal liability for failure to comply with this obligation is ineffective. Different reasons lead to this situation both legal and non-legal: incomplete special legal regulation, lack of legal knowledge, psychological, social and other factors determined by specific activities of schools. Not inadequacy of the legal regulation but its inappropriate implementation is most problematic. Enforcing detailed national as well as schools' local legal regulation, training of all staff, application of special preventive programs, including special measures in to common practices, cooperating with competent institutions are the measures which could lead to the adequate performance of the obligations. Accordingly, schools have human and legal resources to involve in some criminal proceedings for domestic violence against children more actively, especially in reporting about cases of violence
Lietuvos individualaus konstitucinio skundo modelio privalumai ir trūkumai
This article analyses the main elements of the model of individual constitutional complaint enshrined in the Constitution of the Republic of Lithuania and in the ordinary legislation. These elements are: objects of individual constitutional complaint; subjects entitled to lodge individual constitutional complaint and filters, which reduce the flow of individual constitutional complaints. This article aims to reveal the legal framework regulating these elements and to identify its advantages and disadvantages.Straipsnyje nagrinėjami pagrindiniai Lietuvos Respublikos Konstitucijoje ir ordinarinės teisės aktuose įtvirtinti konstitucinio skundo modelio elementai: individualaus konstitucinio skundo objektai; subjektai, turintys teisę kreiptis su individualiu konstituciniu skundu, ir individualių konstitucinių skundų srautą mažinantys filtrai. Straipsniu siekiama išanalizuoti šiuos elementus reglamentuojantį teisinį reguliavimą ir atskleisti jo privalumus ir trūkumus

This article analyzes the objects of verification of the constitutionality of legal acts in the Constitutional Court of the Republic of Lithuania. This article aims to reveal the development of the official constitutional doctrine of the Constitutional Court on the issue of objects (according to the different breakdowns of this doctrine highlighted in the article) of verification of the constitutionality of legal acts, which are entrenched in the Articles 102 and 105 of the Constitution of the Republic of Lithuania, and the further development of this institute inter alia in light of the 2019 amendment to the Constitution, which introduced a mechanism for lodging an individual constitutional complaint.Straipsnyje nagrinėjami Lietuvos Respublikos Konstitucinio Teismo atliekamos teisės aktų konstitucingumo patikros objektai. Individualus konstitucinis skundas ir „Romuvos“ byla
The article deals with the legal basis for and the procedure of granting the status of State-recognised religious association to religious communities in Lithuania. It is based on the case study of the negative experience of the Ancient Baltic religious association Romuva, which was not granted, by the Parliament, the said status. Subsequently, the association won its case in the European Court of Human Rights (8 June 2021), the Lithuanian Constitutional Court adopted the ruling (7 September 2021), whereby it approved as constitutional the legislation on which the association’s request to be granted this status was based, and the relevant statute was amended to ensure greater transparency of the granting procedure. Despite that, the Parliament repeatedly refused to grant the said status to the association involved. The article explores in great detail the parliamentary debate during the examination of both the first and the second requests. The authors explore the possibilities for the association to pursue further litigation in the Lithuanian courts, including making use of the individual constitutional complaint to the Constitutional Court, the new measure introduced in the Lithuanian legislation only in 2019. It is demonstrated that the case-law of the Constitutional Court itself (of 2010, as well as post-2019) prevents the association from making effective use of that measure, thus leaving it with no other alternative than lodging a new application to the European Court of Human Rights, which then would have to decide on whether, in the cases like this, an individual constitutional complaint is to be considered an effective measure within the meaning of Article 35 of the European Convention on Human Rights which has to be exhausted at the domestic level.
