TINJAUAN YURIDIS TERHADAP PASAL 95 KITAB UNDANG-UNDANG HUKUM ACARA PIDANA BAGIAN I TENTANG GANTI KERUGIAN SALAH TANGKAP

Penelitian ini dilakukan dengan tujuan untuk mengetahui bagaimana pelaksanaan ganti kerugian yang dapat diberikan kepada tersangka, terdakwa, atau terpidana yang mengalami penangkapan dan apa saja kendala dalam pemberian ganti kerugian terhadap tersangka, terdakwa, atau terpidana yang mengalami penangkapan.  Dengan menggunakan metode epenelitian yuiridis normatif, disimpulkan: 1. Ganti Kerugian merupakan suatu lembaga hukum dalam hukum pidana di Indonesia. Kewenangan untuk memberikan ganti kerugian bagi seorang terpidana diserahkan kepada negara berdasarkan ketentuan-ketentuan perundang-undangan yang berlaku. Pengaturan ganti kerugian diatur dalam hukum acara pidana KUHAP, PP No 27 tahun 1983, UU No 4 tahun 2004 tentang kekuasaan kehakiman serta dalam keputusan Menteri Keuangan No. 983/KMK.01/1983 mengenai tata cara pemberian ganti kerugian. 2. Pengajuan ganti kerugian atas putusan yang telah diajukan sampai dalam tahap pengadilan diselesaikan oleh Pengadilan Negeri. Bagi terpidana, proses pengajuan ganti kerugian diawali dahulu dengan pengajuan permohonan peninjauan kembali. Tujuannya adalah untuk dapat membatalkan putusan yang sebelumnya. Akan tetapi tuntutan ganti kerugian tersebut tidak selamanya di kabulkan oleh Hakim. Pengabulan ganti kerugian tergantung pula pada pertimbangan hakim dan pembuktiannya. Pengaruh Pendidikan Kesehatan Terhadap Tingkat Pengetahuan Siswa Tentang Bahaya Merokok Di SMA Negeri 1 Manado

: Cigarettes are processed tobacco including cigars wrapped generated or other forms of plant Nicotianatabacum, NicotianaRustica, and other species that contain nicotine and tar with or without substances. Smoking is one of the addictive substance. Dependency on cigarettes smokers will attack the body\u27s physical and the psychological and can cause a variety of diseases and risk is a custom with no positive purpose to human health. Health effects of smoking that cause hair loss disorders of the eye, resulting in various diseases such as heart disease, stroke, lung cancer, breast cancer, cervical cancer.The purpose of this study is to determine the effect of health education on students\u27 level of knowledge about the dangers of smoking in SMA Negeri 1 Manado. Study design is Pre-Experimental with Desaign one group pre-post test, sample selection by purposive sampling and samples taken in this study were 100 students of SMA Negeri 1 Manado who have met the criteria for inclusion and exclusion criteria. Furthermore, the data obtained were processed using SPSS version 16.00 and analyzed using wilcoxon with a significance level (α) of 0.05. The Conclusion of this research have a significant effect of health education on the level of knowledge of students about the dangers smoking with a value P = 0.000

Hubungan Antara Tingkat Stres Dengankemandirian Pada Orang Tualanjut Usia Di Desatombasian Atas Kecamatankawangkoan Barat

Stres adalah reaksi tubuh terhadap situasi yang menimbulkan tekanan, Perubahan dan ketegangan emosi. Keluhan yang dirasakan pada orang yang mengalami stres adalah pemarah, cemas, sedih, pesimis, menangis, mudah tersinggung, mimpi buruk, gangguan konsentrasi dan daya ingat. Bila tidak diatasi, permasalahan tersebut akan menimbulkan gangguan sistem, timbulnya penyakit dan manifestasi klinik, serta menurunya ADL (Activities of Daily Living). Tujuan penelitian ini adalah untuk mengetahui hubungan tingkat stres dengan kemandirian orang tua lanjut usia yang ada di desa Tombasian Atas Kecamatan Kawangkoan Barat. Metode penelitian ini menggunakan survei analitik, dan menggunakan pendekatan cross sectional dimana pengumpulan data, baik variabel independen maupun variabel dependen, dilakukan secara bersama-sama atau sekaligus. Populasi pada penelitian ini adalah seluruh lanjut usia di Desa Tombasian Atas Kecamatan Kawangkoan Barat yang berjumlah 60 jiwa. Teknik pengambilan sampel menggunakan Total sampling. Hasil uji statistik diperoleh nilai p = 0,035. Hal ini berarti nilai p lebih kecil dari (0,05). Kesimpulan penelitian ini yaitu ada hubungan bermakna antara tingkat stres dengan kemandirian pada orang tua lanjut usia.. Saran dari penelitian ini adalah agar lanjut usia dan keluarga dengan lanjut usia mampu meminimalisasi tingkat stres sehingga dapat mencapai tingkat kemampuan lanjut usia seoptimal mungkin

Hubungan Antara Tingkat Stres Dengan Perilaku Merokok Pada Mahasiswa Fakultas Teknik Universitas Sam Ratulangi

: Stress is the reaction or the body\u27s response to psychosocial stressors of mental stress or life burden, the classification of stress levels among others, mild, moderate, and severe stress. Smoking behavior is an activity done by individuals in the form of burning and sucking it and can cause smoke that can be inhaled by the people around himThe purposeof this study to analyze the relationship between stress levels with smoking behavior in students of the Faculty of Engineering Sam Ratulangi University. The research method is descriptive analytic retrospective study design. The sampling technique in this research is purposive sampling in this research is total sampling with 61 samples. The data collection is done by using a questionnaire and interview sheet. Processing data using computer program with Pearson chi-square test with a significance level of 95% (α =, 005). ). The results using the Pearson chi-square analysis showed a significant correlation between the stress level and smoking behavior on the students (p = 0,000). Conclusion there is correlation between stress level with smoking behavior at student of Faculty of Engineering Sam Ratulangi University

Pengaruh Pendidikan Kesehatan Terhadap Tingkat Pengetahuan Siswi Tentang Pencegahan Kanker Serviks Di SMA Negeri 1 Manado

: Cervical cancer is a Malignant tumor growing inside the uterus or the cervix. Cervical cancer occuring the uterine cervix, an area reproductive organs in a woman who was the entrance to the uterus and positioned between the womb (uterus) with coitus (vagina). Health Education is the process of change behavior that dynamic, where such change is not just about the process of the transfer of material or the theory of a person to another person and neither set of procedures, but the changes occur awareness of within individual, group, or society own. This purpose to know the effect of health education on the level of student knowledge about cervical cancer prevention in SMA Negeri 1 Manado. The study design is Pre-Experimental design with one group pre-post test to assess the effect of health education on the level of student knowledge . The sample in this study that is numbered 100 students of SMA Negeri 1 Manado who have met the criteria for inclusion or exclusion criteria using purposive sampling technique. Hubungan Karakteristik Dan Perilaku Masyarakat Dengan Kejadian Malaria Di Rumah Sakit Sinar Kasih Tentena Kabupaten Poso Provinsi Sulawesi Tengah

:Malaria is disease causedby protozoan parasites of genus plasmodium. That are transmitted through the bite of the Anopheles and still a community health problem in Indonesia.The objective of this study was to know the relationship characteristics between and behavior of society with the incidence of malaria in Sinar Kasih Tentena Hospital. This research using by cross sectional method.Collecting of Data by using observation and questionnaire as the respondent houses. The sampling method is purposive sampling.Total of sample 62 respondents consists of malaria Plasmodium falciparum and Plasmodium vivax. Univariate analysis using by SPSS and bivariate analysis were processed by chi-square test for probability of 95% (α=0,05). The result showed people's characteristics: age (p=0.349), education (p=0.840), occupation (p=0.145) and social behavior: costum activity outside the home at the night (p=0.003), use mosquito nets habits(p=0.000), use of anti mosquito (p=0.007). Conclusions: there was no relationship between the characteristics of people with incidence of malaria, and there was a relationship between the behavior of people with malaria incidence. Suggestion: Medical worker be expected for more active in counseling to society around district, then the society itself for more motivated to using mosquito nets habits and protective clothing like jacket or using anti mosquito that used on skin. They have to use it before leaving their home at night. Then, one more important thing is awareness to terminate the mosquitos nests (place to live and multiply)

Hubungan Antara Nyeri Gout Arthritis Dengan Kemandirian Lansia Di Puskesmas Towuntu Timur Kecamatan Pasan Kabupaten Minahasa Tenggara

: Gout is a disease characterized by sudden onset, recurrent and accompanied by very painful arthritis due to the deposition of crystals of monosodium urate or uric acid accumulate in the joints due to high levels of uric acid in the blood. Gout arthritis is one of the health problems that often occur in elderly. The purpose of this research is to know the relationship of gout arthritis pain to the independence of the elderly in the East Towuntu Public Health Center district of Pasan regency of Southeast Minahasa with the number of samples was 30 respondentsThis research method is using cross sectional approach, the sample selection is done by sampling methods saturade. This research uses statistical analysis chi square test with á = 0,05. The result obtained value of p = 0,000 where p < 0,05 then Ho is rejected. Conclusions of this research that there is a relationship between the gout arthritis pain with elderly's independent in the East Towuntu Public Health Center district of Pasan regency of Southeast Minahasa. Suggested that health professionals can pay attention to any complaints of pain in the elderly to overcome the depedences of the elderly cause of the pain

Karakteristik Surimi Yang Dibuat Dari Hasil Pencucian Daging Ikan Cakalang (Katsuwonus Pelamis L) Dengan Air Dingin (± 4ºc)

This research intended to study the effect of washing period of skipjack (Katsuwonus pelamis L) meat with cold water to the chemical and physical properties of surimi. The functional properties of surimi was tested either by physical or chemical analysis. In this study we measured folding test, texture and fat content. A complete randomized design were designated for this study with washing period as a treatment ( 0, 1, 2, 3, or 4 min). The average value of folding test were 2.2, 2.6, 3.0, 3.8 and 4.6, respectively. There is an increment of folding test value as the washing period increased. The average value of the texture analysis were 3.0, 3.8, 4.4, 5.1 and 5.9. Likewise, the longer the washing time, the firmer the texture. However, as the washing period increased, the fat content of surimi tend to decrease

Mutu Ikan Cakalang (Katsuwonus Pelamis L) Asap Yang Direndam Dengan Larutan Kulit Buah Manggis (Gracinia Mangostana Linn).

The purpose of this study was to determine the quality of smoked skipjack (Katsuwonus pelamis L) smoke pre-treated in a solution of mangosteen peel with a concentration of 3, 4 and 5%, with various soaking time, then stored and observed at 0, 3, 6, and 9 days. The results showed that the highest value of total plate count (TPC) was found in the fish sample storage for 9 days, soaking with a concentration of 3% for 30 minutes. Meanwhile, the lowest TPC value was discovered for the fish samples that did not undergo storage, and immersed in a solution of 5% for 30 minutes. Furthermore, the highest TVB value (Total Volatile bases) was detected in fish samples soaked with 3% solution of the mangosteen for 15 minutes (59.22mg N/100g) while the lowest value obtained on the fish sample marinated with 5% concentration for 15 minutes and did not experience storage (5.04mg N/100g)
