Les chiffres macabres de la létalité policière.L’évaluation juridique des “Actes de résistance” à Rio de Janeiro
Cet article prĂ©sente les principaux rĂ©sultats de la recherche intitulĂ©e «Actes de RĂ©sistance”: une analyse des homicides commis par la police dans la ville de Rio de Janeiro», rĂ©alisĂ©e entre les annĂ©es 2009 et 2011. Le principal objectif de la recherche a Ă©tĂ© de suivre un Ă©chantillon du traitement juridique des cas d’assassinat commis par la police qui ont reçu l'enregistrement initial comme "homicide rĂ©sultant d’Actes de RĂ©sistance", Ă savoir avec la lĂ©gitime dĂ©fense prĂ©sumĂ©e. Nous avons cherchĂ© Ă analyser la filière pĂ©nale pour ces cas et comprendre comment sont produites les classifications et les rĂ©cits officiels sur les dĂ©cès dans cette voie. Nous avons analysĂ© la façon dont ils ont Ă©tĂ© enquĂŞtĂ©s par la police et les poursuites des cas par le Parquet. L’objectif a Ă©tĂ© d'identifier les facteurs qui influencent le cours des enquĂŞtes et les pratiques impliquĂ©es dans la construction des faits de manière Ă lĂ©gitimer ou Ă remettre en question la lĂ©galitĂ© de l'action de la police.This article presents the main results of the research entitled "Acts of Resistance: an analysis of the homicides carried out by the police in the city of Rio de Janeiro", between the years 2009 and 2011. The main purpose of the research was to follow a sample of the judicial treatment of cases of murder committed by the police which were initially registered as "homicide resulting from Acts of Resistance", in other words with the presumption of legitimate defence. We sought to analyse the penal process for these cases and to understand how the classifications and official accounts of the deaths so categorized are produced. We analysed how they were investigated by the police and pursued by the prosecution. The aim was to identify the factors which influence the course of the investigations and the practices involved in the construction of the events in order to legitimize or to challenge the legality of the police action.Este artĂculo presenta los principales resultados de la investigaciĂłn titulada «Actos de resistencia”: un análisis llevado a cabo entre 2009 y 2011 sobre los homicidios perpetrados por la policĂa en la ciudad de RĂo de Janeiro. El principal objetivo de la investigaciĂłn fue seguir una muestra del tratamiento jurĂdico de los casos de asesinato cometidos por la policĂa que inicialmente han sido registrados como "homicidio resultante de Actos de resistencia", con la presunciĂłn de la legĂtima defensa. Hemos procurado analizar el procedimiento penal para estos casos y comprender cĂłmo se producen las clasificaciones y los relatos oficiales sobre los decesos clasificados segĂşn este procedimiento. Se ha analizado cĂłmo estos casos han sido investigados por la policĂa y procesados por las autoridades judiciales, con el objetivo de identificar los factores que influyen en el curso de las pesquisas y las prácticas implicadas en la construcciĂłn de los hechos, de manera de legitimar o de cuestionar la legalidad de la acciĂłn policial
