Problems with the islamic legal system regarding child marriages in Indonesia during the covid-19 pandemic period

The high number of child marriages during the Covid-19 pandemic period poses problems related to the Islamic legal system in Indonesia. This study aims to describe the problems of the Islamic legal system regarding the phenomenon of child marriages during the pandemic period in Indonesia. This paper is the result of a qualitative research with a socio-legal analysis approach, that is based on Friedman Hayden's legal system theory. The results of the study show that there are three substantial problems with the Islamic legal system, namely: (1) the problem associated with the legal substance where the Marriage Law stipulates the age of a bride to increase from 16 to 19-year-old as contained in article 7 paragraph (1) of the Marriage Law number 16 of 2019, while at the same time it enables child marriages to be carried out through a marital dispensation request, it acknowledges marital vows (ithbat), and there is an absence of legal sanctions for violating the Marriage Law; (2) the problem related to the legal structure of child marriages that is rooted in the formation, enforcement, and development of child marriage law; and (3) the problem of legal culture in relation to the legal behavior of child marriage, unregistered marriages (sirri) for minors, and the lack of social arrangements to promote the culture of marriage at a mature age. Therefore, this paper offers a reconstruction of the Islamic legal system in terms of legal substance, legal structure, and legal culture to minimize child marriage practices in Indonesia

Ziarah Wali di Indonesia dalam Perspektif Pilgrime Studies

Pilgrimage studies is multidisciplinary studies in religious studies involving many perspectives and approaches in the social sciences. Therefore, it cannot be separated from the development of other studies, particularly tourism studies that leads to the current study on religious tourism. This article is a literature review generally tracing the development of theoretical tendencies of the pilgrimage studies. Based on an understanding of some theoretical tendencies, this article attempts to look at and examine the emerging trends in the study of saint’s pilgrimage in Indonesia, as one of the variants in pilgrimage studies. The study attempts to scrutiny (1) the dominant theories of the pilgrimage studies, (2) the study of saint’s pilgrimage in Indonesia, continued with (3) what aspects relate to the study of saint’s pilgrimage, and (4) which are the focus of discussions that still need to be discussed and explored relating to the study of saint’s pilgrimage in Indonesia. The results show that the pilgrimage studies experience recent theoretical developments and trends that emphasize postmodern reasoning, which makes pilgrimage studies vary with a great influence on the study of pilgrimage to the tourism studies.&nbsp

Analisis Tingkat Berpikir Geometri Siswa dalam Menyelesaikan Soal Bangun Ruang Sisi Datar Berdasarkan Teori Van Hiele pada Siswa Kelas VIII SMP Negeri 2 Baki

The aim of this study is to describe the level of thinking in the geometry of students of 8th grade in order to solve the flat side of space area problems based on Van Hiele Theory. The type of this study is a qualitative research conducted in SMP Negeri 2 Baki on even semester in the academic year 2016/2017. The subject of this study is students of 8th grade of SMP Negeri 2 Baki. The technique collecting data was conducted by test, interview, and documentation. The technique of data analysis uses qualitative data analysis method. The results of this study showed (1) Students who have higher thinking skill has been able to know the indicators of each level, it means that students have reached the level of visualization, level of analysis and level of informal deduction; (2) Students with medium thinking skill are only able to know the indicators of the level of visualization and level of analysis, it means that students reach the level of visualization and level of analysis, but students have not been able to achieve the level of informal deduction. (3) Students with low thinking skill are only able to know the indicator of the level of visualization; it means that students are able to achieve the level of visualization.
