This background study focuses on the right to freedom of movement of refugees. It reviews the law pertaining to this freedom from the perspective of the spatial journey of refugees. This focus on the law means that extralegal considerations will not be taken into consideration. The analysis will not proceed from any perceived need for limits that should be accepted as “a product of realism about the strains that migration, especially high-volume migration or sudden influxes, can bring to a society.

UNHCR's Parallel Universe : Marking the Contours of a Problem

De universele internationale vluchtelingenwetten, die ontstonden in het kielzog van de Tweede Wereldoorlog - bestaande uit het Verdrag van 1951 en het protocol van 1967 betreffende de status van vluchtelingen, en de statuten van de UNHCR - zijn in de loop van de tijd geleidelijk aan maar onmiskenbaar veranderd. De wetten die hiervoor in de plaats zijn gekomen verloren daardoor de oorspronkelijke structuur en de consistentie. In het bijzonder is het niet langer een normatief continuüm, en als gevolg daarvan is de internationale bescherming niet meer gegarandeerd.
