Bulding contour line in the database of the real estate cadastre in Poland pursuant to applicable laws
The study analyzes the provisions of the Polish law concerning the principles of determining the digital description of building contour lines to be entered into the database of the real estate cadastre. The analyzed laws are contained in the Regulation on the register of land and buildings of 2001. The subsequent amendments to this Regulation regarding the contour of a building, made by the entry into force of the amending Regulations in 2013 and 2015, respectively, introduced significant changes. As a result of these changes in the definition of the contour of the building, some of the buildings, entered into the database of the real estate cadastre based on the previous wording of the provisions, became obsolete. The paper also analyzes the effects of the amendments to the Regulation on the register of land and buildings. Some of them should be considered positive, as the new provisions in the Regulation clarified to some extent the earlier wordings which were unclear and gave rise to ambiguous interpretation of the record data of buildings. However, some important record data of the buildings existing in the database of the real estate cadastre, such as the digital description of the contour lines and the resulting built-up area, became outdated as a result of another part of the amended provisions, although there were no changes in the structure of the buildings
Analiza zmian redakcji mapy zasadniczej w aspekcie nowelizacji przepisów prawa
Głównym tematem opracowania jest porównanie standardów
wykonywania mapy zasadniczej w aspekcie zmian przepisów
prawa, jakie dokonują się w Polsce na przestrzeni ostatnich
trzydziestu lat. Analizie został poddany zakres zmian, którym
podlegała redakcja kartograficznej treści mapy zasadniczej, ze
szczególnym uwzględnieniem treści i formy opisów prezentowanych
na mapie. Dokonano porównania standardów wykonywania
tego opracowania na podstawie Instrukcji Technicznej K-1
z 1998 roku [8] oraz zmieniającego ją rozporządzenia z dnia
12 lutego 2013 roku w sprawie bazy danych geodezyjnej ewidencji
sieci uzbrojenia terenu, bazy danych obiektów topograficznych oraz mapy zasadniczej (zwanego dalej: rozporządzenie
BDOT, 2013) [14], a także znowelizowanego rozporządzenia
z dnia 2 listopada 2015 roku w sprawie bazy danych obiektów topograficznych oraz mapy zasadniczej (zwanego dalej: rozporządzenie
BDOT, 2015) [15]. Te rozporządzenia, w połączeniu
z nowelizacją w 2014 roku ustawy Prawo geodezyjne i kartograficzne
[20] spowodowały przełomową zmianę w podejściu do mapy
zasadniczej, zmieniając znacząco formę jej prowadzenia, zakres
danych, jaki ma obejmować, oraz redakcję, czyli jej aspekt wizualny.
W obecnym założeniu mapa zasadnicza jest bowiem raportem
generowanym na podstawie danych z sześciu równolegle
prowadzonych i aktualizowanych baz [1, 6]. Porównanie objęło
opisy, redakcję mapy, a także jej płaszczyznę pojęciową.The main subject of the study is comparison to the standards
for the preparation of the base map in view of the amendments
to the legal provisions, which have been taking place in Poland
over the last thirty years. The scope of the changes to the editing
of the cartographic content of the base map was analyzed, with
particular emphasis on the form and content of the presented descriptions.
The map preparation standards were compared [8],
based on the Technical Guideline K-1 of 1998, and the amending
Regulation of 12 February 2013 on the database of the surveying
records of public utilities, the database of topographic objects
and the base map (hereinafter referred to as the BDOT Regulation,
2013) [14], as well as the amended Regulation of 2 November
2015 on the database of topographic objects and the base map
(hereinafter referred to as the BDOT Regulation, 2015) [15]. These
Regulations, in conjunction with the amendment to the Geodetic
and Cartographic Law of 2014 [20], have resulted in historic changes in the approach to the base map, significantly changing
the form of its records, the scope of the data to be covered, and
the editing, i.e. its visual aspect. The current assumption is that
the base map is in fact a report generated from six databases,
kept and updated simultaneously [1, 6, 11]. The aforementioned
comparison referred primarily to the descriptions, map editing,
as well as to the conceptual level
Characteristics of the selected functional features of electronic tacheometers
W artykule zawarto krótką charakterystykę wybranych rozwiązań konstrukcyjnych współczesnych tachimetrów elektronicznych. Instrumenty te są systematycznie unowocześniane dzięki postępowi nauki w dziedzinie elektroniki, optyki, informatyki i mechaniki precyzyjnej. W niniejszym opracowaniu omówiono szczegółowo zasadę działania systemu kompensacji wychylenia osi głównej obrotu instrumentu od pionu, systemu umożliwiającego automatyczne naprowadzanie lunety tachimetru na reflektor, jak również śledzenie przemieszczającego się pryzmatu oraz możliwość prowadzenia pomiarów odległości bez użycia reflektora. Tachimetry firmy Topcon, charakteryzujące się wybranymi z powyższych cech, zostały wykorzystane w pomiarach terenowych i laboratoryjnych. Laboratoryjne pomiary odległości zostały odniesione do wartości wzorcowych, uzyskanych na podstawie pomiarów interferometrem laserowym HP5529A. Przeprowadzone pomiary umożliwiły sformułowanie wniosków dotyczących możliwości i ograniczeń zastosowań tachimetrów w praktyce geodezyjnej, szczególnie w aspekcie pomiarów bezlustrowych.The paper includes a brief characteristics of the selected design solutions of modern electronic tacheometers. These instruments are systematically improved due to scientific progress in such fields like electronics, optics, information technology and precision mechanics. The subject of the detailed discussion in this paper was a principle of operation of the main axis vertical swing compensation system of the instrument, the system to enable automatic aiming of the tacheometer telescope at the reflector, and tracking of the moving prism and possibility to conduct distance measurements without using a reflector. Tacheometers made by Topcon, incorporating the above mentioned features, were used in field and laboratory surveys. Laboratory distance measurements were related to the reference values, obtained based on measurements taken by laser interferometer HP5529A. The performed measurements enabled to formulate the conclusions, regarding the application capabilities and limits of tacheometers in geodetic practice, particularly in the aspect of non-prism measurements
Analysis of the influence of amendments to the legal provisions relating to building structures on keeping the real estate cadastral database updated
W niniejszym opracowaniu zostaną poddane analizie zmiany w przepisach prawa dotyczących ujawniania budynków w katastrze nieruchomości, zawarte w rozporządzeniu w sprawie ewidencji gruntów i budynków, wprowadzane do niego podczas kolejnych nowelizacji, czyli w 2013 r. oraz w 2015 r., w odniesieniu do tekstu pierwotnego z 2001 r. Na tym tle zostanie przedstawiona problematyka częściowej utraty aktualności bazy danych dla budynków ujawnionych w niej na podstawie poprzedniego brzmienia zapisów rozporządzenia w sprawie EGiB, dokonująca się z dniem wejścia w życie kolejnej nowelizacji rozporządzenia. Analizie zostaną poddane skutki tych nowelizacji, z których część należy uznać za pozytywne, ponieważ nowe zapisy doprecyzowały wcześniejsze sformułowania, które pozostawały niejasne i dawały podstawę do niejednoznacznej interpretacji danych ewidencyjnych budynku. Jednak inna część znowelizowanych zapisów powoduje, że dla budynków ujawnionych w katastrze nieruchomości, pomimo braku dokonania w nich jakichkolwiek zmian konstrukcyjno-budowlanych, nieaktualne stają się ich istotne dane ewidencyjne, jak na przykład status budynku czy kontur budynku i wynikająca z niego powierzchnia zabudowy.This study will analyze the amendments to the legal provisions which refer to the entering of building structures into the real estate cadastre, contained in the Regulation on the register of land and buildings, introduced during the subsequent amendments, that is in 2013 and in 2015, with respect to the original text of 2001. This will form the background for the issue of a partial loss of the updated status of the database for the building records therein entered under the previous wording of the Regulation on the register of land and buildings, becoming effective as of the day the next amendment to the Regulation comes into force. The effects of these amendments will be analyzed, some of which should be considered positive, as the new provisions clarified the previous formulations, which remained unclear and gave rise to ambiguous interpretation of cadastral data of buildings. However, another part of the amended provisions makes the essential cadastral data of the buildings which are entered into the real estate cadastre outdated, despite no changes made in their construction. These essential data include, for example, status of the building or contour of the building, and the resulting built-up area
Analiza przepisów prawa i propozycje zmian w zakresie definicji konturu budynku w katastrze nieruchomości
W artykule została przeprowadzona analiza przepisów prawa związanych
z geodezją i kartografią w zakresie budynków ujawnianych w bazie danych
katastru nieruchomości. Szczególną uwagę poświęcono konturowi budynku
w bazie ewidencji gruntów i budynków oraz jednemu z atrybutów opisowych
budynku, jakim jest pole powierzchni zabudowy. W aktualnych przepisach
prawa pole powierzchni zabudowy wynika wprost z konturu budynku.
Tezą artykułu jest stwierdzenie, że aktualny sposób definiowania konturu budynku
oraz wynikającej z niego powierzchni zabudowy nie oddaje postaci, jaką budynek
faktycznie przyjmuje w terenie. W celu weryfikacji powyższej tezy przytoczono
przykłady różnorodnych budynków. Przykłady te uwidaczniają mankamenty
w definicjach, co z kolei powoduje niejednolitość danych ewidencyjnych w bazie
katastru nieruchomości w skali Polski. Skutkiem błędów w aktualnie obowiązujących
definicjach są również ograniczone możliwości wykorzystywania danych
katastru nieruchomości podczas zadań związanych zplanowaniem gospodarczym,
planowaniem przestrzennym oraz wymiarem podatków i świadczeń.
Na podstawie analizy aktualnych aktów prawnych oraz przykładów budynków
występujących w terenie w artykule sformułowano propozycje definicji
konturu budynku oraz powierzchni zabudowy budynku.This paper analyzes the legal regulations related to cartography and surveying
with regard to the building structures entered into the real estate cadastral database.
Particular attention has been paid to the contour of a building structure
in the register of land and buildings, and to one of the descriptive attributes
– the development area. Under the current laws, the development area results
directly from the contour of a building structure.
The thesis of this paper is that the current manner of defining the contour of
a building and the resulting development area do not reflect the factual status
of the building in the field. In order to verify the above thesis, examples of
various building structures have been provided that reveal flaws in the definitions.
The result is a lack of uniformity in the collected cadastral data in the
database of the real estate cadastre of Poland. The consequences of the definitions
that are currently binding also include limited possibilities when using
real estate cadastral data for economic and spatial planning as well as assessing
taxes and benefits.
Based on an analysis of the current legal acts and examples of the existing building
structures, the author formulated proposals for a definition of the contour
of a building structure and its development area
Integrated database as the basis for the modern real estate cadastre
A comprehensive IT system to run the National Cartographic Documentation Center database (PZGiK) is currently being implemented for the city of Krakow. Part of this implementation involves the conversion of the data contained in the previous system, a lossless migration of the data contained in the previously existing analog systems, as well as adjusting the data as required by the current legal provisions. The subject of this study is to analyze the progress of this implementation in terms of building an integrated relational database and the specificity of the objects it is composed of. The analysis gave grounds to present the problems of data harmonization, associated with frequent changes in the legislation in the field of geodesy and cartography. The paper demonstrates the problems which occur when implementing the new system combined with the conversion of the National Cartographic Documentation Center database, which require solutions in the form of strategic decision making, determining the system of work of the surveying administration in Krakow over the next years
Badanie odkształceń i przemieszczeń rurociągu pary świeżej kotła parowego
The present paper describes the process of determining deformation and displacement of fresh steam pipeline to a boiler. Subject of the measurements was the pipeline located on several stores. Therefore, particular attention was drawn to determining the location of the test points of the pipeline and difficulties involved proper selection of the reference system and height system.W artykule omówiono proces wyznaczania odkształceń i przemieszczeń rurociągu pary świeżej kotła parowego. Przedmiotem pomiaru był rurociąg zlokalizowany na kilku kondygnacjach. W związku z tym szczególną uwagę zwrócono na określenie położenia punktów kontrolnych oraz właściwy dobór układu odniesienia i osnowy geodezyjnej
Aktualizacja danych w aspekcie przepływu informacji pomiędzy systemami katastru nieruchomości oraz ksiąg wieczystych
This article presents the connections between the real estate cadastre (REC) and land and mortgage register (LMR) in terms of the time of passing geographic and legal information between these systems. The studies were carried out in the units responsible for the Inventory of Land and Buildings (ILB) and courts keeping the land and mortgage register in 2002 and in 2012.
The results of the studies on the information flow from LMR to REC in 2002 revealed significant inaccuracies. Many cases of outdated information were found in ILB. After introducing legal changes in LMR and sending the message about this fact to the register, the time of introducing the information into the system, in some cases, exceeded even 1200 days. Based on the same studies, it was also observed that some courts responsible for land and mortgage register did not update the content of the register, despite the fact that ILB informed them on the changes.
The studies carried out in 2012 were to define the present situation with the time of the exchange of object and subject data between the mentioned systems. A subsequent analysis of the time of updating information to verify to which extent legal as well as technological and informatics changes of the recent decade improved the co-operation between REC and LMR systems. Based on these studies one can also state that in the offices in Poland the information flow is still irregular. There are still problems with the updating the data revealed in the real estate cadastre and the land and mortgage register.
While the recent progress in technology and informatics facilitated the access to information both in the real estate cadastre and in the land and mortgage register, nowadays also in an electronic form, it did not provide automatic integration of data between the systems nor prevented the data redundancy. Only the creation of the Integrated Real Estate Information System (IREIS) would provide the on-line updating of the data change in both systems. The basic goal of IREIS would be providing the access to reliable and up-to-date information on the real estate, collected in public registers.W artykule zostaną przedstawione zależności między katastrem nieruchomości (KN) i księgami wieczystymi (KW) w zakresie czasu przepływu informacji przestrzennej i prawnej pomiędzy tymi systemami. Badania przeprowadzono w jednostkach prowadzących ewidencję gruntów i budynków (EGiB) oraz sądach prowadzących księgi wieczyste w latach 2002 oraz 2012.
Na podstawie wyników badań związanych z przepływem informacji z KW do KN w roku 2002 stwierdzono istotne nieprawidłowości. Odnotowano wówczas wiele przypadków przechowywania w EGiB informacji nieaktualnych. Po wprowadzeniu zmian prawnych w KW i przesłaniu zawiadomienia o tym fakcie do KN czas wprowadzenia informacji do systemu w pewnych przypadkach przekraczał nawet 1200 dni. Na podstawie tych samych badań zaobserwowano również, że niektóre sądy wieczystoksięgowe nie aktualizowały treści ksiąg wieczystych mimo wpływu dostarczanych przez EGiB zawiadomień o zmianach.
Badania przeprowadzone w roku 2012 miały na celu określenie aktualnego czasu wymiany danych przedmiotowych i podmiotowych między omawianymi systemami. Została dokonana kolejna analiza czasu aktualizacji informacji w celu weryfikacji, w jakim stopniu zmiany prawne i technologiczno-informatyczne w ostatnim dziesięcioleciu wpłynęły na poprawę współpracy pomiędzy systemami KN i KW. Na podstawie tych badań można także stwierdzić, że w Polsce przepływ informacji między KN oraz KW wciąż odbywa się w zróżnicowany sposób. Ich wyniki wskazują na istniejące nadal zakłócenia w aktualizacji danych ujawnianych w katastrze nieruchomości i księgach wieczystych.
Postęp technologiczno-informatyczny w ostatnim dziesięcioleciu ułatwił wprawdzie dostęp do informacji zarówno w katastrze nieruchomości, jak i w księgach wieczystych prowadzonych obecnie również w formie elektronicznej, ale nie zapewnił automatycznej integracji danych przepływających pomiędzy systemami oraz ich zbędnej redundancji. Tylko stworzenie zintegrowanego systemu informacji o nieruchomościach (ZSIN) spowoduje bieżącą aktualizację zmian danych w obu systemach. Podstawowym celem ZSIN jest bowiem zapewnienie dostępu do gromadzonych w rejestrach publicznych wiarygodnych i aktualnych informacji o nieruchomościach
Struktura użytkowania gruntów – analiza na przykładzie gmin wiejskich i miejskich w Polsce i na Ukrainie
W ostatnich latach w intensywny sposób prowadzone są na terenie Polski modernizacje
ewidencji gruntów i budynków. W trakcie procedury związanej
z modernizacją aktualizowane są między innymi dane o użytkach gruntowych.
Oczywiście taka aktualizacja prowadzona jest również na bieżąco podczas geodezyjnych
prac jednostkowych związanych z katastrem nieruchomości. W artykule
została przedstawiona analiza zmian użytkowania gruntów na przykładzie
gminy miejskiej oraz wiejskiej Polsce w latach 2002–2015 oraz sytuacja
w tym aspekcie na Ukrainie. W analizowanym przedziale czasowym zostały przeprowadzone na testowym
terenie dwie kompleksowe modernizacje katastru. Analiza dotyczyła dwóch
użytków gruntowych: gruntów rolnych zabudowanych (Br) oraz terenów
mieszkaniowych (B). Wybrane zostały te spośród wszystkich grup użytków,
ponieważ w odniesieniu do nich zmieniały się w Polsce w sposób szczególny
przepisy prawa regulujące zasady zaliczania użytku gruntowego do konkretnej
grupy spośród wymienionych. Jednocześnie dla tych użytków przewidziane
są skrajnie różne stawki podatku od nieruchomości. W opracowaniu została
również przeprowadzona analiza zmian dochodów gmin pochodzących
z opodatkowania właścicieli, spowodowana aktualizacją operatu katastralnego
w zakresie zmian użytkowania gruntów.Intensive modernization of the cadastre has been implemented in Poland in
recent years. During the modernization procedure, land use was updated as
well. Obviously, such an update is also carried out on a regular basis, during
individual surveying works associated with the real estate cadastre. The article
presents an analysis of land-use changes on examples of urban and rural communes
in Poland during the period of 2002–2015 (as well as the situation in this
aspect in Ukraine).
During the analyzed period in Poland, there were two comprehensive modernizations
of the cadastre carried out in the study area. The analysis covered
two types of usable land: developed agricultural land (Br) and residential areas
(B). These two particular types of land use were selected, as the applicable
legal provisions in Poland regulating the principles for assigning land use to
a specific group changed significantly. At the same time, radically different real
estate tax rates are planned for these types of land use. The study also analyzes
the changes in the communes’ receipts from the taxes that are imposed on the
owners of land due to the update of the cadastral survey related to the land-use
changes
