    Juror Typologies and DNA Comprehension:Who Benefits from Jury Trial Innovations?

    When DNA evidence is presented in the courtroom, it is typically accompanied by complex testimony conveying information such as the method of generating population frequencies, match criteria and probabilities, as well as laboratory errors and error rates. Although this evidence may have high probative value, the legal community has expressed growing concern regarding jurors’ ability to comprehend it. However, courts have implemented a variety of jury trial innovations to facilitate jurors’ ability to process complex information. Although these innovations may have a positive effect on comprehension of complex trial evidence, it is unclear whether some jurors are more likely to benefit from these aids than others, particularly in cases involving DNA evidence. The present research explores this issue using data originally by Dann, Hans, and Kaye (2003). Juror typologies are constructed to better understand how trial innovations contribute to juror comprehension and satisfaction in cases where DNA evidence is present

    Power of Perspective: The Effects of Public Perceptions of Police and Fear of Crime on Attitudes Towards Aerial Drone Use

    Historically, unmanned aerial systems (UAS; i.e., drones) have largely been used by the military and federal government. As UAS have become more affordable and easier to operate in recent years, state and local law enforcement agencies have become interested in adopting this technology to facilitate a wide range of police activities (e.g., search and rescue, surveillance, tactical operations, etc.). The Federal Aviation Administration (FAA) has begun to regulate the use of unmanned aerial systems, which will likely lead to the increased use of drone technology by law enforcement agencies across the country in upcoming years. However, previous research suggests that public perception of UAS use by the police is mixed, and in some cases there is considerable resistance to police departments adopting this technology. In the present research, we explore several personality factors related to public attitudes towards police UAS use. More specifically, we conducted a national survey examining the relationship between public perceptions of police legitimacy and effectiveness, as well as fear of crime and victimization, and police use of drone technology. The potential implications for public policy and law enforcement practices, particularly in terms of the introduction of UAS into local communities, are discussed

    Death and Politics: The Role of Demographic Characteristics and Testimony Type in Death Penalty Cases Involving Future Dangerousness Testimony

    Past research examining expert future dangerousness prediction testimony in death penalty cases and civil confinement hearings for sex offenders has found that jurors tend to be more persuaded by less scientific “clinical” testimony and less influenced by “actuarial” based testimony. Jurors demonstrate greater receptivity for clinical testimony despite the fact that actuarial testimony has been shown to be a better predictor of future dangerousness. Research in this area has focused on identifying cognitive factors that can potentially be manipulated during a trial to increase the effectiveness of actuarial testimony on jurors. A mock jury study was conducted to extend these findings and identify demographic characteristics that predict juror responsiveness to the more scientifically reliable actuarial testimony. The results indicate that political orientation may operate in a counterintuitive manner and should be carefully considered during voir dire in cases where future dangerousness testimony is presented

    Comparison of Patient and Surgeon Expectations of Total Hip Arthroplasty

    OBJECTIVES: Analysis of discrepancies between patient and surgeon expectations before total hip arthroplasty (THA) should enable a better understanding of motives of dissatisfaction about surgery, but this question has been seldom studied. Our objectives were to compare surgeons' and patients' expectations before THA, and to study factors which affected surgeon-patient agreement. METHODS: 132 adults (mean age 62.8+/-13.7 years, 52% men) on waiting list for THA in three tertiary care centres and their 16 surgeons were interviewed to assess their expectations using the Hospital for Special Surgery Total Hip Replacement Expectations Survey (range 0-100). Patients' and surgeons' answers were compared, for the total score and for the score of each item. Univariate analyses tested the effect of patients' characteristics on surgeons' and patients' expectations separately, and on surgeon-patient differences. RESULTS: Surgeon and patient expectations' mean scores were high (respectively 90.9+/-11.1 and 90.0+/-11.6 over 100). Surgeons' and patients' expectations showed no systematic difference, but there was little agreement on Bland and Altman graph and correlation coefficient was low. Patients had higher expectations than surgeons for sports. Patients rated their expectations according to trust in physician and mental quality of life, surgeons considered disability. More disabled patients and patients from a low-income professional category were often "more optimistic" than their surgeons. CONCLUSION: Surgeons and patients often do not agree on what to expect from THA. More disabled patients expect better outcomes than their surgeons

    Flow mediated dilation of the brachial artery: an investigation of methods requiring further standardization

    BACKGROUND: In order to establish a consistent method for brachial artery reactivity assessment, we analyzed commonly used approaches to the test and their effects on the magnitude and time-course of flow mediated dilation (FMD), and on test variability and repeatability. As a popular and noninvasive assessment of endothelial function, several different approaches have been employed to measure brachial artery reactivity with B-mode ultrasound. Despite some efforts, there remains a lack of defined normal values and large variability in measurement technique. METHODS: Twenty-six healthy volunteers underwent repeated brachial artery diameter measurements by B-mode ultrasound. Following baseline diameter recordings we assessed endothelium-dependent flow mediated dilation by inflating a blood pressure cuff either on the upper arm (proximal) or on the forearm (distal). RESULTS: Thirty-seven measures were performed using proximal occlusion and 25 with distal occlusion. Following proximal occlusion relative to distal occlusion, FMD was larger (16.2 ± 1.2% vs. 7.3 ± 0.9%, p < 0.0001) and elongated (107.2 s vs. 67.8 s, p = 0.0001). Measurement of the test repeatability showed that differences between the repeated measures were greater on average when the measurements were done using the proximal method as compared to the distal method (2.4%; 95% CI 0.5–4.3; p = 0.013). CONCLUSION: These findings suggest that forearm compression holds statistical advantages over upper arm compression. Added to documented physiological and practical reasons, we propose that future studies should use forearm compression in the assessment of endothelial function
