Vybrané aspekty přímých daní a jejich interpretace a aplikace v judikatuře

Monografie si klade vcelku ambiciózní cíl, tj. na vybraných aspektech přímých daní zhodnotit interpretaci a aplikaci daňověprávních norem. Autoři se rozhodli podrobit kritické analýze vybrané instituty z oblasti přímých daní sensu largo, které byly předmětem judikatury tuzemských soudů v posledních třech letech. S ohledem na množství takových rozhodnutí a možný rozsah publikace nebylo samozřejmě možné postihnout veškerou materii, proto byl výběr zúžen na ty oblasti, na které autoři v rámci svého vědeckého bádání zaměřují nejčastěji a nejpodrobněji svoji pozornost a které považují za zajímavé a poskytující podněty k diskuzi a polemice

Metoda a ekonomické limity regulace ve finančním právu

Hlavním cílem práce bylo identifikovat metodu regulace ve finančním právu a pojednat o jednotlivých oblastech finančního práva. Dalším cílem bylo vybrat základní ekonomické instituty, kterých stát užívá při plnění svých funkcí nebo které ovlivňují svojí regulací. Třetím cílem bylo určit sociologické metody, konkrétně metody kvantitativního a kvalitativního výzkumu, které lze využít při úvahách de lege ferenda. Publikace je výstupem dvouleté výzkumné činnosti v projektech specifického výzkumu Masarykovy univerzity Metoda a ekonomické limity regulace ve finančním právu (2012) a Metoda a ekonomické limity regulace ve finančním právu II (2013).The main goal of the work has been to identify the method of legal regulation in financial law relations and to discuss certain segments of financial law. The second goal has been to select the basic economic institutes used by the state for fulfilling its tasks or affected by the state through its regulation. The third goal has been to assess the sociological methods including the methods of the quantitative and qualitative research that may be used for de lege ferenda discussions. The publication is the output of the two-years research activities in the specific research projects Method and economic limits of regulation in financial law (2012) and Method and economic limits of regulation in financial law II (2013)

System of financial management and control

As a result of the mandatory implementation of European Union legislation into the Czech legal system is a significant change in the settings of the financial management and control in public administration. It is the acceptance of the principles of modern financial management and good governance. European Charter of Local Self-Government in the Czech Republic

The paper analyzes the application of the provisions of the European Charter of Local Self-Government in the Czech Republic. It focuses mainly on the scope of local government (Art. 4 of the Charter) and financial resources (Art. 9 of the Charter). The paper deals with the reservations which were done by Czech Republic to Art. 9 of the Charter. The aim of this paper is to bring readers selected specifics of local governments in the Czech Republic that in practice influence the fulfillment of Charter
