L'accès au droit : logiques de marché et enjeux sociaux

La stratégie développée par les professions juridiques pour contrôler le marché de la consultation juridique révèle que l'accès au droit ne représente pas seulement un enjeu démocratique mais également financier. La loi française du 10 juillet 1991 relative à l'aide juridique l'indique clairement. L'ineffectivité structurelle dont elle pâtit montre qu'une démarche étroitement corporatiste et juridique est irréaliste et inadaptée dans un contexte de crise des modes traditionnels de régulation sociale. Seule la coopération horizontale et non hiérarchique entre professions juridiques et acteurs sociaux spécialisés permettra de faire face efficacement à l'intensification de la demande sociale de droit.The strategy developed by the legal professions in order to control the market of juridical consultation reveals that access to law represents not only a democratic but also a financial stake. The French Law relating to legal aid of July 10, 1991, clearly shows this. The structural ineffectiveness from which it suffers indicates that a narrow legal and corporatist approach is unrealistic and unsuitable within the context of the crisis of traditional modes of social regulation. The increasing social demand for the law may only be met efficiently by lateral as opposed to hierarchical cooperation between the legal professions and the specialized social players
