    To understand the transaction between the environment and students, this study examines a Latin* cultural center in facilitating community and sense of belonging for Latino men at a predominantly White institution (PWI). This study used critical race theory, specifically LatCrit to interrogate Strange and Banning’s (2015) hierarchy of environmental design. Findings nuanced the understanding and experience of community, engagement and safety of Latino men within a racialized space at a PWI. Implications for practice are discussed to better understand how Latin* cultural center environments contribute to the behavior and experience of Latino men

    Sense of place: Latinx/o men's sense of belonging in a Latinx cultural center at a predominantly White institution

    2019 Summer.Includes bibliographical references.The purpose of this study is to examine the role of a Latinx cultural center in facilitating the sense of belonging of Latinx/o men at a predominantly White institution. This study examines how Latinx/o men perceive, experience, and participate in cultural centers, specifically from an ecological viewpoint. This research examines the Latinx cultural center through a critical cultural ethnography. Using critical race theory and Latino critical theory (LatCrit) this study interrogates the hierarchy of learning environment purposes to understand the factors associated with sense of belonging for Latinx/o men at a predominantly White institution. Participant photo elicitation interviewing is employed to produce visual elements and in-depth participant interviews. Four themes emerged from this study: (a) political safety during the bad hombre era; (b) shedding machismo: emotional vulnerability; (c) person-environment congruence; and (d) Latinx cultural center as a counter narrative. Recommendations for Latinx cultural centers and institutions of higher education are discussed as well as recommendations for future study

    On Jhering's passive Wirkungen and the proprietary effect of the fulfilment of the condition in case of a transfer subject to a suspensive condition

    The proprietary effect of the fulfilment of the suspensive condition in a conditional transfer is traditionallyexplained by the retroactive effect of the fulfilment of the condition. In the nineteenth century, variouswriters wondered whether this explanation was satisfactory. Jhering proposes a different theory for theexplanation of the proprietary effect of the fulfilment of the condition. In his article ‘Passive Wirkungender Rechte’, he creates a theory based on Roman law in which the proprietary effect is explained by thepassive Wirkungen of the ‘legal bond’ of the asset. In his theory, the fulfilment of the suspensive conditionhas a proprietary effect without using retroactive effect of the fulfilment of the condition. Despite the factthat the transfer of rights is postponed until the condition is realised, the asset is already ‘legally bound’because of the conditional transfer. This ensures that the ownership is transferred if the suspensivecondition is fulfilled.Jhering’s theory is insightful for Dutch law because the Dutch Civil Code excludes retroactiveeffect of the fulfilment of the condition. The doctrine of the ‘legal bond’ of the asset also correspondswith the intention of the transfer in the case of a suspensive condition. It fits within the Dutch system ofproperty law and explains in a simple manner the proprietary effect of the fulfilment of the condition
