The paper argues for the need to develop forensic analysis of wild flora and fauna as an separate branch of forensic science. It offers a classification of various types of examinations that can be distinguished within this field of forensic practice, and specifies their respective subjects, objects and objectives. В статье обоснованы необходимость формирования судебной экспертизы дикой флоры и фауны в качестве самостоятельного рода судебных экспертиз, представлена классификация, предмет, объекты и задачи видов, которые можно выделить в рамках данного направления судебно-экспертной деятельности.

The paper examines key trends in providing forensic support for investigation of crimes against wild plants and animals, and argues for the need to develop wildlife forensics as an independent branch of inquiry pursued by forensic science organizations of the Russian Ministry of Justice. В статье освещаются основные тенденции развития судебно-экспертного обеспечения расследования преступлений против дикой флоры и фауны, обосновывается необходимость формирования судебной экспертизы дикой флоры и фауны в судебно- экспертных учреждениях Минюста России в качестве самостоятельного направления экспертных исследований.

Классификация объектов интеллектуальной собственности для целей судебной экспертизы

Correlation of the concepts of the object of forensic intellectual property investigation and the object of intellectual property is contemplated. The attributes of these objects are analyzed, in particular the intangible nature of intellectual property objects and the tangible character of the objects of forensic intellectual property investigation. A distinction is made between the concepts of ‘intellectual property’, ‘industrial property’ and ‘intangible assets’. The proposed systematization of intellectual property objects for forensic purposes is based on current practices in court ordered forensic intellectual property investigations. The case is made for setting up a new species of forensic investigation in the system of the Russian Ministry of Justice, as well as four new forensic science specialties: (1) investigation of items covered by copyright and related rights, (2) investigation of objects of patent rights and unconventional objects, (3) investigation of brand identities, (4) valuation of intellectual property objects.Pассмотрено соотношение понятий объекта судебной экспертизы интеллектуальной собственности и объекта интеллектуальной собственности. Проанализированы характеристики этих объектов, в частности нематериальная природа объектов интеллектуальной собственности и материальный характер объектов судебной экспертизы интеллектуальной собственности. Проведено разграничение понятий «интеллектуальная собственность», «промышленная собственность» и «нематериальные активы». Предложена классификация объектов интеллектуальной собственности для целей судебной экспертизы на основе практики назначения судами экспертиз объектов интеллектуальной собственности. Обосновано выделение в системе Минюста России нового рода судебной экспертизы, а также четырех новых экспертных специальностей: (1) исследование объектов авторского права и объектов смежных прав, (2) исследование объектов патентного права и нетрадиционных объектов, (3) исследование средств индивидуализации, (4) определение стоимости объектов интеллектуальной собственности

The article deals with the problem of providing forensic assistance in the investigation of crimes against tigers, and the work of international organizations and foreign forensic science institutions involved in tiger conservation. It provides information about the key features of tiger anatomy and the formation of tiger tracks and signs in natural habitats, as well as traces left in the event of criminal attacks on animals. Also presented is an overview of forensic trace evidence analysis, as well as forensic ballistics, zoology, veterinary, molecular genetics, and toxicology examinations conducted in order to establish circumstances relevant to the detection, investigation and prosecution of tiger poaching incidents.Рассмотрены проблемы криминалистического обеспечения расследования преступлений в отношении тигров, деятельность международных организаций и зарубежных судебно-экспертных учреждений, связанная с охраной этих животных. Приведены сведения об особенностях анатомии и следов тигров в среде их обитания.
