Access to justice review
Access to justice is fundamental to ensuring that core values of our community are translated into practice. Those values include the rule of law, fairness, and equity. Access to justice works to ensure that citizens are treated fairly by government; it supports social cohesion and a common commitment to the life and institutions of the community; and it encourages economic prosperity by providing a reliable mechanism through which citizens can resolve their disputes.
Yet the practical capacity of many citizens to gain access to justice is diminishing, and the gap between the Victorian community’s needs, and the justice system’s ability to meet those needs, is growing.
The Review found a great deal of goodwill and dedication among institutions and service providers – people committed to doing their best to serve the growing needs and expectations of the Victorian community – despite the significant challenges in the justice system, including the legal assistance sector. Unfortunately, some important enablers of the system are weak: there is a lack of data, poor technology in many parts of the system, under-resourcing of legal assistance and related services, and services that are not sufficiently integrated.
The justice system is comprised of inter-connected components – users, the courts and tribunals, dispute resolution and complaints bodies, publicly-funded legal assistance providers, private practitioners, and administrators. This system is under stress. Stress in one part of the system has an influence on others.
It is with a keen sense of gratitude to the workers and volunteers who keep the system going, and an understanding of the seriousness of the needs of vulnerable and disadvantaged Victorians, that the Review makes recommendations to improve the services provided to meet Victorians’ legal needs, and maximise the efficiency with which public resources are used. 
The Conservation Of Arboreal Marsupials In The Montane Ash Forests Of The Central Highlands Of Victoria, South-Eastern Australia - VII. Modelling The Persistence Of Leadbeater's Possum In Response To Modified Timber Harvesting Practices
A computer model for Population Viability Analysis (PVA) was used to simulate the relationship between the persistence of populations of the endangered species, Leadbeater's possum, Gymnobelideus leadbeateri and the implementation of a range of possible modified timber harvesting practices in two wood production blocks within the montane ash forests of the central highlands of Victoria, south-eastern Australia. The results of our analyses revealed that under the existing conservation strategies there was a high probability of extinction over the next 150 years in both blocks. Given that timber production areas comprise more than 75% of the distribution of G. leadbeateri, our findings highlight a need for additional conservation measures to enhance the survival prospects of the species. The range of upgraded conservation strategies that were examined included (1) extending the rotation time between logging operations; (2) modifying silvicultural practices to increase the amount of forest retained within each harvested coupe; and (3) permanently withdrawing areas from wood production. All of each of these approaches were found significantly to reduce the probability of extinction of populations of G. leadbeateri. However, when the relative merits of the various strategies were compared, the permanent withdrawal of potential logging coupes from timber harvesting was predicted to be the most efficient approach. Importantly, this strategy would have a number of practical advantages including that it overcomes both (1) the logistic difficulties of ensuring the long-term survival of retained trees within logged areas; and (2) human safety issues arising from implementing modified silvicultural practices. This practical application of PVA to compare the merits of different potential management options has provided new information that will enhance present efforts to conserve G. leadbeateri in wood production areas
Food consumption habits in two states of Australia, as measured by a Food Frequency Questionnaire
BACKGROUND: Obesity is an important public health problem in Australia, and monitoring the nutritional intake of the population is an important endeavour. One way to assess food habits is via Food Frequency Questionnaires (FFQ). This pilot study used a routine telephone risk factor surveillance survey to recruit participants in South Australia (SA) and Western Australia (WA) to a postal survey investigating food consumption habits, using a FFQ. Respondents were also asked specific additional questions about their fruit and vegetable consumption and also about their height and weight so that comparisons could be made between the data collected in the risk factor surveillance system and the postal survey. FINDINGS: In total, 1275 respondents (65% of eligible telephone respondents) completed the postal survey. The results of the FFQ were very similar for WA and SA. Western Australians consumed statistically significantly more serves of vegetables than South Australians (t = 2.69 df = 1245 p <= 0.01), and females consumed statistically significantly more serves of both fruit and vegetables than males (t = 4.51 df = 1249 p <= 0.01 and t = 4.83 df = 1249 p <= 0.01 respectively). Less than 10% of respondents met the daily guidelines for vegetable consumption. Over half of respondents were overweight or obese. CONCLUSIONS: Although a wide variety of foods were consumed, guidelines for fruit and vegetable consumption were not being met and overweight and obesity continue to be issues in this population.Alison M. In what ways does the mandatory nature of Victoria's municipal public health planning framework impact on the planning process and outcomes?
BACKGROUND: Systems for planning are a critical component of the infrastructure for public health. Both in Australia and internationally there is growing interest in how planning processes might best be strengthened to improve health outcomes for communities. In Australia the delivery of public health varies across states, and mandated municipal public health planning is being introduced or considered in a number of jurisdictions. In 1988 the Victorian State government enacted legislation that made it mandatory for each local government to produce a Municipal Public Health Plan, offering us a 20-year experience to consider. RESULTS: In-depth interviews were undertaken with those involved in public health planning at the local government level, as part of a larger study on local public health infrastructure and capacity. From these interviews four significant themes emerge. Firstly, there is general agreement that the Victorian framework of mandatory public health planning has led to improvements in systems for planning. However, there is some debate about the degree of that improvement. Secondly, there is considerable variation in the way in which councils approach planning and the priority they attach to the process. Thirdly, there is concern that the focus is on producing a plan rather than on implementing the plan. Finally, some tension over priorities is evident. Those responsible for developing Municipal Public Health Plans express frustration over the difficulty of having issues they believe are important addressed through the MPHP process. CONCLUSION: There are criticisms of Victoria's system for public health planning at the local government level. Some of these issues may be specific to the arrangement in Victoria, others are problems encountered in public health planning generally. In Victoria where the delivery structure for public health is diverse, a system of mandatory planning has created a minimum standard. The implementation of the framework was slow and factors in the broader political environment had a significant impact. Work done in recent years to support the process appears to have led to improvements. There are lessons for other states as they embark upon mandated public health plans
Evolving Discourses on Water Resource Management and Climate Change in the Equatorial Nile Basin
Transboundary water resources management in the Equatorial Nile Basin (EQNB) is a politically contested issue. There is a growing body of literature examining water-related discourses which identifies the ability of powerful actors and institutions to influence policy. Concern about the effects of future climate change has featured strongly in research on the Nile River for several decades. It is therefore timely to consider whether and how these concerns are reflected in regional policy documents and policy discourse. This study analyzes discourse framings of water resources management and climate change in policy documents (27, published between 2001 and 2013) and as elicited in interviews (38) with water managers in the EQNB. Three main discursive framings are identified which are present in the discourses on both subjects: a problem-oriented environmental risk frame and two solution-oriented frames, on governance and infrastructure development. Climate change discourse only emerges as a common topic around 2007. The framings found in the water resources management discourse and the climate change discourse are almost identical, suggesting that discursive framings were adopted from the former for use in the latter. We infer that the climate change discourse may have offered a less politically sensitive route to circumvent political sensitivities around water allocation and distribution between riparian countries in the EQNB. However, the climate change discourse does not offer a lasting solution to the more fundamental political dispute over water allocation. Moreover, in cases where the climate change discourse is subsumed within a water resources management discourse, there are dangers that it will not fully address the needs of effective adaptation
How to select a chiropractor for the management of athletic conditions
<p>Abstract</p> <p>Background</p> <p>Chiropractors are an integral part of the management of musculoskeletal injuries. A considerable communication gap between the chiropractic and medical professions exists. Subsequently referring allopathic practitioners lack confidence in picking a chiropractic practitioner with appropriate management strategies to adequately resolve sporting injuries. Subsequently, the question is often raised: "how do you find a good chiropractor?".</p> <p>Discussion</p> <p>Best practice guidelines are increasingly suggesting that musculoskeletal injuries should be managed with multimodal active and passive care strategies. Broadly speaking chiropractors may be subdivided into "modern multimodal" or "classical" (unimodal) in nature. The modern multimodal practitioner is better suited to managing sporting injuries by incorporating passive and active care management strategies to address three important phases of care in the continuum of injury from the acute inflammation/pain phase to the chronic/rehabilitation phase to the injury prevention phase. In contrast, the unimodal, manipulation only and typically spine only approach of the classical practitioner seems less suited to the challenges of the injured athlete. Identifying what part of the philosophical management spectrum a chiropractor falls is important as it is clearly not easily evident in most published material such as Yellow Pages advertisements.</p> <p>Summary</p> <p>Identifying a chiropractic practitioner who uses multimodal treatment of adequate duration, who incorporates active and passive components of therapy including exercise prescription whilst using medical terminology and diagnosis without mandatory x-rays or predetermined treatment schedules or prepaid contracts of care will likely result in selection of a chiropractor with the approach and philosophy suited to appropriately managing athletic conditions. Sporting organizations and associations should consider using similar criteria as a minimum standard to allow participation in health care team selections.</p
Women, resettlement and desistance
With the numbers of women imprisoned increasing across Western jurisdictions over the last 15 or so years, so too have the numbers of women returning to the community following a period in custody. Despite increasing policy attention in the UK and elsewhere to prisoner resettlement, women’s experiences on release from prison have received limited empirical and policy attention. Drawing upon interviews with women leaving prison in Victoria, Australia, this article discusses the resettlement challenges faced by the women and highlights their similarity to the experiences of women leaving prison in other jurisdictions. Women had mixed (and predominantly negative) experiences and views of accessing services and supports following release, though experiences of parole supervision by community corrections officers were often positive, especially if women felt valued and supported by workers who demonstrated genuine concern. Analysis of factors associated with further offending and with desistance, points to the critical role of flexible, tailored and women-centred post-release support building, and, where possible, upon relationships established with women while they are still in prison
“Is it me or should my friends take the credit?” The role of social networks and social identity in recovery from addiction
This study explored the role of social network and social identity factors in recovery from addiction. The sample consisted of 537 individuals who completed a survey about their experiences of recovery. Results indicated that the transition from addiction to recovery was characterized by an increase in social connectedness and changes in social network composition coupled with the emergence of a “recovery” identity. These factors accounted for 14% of the variance in quality of life when controlling for known predictors, accounting for a greater proportion of variance than substance use variables. Results suggest that recovery from addiction can be understood as a socially mediated transition characterized by social network and social identity change, which drive broader improvements in quality of lif

Food Policy Development in the Australian State of Victoria: A Case Study of the Food Alliance
This article explores the development of a food policy body called the Food Alliance and the role of the organization in encouraging the development of food policy that integrates health and ecological issues. The Food Alliance is located within the Australian state of Victoria. A policy triangle is used as a framework to describe and analyse the work of the Food Alliance. Lessons are drawn about effective strategies for influencing integrated food policy. This occurs in a context where food policy typically favours powerful industry and agricultural interests and where relationships between the health and environmental sectors are in their infancy. The implications for planning and organizing a state-wide food policy are explored from the perspective of policy and the ways in which this can be influenced through working with key stakeholders
