세계화와 21세기를 위한 법 : 제3주제 발표논문 ; 유럽법의 일반원칙으로서 비례원칙과 신뢰보호원칙

지금까지 유럽통합과정에서 생긴 국가동맹들은 세계보편적으로 적용될 수 있는 공법적 원칙들을 개발하는 데에 매우 적합한 실험영역이라고 할 수 있다. 왜냐하면 이들 국가동맹과정에서 경제, 환경 및 기타 여러 문제들에 대하여 수반은 법규들이 제정되었을 뿐만 아니라, 몇몇개의 일반적 법원칙들이 개발되고 승인되었기 때문이다. 이러한 법원칙들이 효력을 갖고 적용됨으로써 다수 국가들의 법질서가 결합되고 있다. 유럽연합(Europaische Union)은 주지하는 바와 같이 시민과 기업자에 대하여 직접 효력을 갖는 -한 국가의 법질서와 유사한- 고유한 법질서를 갖고 있다. 유럽연합은 현재 15개 국가로 구성되어 있고 장차 더 가입국이 확대돨 전망이다. 유럽연합을 이루는 최초의 그리고 가장 오래된 지주는 유럽공동체(Europaische Gemeinschaft)인데, 우리는 그 법질서를 유럽공동체법(europaisches Gemeinschaftsrecht)이라고 부르고 있다. 오늘 발표에서 주로 이 유럽공동체법을 다루겠으나, 유럽국가들로 이루어진 보다 큰 규모의 또 다른 동맹, 즉 현재 40개 국가가 가입된 유럽평의회(Europarat)에 대해서도 언급하고자 한다. 유럽평의회는 유럽통합에 있어 가장 오래된 조직체이다. 1950년 이 유럽평의회에서 유럽인권협약(Eurpaiache Menschenrechte-Konvention)이 다자국제계약으로서 체결되었다. 유럽인권협약은 일정한 기본권들의 효력을 규정하고 있을 뿐만 아니라 기본권보호를 위한 자체 기관, 즉 인권보호를 위한 위원회와 법원을 설치하고 있다. 이 법원의 판례는 오늘 발표에서 상세히 다루게 될 비례원칙의 매우 풍부한 근원을 이룬다

FIDIC - A Guide for Practitioners

In 1999, a suite of three new conditions of contract was published by FIDIC, following the basic structure and wording harmonised and updated around the previous FIDIC Design Build and Turnkey Contract (the 1992 range Book). These conditions, known as the FIDIC rainbow, were the Conditions of C- tract for: l Construction, the so called Red Book, for works designed by the Employer l Plant and Design Build, the so called Yellow Book, for works designed by the Contractor l EPC/Turnkey Projects, the so called Silver Book, for works designed by the Contractor The first is intended for construction works where the Employer is responsible for the design, as for per the previous so called Red Book 4th Edition (1987), with an important role for the Engineer. The other two conditions of contract are intended for situations when the Contractor is responsible for the design.
