Procedure of Repair integral for victims of domestic violence in the divorce process in Colombia
La violencia intrafamiliar es un tema de profunda preocupaci贸n en Colombia, dado que por muchos
a帽os ha afectado a muchas familias colombianas, impactando de manera significativa en la vida de
numerosas personas y en la estructura misma de la sociedad, pues implica actos de agresi贸n, abuso
f铆sico, psicol贸gico o emocional, as铆 como el control coercitivo ejercido por un miembro de la
familia sobre otro, generando un entorno de miedo y desprotecci贸n en el hogar. El Estado
Colombiano ha luchado por abordar este problema con pol铆ticas, programas y marcos legales
destinados a prevenir, sancionar y erradicar la violencia intrafamiliar. Es por lo anterior que, el
presente art铆culo de investigaci贸n tiene como prop贸sito analizar e identificar, en las 煤ltimas
decisiones proferidas por la Corte Constitucional, el tr谩mite establecido para la reparaci贸n integral
de las victimas de violencias intrafamiliar cuando se recurre al numeral tercero del art铆culo 145 del
C贸digo Civil, debido a que antes se requer铆a de dos procesos diferentes para poder acudir a esta
reparaci贸n, porque el Congreso de la Rep煤blica no ha legislado respecto de un mecanismo expedito
que evite la revictimizaci贸n y garantice la celeridad de quien acude a la jurisdicci贸n buscando

it has affected many Colombian families, impacting significantly on the lives of many people and
on the very structure of society, as it involves acts of aggression, physical, psychological or
emotional abuse, as well as coercive control exercised by one family member over another,
generating an environment of fear and vulnerability in the home. The Colombian State has fought
to address this problem through policies, programmes and legal frameworks aimed at preventing,
punishing and eradicating domestic violence. For this reason, the purpose of this article of
investigation is to analyze and identify, in the latest decisions issued by the Constitutional Court,
the procedure established for the full reparation of victims of domestic violence when recourse is
made to the third paragraph of article 145 of the Civil Code, because before two different processes
were required to be able to seek such reparation, because the Congress of the Republic has not
legislated for an expeditious mechanism that avoids re-victimization and guarantees the speed of
those who come to the jurisdiction seeking to safeguard its integrity
