Concursal law evolvement in Colombia and transitory expedition in 2020 of 560 and 772 decretes during the emergency of Covid-19

En este artículo se abordará el tema del derecho concursal desde una perspectiva jurídica, partiendo de su evolución dentro del ordenamiento jurídico interno, a partir de dos momentos: 1) referente a la etapa previa al estado de emergencia económica, social y ecológica decretado por el Gobierno nacional en el año 2020, producto del Covid-19, y 2) el periodo posterior a la pandemia, puntualizando para tal fin en los Decretos Ley 560 y 772 de 2020, que con ocasión de la emergencia económica fueron expedidos por el Gobierno, con orientación a la determinación de que los mismos dada la practicidad y evolución significativa al respecto requieren de una adopción permanente y no transitoria.Universidad Libre-Facultad de Derecho-especialización Derecho comercialThis research addresses the issue of bankruptcy law from an economic perspective, based on its evolution within the internal legal system, from two moments; the first of these refers to the stage prior to the state of economic, social and ecological emergency decreed by the national government in 2020 as a result of Covid-19, and secondly, the period after the pandemic, specifying for this purpose in the Decrees that were issued on the matter and due to said calamity, with orientation to the determination that the same, given the practicality and significant evolution in this regard, require a permanent and not transitory adoption
