Sistema inquisitivo del derecho administrativo sancionatorio y debido proceso en Colombia
El derecho administrativo sancionador se remonta a épocas del colonialismo
en Colombia, siendo un proceso que ha ido mutando y adaptándose a cada
uno de los momentos políticos que se han suscitado en el territorio nacional,
pero siempre enmarcado bajo ese poder policivo del ejecutivo, poder que
actualmente encuentra sus limitaciones en la Constitución de 1991,
concretamente en el respeto a los derechos fundamentales de los
investigados, como es al debido proceso.
Sin embargo, en esta investigación se pretende denotar el tipo de sistema al
que están supeditados los procesos administrativos sancionatorios de índole
disciplinaria, ambiental y sanitaria, pues, contrario a lo que sucede en el
derecho penal, a los sancionados por la rama ejecutiva se les investiga y
sanciona a través de un sistema acusatorio, es decir, un área determinada y
definida de una entidad estatal es la encargada de investigar, y a su vez es la
que impone las sanciones; sobre este aspecto es que versa nuestra
investigación, ya que a través del análisis jurisprudencial, es que se revisará
la protección de los derechos fundamentales de los investigados en un

and sanitary nature are subject, because contrary to what happens in criminal
law, those sanctioned by the executive branch are investigated. and
sanctions through an accusatory system, that is, a determined and defined
area of a state entity is in charge of investigating and, in turn, is the one that
imposes the sanctions; It is on this aspect that our research deals, since
through the jurisprudential analysis, the protection of the fundamental rights
of those investigated in an administrative sanctioning process will be
reviewed
