    Is Money No Object: Can the Government Rely on Financial Considerations Under Charter Section 1

    Government programs have increasingly been challenged under the Charter on the grounds that they are provided inappropriately to a limited number of beneficiaries and that the benefits provided are set at insufficient levels. Courts have thus been asked to determine how governments should allocate finite resources in a world of infinite need. In this paper, the authors explore the question of the place of financial considerations for the purposes of section 1 of the Charter. In Martin (2003), the government of Nova Scotia attempted to rely on financial considerations in order to justify the exclusion of chronic pain sufferers from the regular compensation scheme provided by the Workers’ Compensation Act. Relying on dicta from the Schachter (1992) and Judges’ Reference (1997) decisions, the Supreme Court dismissed this argument and held that budgetary considerations could not be put forward by governments as a free-standing pressing and substantial objective for the purposes of section 1 of the Charter. However, the Court also acknowledged that “in certain circumstances”, financial considerations may constitute a pressing and substantial objective. The Court found it unnecessary to decide this point in Martin, and the question remains unanswered. Using examples from tort and administrative law, as well as lower court Charter decisions, the authors argue that courts cannot ignore the realities imposed on governments by fiscal limitations. If courts take on a greater role in policy-making, they must give serious consideration not only to arguments based on financial considerations, but also to the financial implications of their decisions

    Generic Subsequence Matching Framework: Modularity, Flexibility, Efficiency

    Subsequence matching has appeared to be an ideal approach for solving many problems related to the fields of data mining and similarity retrieval. It has been shown that almost any data class (audio, image, biometrics, signals) is or can be represented by some kind of time series or string of symbols, which can be seen as an input for various subsequence matching approaches. The variety of data types, specific tasks and their partial or full solutions is so wide that the choice, implementation and parametrization of a suitable solution for a given task might be complicated and time-consuming; a possibly fruitful combination of fragments from different research areas may not be obvious nor easy to realize. The leading authors of this field also mention the implementation bias that makes difficult a proper comparison of competing approaches. Therefore we present a new generic Subsequence Matching Framework (SMF) that tries to overcome the aforementioned problems by a uniform frame that simplifies and speeds up the design, development and evaluation of subsequence matching related systems. We identify several relatively separate subtasks solved differently over the literature and SMF enables to combine them in straightforward manner achieving new quality and efficiency. This framework can be used in many application domains and its components can be reused effectively. Its strictly modular architecture and openness enables also involvement of efficient solutions from different fields, for instance efficient metric-based indexes.     Mixed messengers, unified message: spatial grouping from temporal structure

    AbstractIn dynamic visual environments, objects can differ from their backgrounds in terms of their associated temporal structure—the time course of changes in some stimulus property defining object and background. In a series of experiments, we investigated whether different “messengers” of temporal structure group into coherent spatial forms. Observers viewed arrays of Gabor patches in which different temporal structures designated figure and ground regions; extracting the figure required grouping across synchronized orientation, spatial frequency, phase, and/or contrast changes. Observers were able to extract spatial form from temporal structure even when information had to be combined across different messengers. Further, mixing messengers of temporal structure proved cost-free: task performance when grouping across messengers approximated performance when all information resided within a single messenger. Thus, the visual system can abstract temporal structure regardless of the messenger of the dynamic event; a coherent spatial structure emerges from this abstracted temporal structure

    Shigella flexneri utilize the spectrin cytoskeleton during invasion and comet tail generation

    <p>Abstract</p> <p>Background</p> <p>The spectrin cytoskeleton is emerging as an important host cell target of enteric bacterial pathogens. Recent studies have identified a crucial role for spectrin and its associated proteins during key pathogenic processes of <it>Listeria monocytogenes </it>and <it>Salmonella </it>Typhimurium infections. Here we investigate the involvement of spectrin cytoskeletal components during the pathogenesis of the invasive pathogen <it>Shigella flexneri.</it></p> <p>Results</p> <p>Immunofluorescent microscopy reveals that protein 4.1 (p4.1), but not adducin or spectrin, is robustly recruited to sites of <it>S. flexneri </it>membrane ruffling during epithelial cell invasion. Through siRNA-mediated knockdowns, we identify an important role for spectrin and the associated proteins adducin and p4.1 during <it>S. flexneri </it>invasion. Following internalization, all three proteins are recruited to the internalized bacteria, however upon generation of actin-rich comet tails, we observed spectrin recruitment to those structures in the absence of adducin or p4.1.</p> <p>Conclusion</p> <p>These findings highlight the importance of the spectrin cytoskeletal network during <it>S. flexneri </it>pathogenesis and further demonstrate that pathogenic events that were once thought to exclusively recruit the actin cytoskeletal system require additional cytoskeletal networks.</p

    A comparative study for the pair-creation contact process using series expansions

    A comparative study between two distinct perturbative series expansions for the pair-creation contact process is presented. In contrast to the ordinary contact process, whose supercritical series expansions provide accurate estimates for its critical behavior, the supercritical approach does not work properly when applied to the pair-creation process. To circumvent this problem a procedure is introduced in which one-site creation is added to the pair-creation. An alternative method is the generation of subcritical series expansions which works even for the case of the pure pair-creation process. Differently from the supercritical case, the subcritical series yields estimates that are compatible with numerical simulations

    The Josephson heat interferometer

    The Josephson effect represents perhaps the prototype of macroscopic phase coherence and is at the basis of the most widespread interferometer, i.e., the superconducting quantum interference device (SQUID). Yet, in analogy to electric interference, Maki and Griffin predicted in 1965 that thermal current flowing through a temperature-biased Josephson tunnel junction is a stationary periodic function of the quantum phase difference between the superconductors. The interplay between quasiparticles and Cooper pairs condensate is at the origin of such phase-dependent heat current, and is unique to Josephson junctions. In this scenario, a temperature-biased SQUID would allow heat currents to interfere thus implementing the thermal version of the electric Josephson interferometer. The dissipative character of heat flux makes this coherent phenomenon not less extraordinary than its electric (non-dissipative) counterpart. Albeit weird, this striking effect has never been demonstrated so far. Here we report the first experimental realization of a heat interferometer. We investigate heat exchange between two normal metal electrodes kept at different temperatures and tunnel-coupled to each other through a thermal `modulator' in the form of a DC-SQUID. Heat transport in the system is found to be phase dependent, in agreement with the original prediction. With our design the Josephson heat interferometer yields magnetic-flux-dependent temperature oscillations of amplitude up to ~21 mK, and provides a flux-to-temperature transfer coefficient exceeding ~ 60mK/Phi_0 at 235 mK [Phi_0 2* 10^(-15) Wb is the flux quantum]. Besides offering remarkable insight into thermal transport in Josephson junctions, our results represent a significant step toward phase-coherent mastering of heat in solid-state nanocircuits, and pave the way to the design of novel-concept coherent caloritronic devices.Comment: 4+ pages, 3 color figure

    The polymorphic nature of the human dopamine D4 receptor gene: A comparative analysis of known variants and a novel 27 bp deletion in the promoter region

    BACKGROUND: The human dopamine D4 receptor (DRD4) is a candidate gene of great interest in molecular studies of human personality and psychiatric disorders. This gene is unique in having an exceptionally high amount of polymorphic sites both in the coding and in the promoter region. RESULTS: We report the identification of a new 27 bp deletion starting 524 bp upstream of the initiation codon (27 bp del) of the dopamine D4 receptor (DRD4) gene, in the close vicinity of the -521C>T SNP. The presence of the 27 bp deletion leads to the misgenotyping of the -616C>G SNP by the Sau96 I RFLP method, thus the genotype determination of the mutation is of additional importance. The frequency of this novel sequence variation is considerably low (allele frequency is = 0.16%), as no homozygotes, and only 3 heterozygote carriers were found in a healthy, unrelated Caucasian sample (N = 955). CONCLUSION: Remarkably, the deleted region contains consensus sequences of binding sites for several known transcription factors, suggesting that the different alleles may affect the transcriptional regulation of the gene. A comparison of methods and results for the allelic variations of the DRD4 gene in various ethnic groups is also discussed, which has a high impact in psychiatric genetic studies
