    Historical Aspects of the Impact of the Law of Eastern Adriatic Towns on the Law of Medieval Bosnia (Europeanisation of the Bosnian Law?)

    Razvitak hrvatskog prava ukazuje na zanimljivi pluralitet pravnih pojava gdje pojedina područja pokazuju veliku raznolikost preuzimanja i nadgradnje rimskog postklasičnog prava, bizantskog, franačko-langobardskog, mletačkog i ugarskog prava, sve opet na bogati slavenski običajnopravni temelj. Pri tom pojedine regije zrače svojim uplivom i na prava susjednih zemalja, prije svega srednjovjekovne banovine, a od 1377. godine Kraljevine Bosne; on je, naravno, značajniji u javnopravnoj oblasti, ali je daleko rašireniji i bogatiji u domenu privatnog prava. Hrvatsko srednjovjekovno pravo je samo jedna od varijanti europskog prava, pa upravo tim putem dolazi i do prihvatanja instituta europskog privatnog prava u pravni sistem srednjovjekovne Bosne, nesumnjivo da je uticaj dubrovačkog prava najvidljiviji jer najznačajniji bosanskohercegovački pravni povjesničar Mustafa Imamović (1941.-2017.) nalazi da je on toliko veliki da ga, s pravom, proglašava pomoćnim pravnim izvorom u Bosni. Uticaji prava ostalih istočnojadranskih gradova nerijetko se zanemaruju čak i u periodu kada su dalmatinski gradovi Split, Trogir i Šibenik te otoci Brač, Hvar i Korčula, bili u sastavu bosanske države. Bosanski kraljevi izdali su ukupno devet povelja Splitu, četiri povelje i dva pisma Trogiru, četiri povelje gradu Šibeniku u kojima su regulisali prirodne veze hrvatskih gradova i bosanskog zaleđa, iz kojih se često zrcale norme privatnog prava. Mada ti odnosi nipošto nisu jednosmjerni, upravo ovim putem dolazi do širenja, preoblikovanja i prihvatanja normi statutarnog prava hrvatskih gradova u bosankom zaleđu, pa time i do procesa prve europeizacije bosanskog prava, dok drugu pak donose rudari Sasi sa svojim tradicionalnim rudarskim pravima i slobodama.The development of the Croatian law is characterised by an interesting plurality of legal phenomena where certain areas have shown a huge variety of takeovers and upgrades of the post-classic Roman law, Byzantine law, Frankish-Lombardian law, Venetian and Hungarian law, superimposed on the rich foundation of Slavic customary law. In this process, certain regions influenced the laws of neighboring countries, such as the Banate of Bosnia in particular and the Kingdom of Bosnia from 1377. This was certainly more important in the field of public law, but it is far more widespread and richer in the domain of private law. Medieval Croatian law is one of the varieties of medieval European law (ius commune), and in this way the institute of medieval European private law was accepted in the legal system of medieval Bosnia. There is no doubt that the influence of the law of the Republic of Ragusa was the most prominent e, so that the most important Bosnian legal historian Mustafa Imamovic (1941–2017) identified its impact to be so large that he rightfully proclaimed it as an auxiliary source of law in Bosnia. The effects of the laws of other Eastern Adriatic towns were often ignored and disregarded even in the period when the Dalmatian towns of Split, Trogir and Šibenik and the islands of Brač, Hvar and Korčula, were part of the Bosnian state. Bosnian kings issued a total of nine charters to Split, four charters and two letters to Trogir, four charters to Šibenik which regulated the relations between Croatian towns and the Bosnian hinterland, reflecting the norms of private law. Although these were by no means one-way relations, this led to the spread, transformation and acceptance of the norms of the statutory rights of Croatian towns in the Bosnian hinterland, and thus to the process of the first Europeanization of the Bosnian law, while the second one was brought by the Saxon miners with their traditional mining rights and freedoms

    Acute abdominal pain presenting as a rare appendiceal duplication: a case report

    <p>Abstract</p> <p>Introduction</p> <p>Appendiceal duplication is a rare anomaly that can manifest as right lower quadrant pain. There are several variations described for this condition. We recommend aggressive operative management should this anatomical variation present in the presence of acute appendicitis.</p> <p>Case presentation</p> <p>We report the case of a 15-year-old African American girl who presented to our hospital with right lower quadrant pain and was subsequently found to have appendiceal duplication.</p> <p>Conclusion</p> <p>There are two categorical systems that have described and stratified appendiceal duplication. Both classification systems have been outlined and referenced in this case report. A computed tomography scan has been included to provide a visual aid to help identify true vermiform appendiceal duplication. The presence of this anatomical abnormality is not a reason for surgical intervention; however, should this be found in the setting of acute appendicitis, aggressive resection of both appendices is mandatory.</p

    U hrestomatijski koncipiranoj knjizi "Kritičari o Amiru Brki" koju je priredio Muhidin Džanko u poglavlju "Kulturna i opća historija, publicistika" nekoliko radova je posvećeno osvrtu na knjigu Amira Brke "Nisim Albahari, tragični revolucionar" (Centar za kulturu i obrazovanje, Tesanj, 2018.). Jedan od tih radova je i rad Dževada Drine "Istinsko poimanje ljudskih vrijednosti" u kome se navodi da je autor "... u ovom djelu primijenio multidisciplinarni pristup. Uz opsežno korištenje arhivskih izvora i literature (navođenih u fusnotama i evidentiranih na kraju knjige), on jasno određuje svoj humanistički diskurs kao kompleksnu strukturu akumuliranih znanja, sa metanarativima u povijesnoj pozadini: fašizmom, civilizacijom, kulturom, tešanjskom prošlošću. U ovom vremenu ukrštenih historija autor analizira društvene procese, vjerovanja i motive koji su određivali život ne samo Nisima Albaharija nego i njegove generacije, pa je, i po Czeslawu Miloszu, trgovina prošlošću samo razlika između zapadne i istočne Evrope, razlika između pamćenja i nedostatka pamćenja...“In the textbook "Critics of Amir Brka" prepared by Muhidin Džanko in the chapter "Cultural and General History", several works are devoted to a review of Amir Brka's book "Nisim Albahari, a tragic revolutionary" (Center for Culture and Education, Tešanj, 2018). One of these works is the work of Dževad Drina "A true understanding of human values" in which it is stated that the author "... applied a multidisciplinary approach in this work. With extensive use of archival sources and literature (cited in footnotes and recorded at the end of the book), he clearly defines his humanistic discourse as a complex structure of accumulated knowledge, with metanarratives in the historical background: fascism, civilization, culture, Tešanj's past. In this time of cross-cutting histories, the author analyzes the social processes, beliefs, and motives that determined the life not only of Nisim Albahari but and his generation, so, according to Czeslaw Milosz, trade with the past is just the difference between Western and Eastern Europe, the difference between memory and lack of memory ...     EU conditionality and governance complexities in the Western Balkans : towards mutual accommodation or maintaining the status quo?

    Almost a year following the third “eastern” enlargement of the European Union (EU) and first to the Western Balkans (Croatia), one particular research question remains unanswered: why does EU conditionality, which proved to be the main attraction and strategic tool leading to EU accession in the post-communist countries, still find hostile ground in most of the Western Balkan states? The thesis believes this dilemma deserve re-orientation of the existing academic research regarding EU conditionality as a mechanism of Europeanization. The thesis suggests that in all the countries of the Western Balkans, including Croatia as a new EU member state a huge gap exists between ‘rule transfer and ‘rule diffusion; hence, the research hypothesises the inadequacy, to a large extent, of the EUs ‘external governance method to the mentioned states, which consisted of applying EU conditionality based on the pre-dominance of ‘external incentive model as conceptualised by the mainstream Europeanization theory. Contrary to the majority of relatively new scholarship, the present doctoral thesis in this regard does not focus on either the EU conditionality or Balkan complexity as a unique explanation for the ineffectiveness of EU rule transfer. Instead, it complements the existing literature by emphasising how the mutual interaction of both concepts influences patterns of compliance in the selected cases, thus identifying and re-constructing factors to the positive fulfilment of conditions. The thesis key argument therefore posits that the EU can ‘accommodate its conditionality approach to the Western Balkans by carefully balancing between the domestic contextual constraints and setting of the conditions.     De Officio Praesidis – On the Service of the Administrator of a Province, With Special Emphasis on Judicial Activity / De Officio Praesidis - o službi upravnika provincije, sa posebnim osvrtom na sudbenu djelatnost

    Preserved terminational or border- writings from the area of today’s Bosnia and Herzegovina, point towards the judicial role of the administrator of the province in disputes about the borders of land, belonging to particular tribes and they most certainly represent a valuable source in tracing the topographical distribution of certain tribes, but also point towards the type of organisation and execution of judicial power in the provinces. Thus, from the writings on bedrock near the village of Vaganj (the municipality of Šipovo, near Jajce), we learn that the governor of the Dalmatia province, Lucius Camillus Scribonianus, during the reign of Emperor Claudius, authorised the centurion of the VII legion to mark the borders of the Sapuat and Lamatin tribes, which he did. The writings begin with the name of the governor of the province, so the judicial ruling was always made at his order or decree (ex decreto, ex iussu, ex sententialetc), according to Roman jurist Callistratus. Justinian’s Digesta in the first volume and XVIII titulus with 21 fragment and 11 paragraphs, based on the fragments from the works of some of the most significant Roman jurists: Ulpian, Paulus, Julius, Modestinus, Papinianus and others, along with other officials, also regulate the responsibilities of the governor of the province.     Vector Analysis of Visual Acuity and Refractive Outcomes of Astigmatic Corrections After T-PRK and Fs-LASIK

    Introduction: T Transepithelial photorefractive keratectomy (T-PRK) and femtosecond laser in situ keratomileusis (Fs-LASIK) are reftactive surgery methods for treating myopia and myopic astigmatism. Although T-PRK obtains similar results to Fs-LASIK with spherical myopia, it has differences in astigmatism correction. Vector analysis is a perfect tool to see the real difference between these two methods regarding astigmatic refraction and visual acuity.Aim: The aim of the study is to investigate changes in astigmatism and visual acuity following treatment of myopia and myopic astigmatism above -5.00DS and up to -2.00DC after either T-PRK or Fs-LASIK. Methods: Patients (30 eyes per group) underwent unremarkable T-PRK (group I) or Fs- LASIK (group II) using Schwind Amaris 750S laser. Astigmatic data acquired by subjective refraction were subjected to vector analysis to determine the association between surgically (SIA) and target induced (TIA) astigmatic powers and differences in axes(θ). Results: Key results at 6 months were: i) Mean astigmatism changed from -0.92 DC (sd ±0.49, 95%CI-1.10to-0.75) to -0.38 DC (sd ±0.40, 95% CI-0.52 to -0.24) in group I and -0.93DC (sd±0.55, 95%CI -1.07 to -0.67) to -0.14DC (sd±0.31, 95% CI-0.25 to -0.03) in group II (P=0.005 at 6 months). ii) Mean (±sd) θ was +9.7° (±19.0°) in group I and -2.2° (±15.5°) in group II (P=0.005).Conclusion: There was a greater mismatch between SIA and TIA powers and axes after T-PRK. T-PRK tends to induce more unwanted astigmatism. The predictability of the refractive and optical changes is better following Fs-LASIK
