Hukum Adat tentang Harta Perkawinan dalam Kosmologi Osing Banyuwangi
Tujuan penelitian ini adalah untuk memahami hukum adat tentang perkawinan dalam Kosmologi masyarakat Osing di Banyuwangi. Bagaimana hukum adat tentang perkawinan yang terkait dalam Kosmologi masyarakat Osing menjadi pertanyaan pertama dalam penelitian. Hukum adat tentang perkawinan dalam kosmologi masyarakat bersifat jamak, karena konstruksi sosial tentang hukum ada pada gagasan individu atau individu. Hal-hal pernikahan dalam komunitas Osing adalah harta asal, gono gini, harta yang diperoleh atas keringat sendiri, dan tirka mayit. Konflik tentang perkawinan selalu terjadi meski dipandu secara harmonis. Hukum adat tentang perkawinan selalu terintegrasi dalam kosmologi masyarakat Osing secara ontologis berorientasi pada dunia tersebut. Oleh karena itu diperlukan paradigma konstruktivisme yang mampu memahami objek penelitian. Dengan teori kosmologi, antropologi, agama dan hukum adat tentang perkawinan memandu peneliti untuk menarik kesimpulan bahwa hukum adat, khususnya tentang perkawinan, dalam masyarakat lokal selalu bergerak ke daerah sesuai dengan ritme kosmologisnya. Untuk menghadapi perubahan, individu harus secara aktif beradaptasi, melembagakan, memperbanyak, dan merekonstruksi informasi baru yang datang dari luar, khususnya hukum negara. Untuk itu, hukum adat khususnya tentang perkawinan dalam kosmologi masyarakat setempat, khususnya masyarakat Osing, diintegrasikan. Para pembuat hukum dan penegak hukum perlu memahami kosmologi masyarakat setempat jika mereka menginginkan hukum yang berkaitan dengan tanah menjadi hukum yang hidup yang ditaati dan bela rakyat dalam kehidupan nyata
Legal Conflicts in the Border Dispute between Indonesia and Timor Leste
This study aims to find the pattern of dependable approach in the border dispute settlement between Indonesia and Timor Leste in Oecusse. Historically, the community lived in the border area came from one ancestor. Because of social-political problems, however, the community subsequently followed the trajectory for which the partition between Indonesia and Timor Leste was undeniable. As a result of the partition, in the context, adat land should become the collective right of the community, which is situated under one adat law system but in the different national jurisdictions. This study questions on what causes collective land conflicts at the border of these countries. Using socio-legal and local wisdom approaches, as it is subsequently analyzed according to adat law, the study finds the cause that emerged as the result of the legal conflict between adat law and state law. If the state hands over the problem to adat communities or traditional leaders, based on their adat law dispute resolution, the conflict will resolve quickly. This study recommends the two states, Indonesia and Timor Leste, to provide the dispute resolution to adat or traditional leaders based on their adat law.

The goal of the study to improve alternative dispute resolution of adat land conflict within local knowledge perspectif in Ngadhu-bhaga community , Flores, Nusa Tenggara Timur. In the socio-cultural reality of local knowledge is plural. The plurality of local knowledges are local komunity cosmological based. The dispute resolution of conflict always happens although it is guided in harmony. So, the dispute resolution of adat land conflict of Ngadhu-bhaga community it is world view orientation
Kekuatan Mengikat Akta Van Vergelijk Pembagian Harta Bersama Berdasarkan Kitab Undang-Undang Hukum Perdata
Akta perdamaian yang telah disepakati bersama oleh kedua belah pihak, apalagi yang dibuat dalam bentuk akta notaril diharapkan dapat memberikan kepastian hukum bagi keduanya. Akta tersebut diharapkan menjadi pedoman terhadap kedua belah pihak jika suatu saat terdapat sengketa. Tetapi, apabila akta perdamaian yang telah dibuat khususnya yang telah dibuat dihadapan notaris dikemudian hari di persengketakan, tentunya akta perdamaian yang telah dibuat tersebut tidak memberikan kepastian hukum. Tujuan dalam penelitian ini yaitu menganalisis kekuatan mengikat akta van vergelijk pembagian harta bersama berdasarkan hukum. Tipe penelitian yang digunakan adalah yuridis normatif. Hasil dan pembahasan dalam penelitian ini yaitu Kekuatan pembuktian akta otentik diatur dalam Pasal 1870 KUH Perdata yang mengatakan bahwa suatu akta otentik memberikan di antara para pihak beserta ahli warisnya atau orang-orang yang mendapat hak dari mereka, suatu bukti yang sempurna tentang apa yang dimuat di dalamnya. Artinya, akta van vergelijk mengikat bagi para pihak yang membuat perjanjian perdamaian dan memberikan kekuatan pembuktian yang sempurna bagi para pihak.

The peace deed that has been mutually agreed upon by both parties, especially the one made in the form of a notarial deed, is expected to provide legal certainty for both. The deed is expected to be a guideline for both parties if at any time there is a dispute. However, if the peace deed that has been made, especially the one that has been made before a notary in the future, is disputed, of course the peace deed that has been made does not provide legal certainty. The purpose of this study is to analyze the binding strength of the deed of van vergelijk distribution of joint property based on law. The type of research used is normative juridical. The results and discussion in this study are the strength of proof of an authentic deed regulated in Article 1870 of the Civil Code which says that an authentic deed provides between the parties and their heirs or people who have rights from them, a perfect proof of what is contained in the document. in it. That is, the deed of van vergelijk is binding on the parties who made the peace agreement and provides perfect evidentiary power for the parties.

The legal concept regarding the position of a child born out of wedlock who only has a civil relationship with the mother and the mother's family experienced a shift when the Constitutional Court Decision Number 46/PUU-VIII/2010 was issued. There are 2 (two) issues that will be discussed, namely the rights and status of children illegitimate after the Constitutional Court's decision, as well as the authority of a Notary in making a Certificate of Inheritance for a Child Out of Wedlock after the Constitutional Court's Decision. In compiling this research, the writer uses normative research methods which are carried out as an effort to obtain the necessary data in an effort to obtain the necessary data in connection with the problem. From the results of the research it can be obtained that the Constitutional Court's decision opens opportunities for children outside of marriage to have civil relations with their father and father's family and the authority of a notary in making certificates of inheritance for children outside of marriage after the decision of the Constitutional Court Number 46/PUU-VIII/2010 becomes very important
PERAN NOTARIS DALAM PERLINDUNGAN HUKUM TERHADAP PIHAK KETIGA ATAS PEMBUATAN PERJANJIAN PERKAWINAN SETELAH PERKAWINAN BERLANGSUNG
One of the legal consequence of a marriage is a consolidation of husband and wife assets with the understanding that both parties before signing the marriage contract can decide otherwise, through the pre-nuptial contract. The Constitutional Court Decision No. 69/PUU-XII/2015, made possible the making of a similar arrangement after the marriage contract has been signed. The focus of this article is to explore, using a juridical normative approach, what legal protection exist for third parties. The main finding is that legal protection is provided by requiring the contract be made by and before a notary public, registered at the Civil Registrar Office and all that is performed only after the Notary Public made an inventory of both spouse’s assets
Putusan Nihil: Mengukur Eksistensi dan Validitas dalam Perspektif Ronald Dworkin
Penerapan "putusan nihil" oleh hakim di Indonesia menciptakan ketidakpastian hukum dan moralitas dalam pengadilan, sebuah permasalahan yang perlu diatasi dengan pendekatan yang lebih komprehensif daripada mengandalkan kepastian hukum semata. Dalam konteks ini, prinsip-prinsip filosofis yang lebih luas seperti yang disampaikan oleh Dworkin menjadi relevan. Penelitian ini mengkaji sudut pandang filasafat hukum dalam eksistensi putusan nihil. Di satu sisi, sebagai produk interpretatif kewenangan hakim, putusan nihil dikaji melalui pemaparan filosofis milik Dworkin. Penelitian ini mengevaluasi putusan nihil dengan memeriksa dasar hukumnya dan menggunakan pendekatan peraturan perundang-undangan serta konseptual. Selain itu, penelitian ini mengkaji konsep hukum interpretatif dalam hukum civil law dan memanfaatkan konsep filsafat hukum Ronald Dworkin. Studi ini bertujuan untuk menganalisis eksistensi putusan nihil dalam kerangka hukum sipil serta menguji validitasnya dengan konsep Ronald Dworkin. Eksistensi putusan nihil berasal dari ketidakmampuan sistem hukum Indonesia dalam menangani permasalahan teknis. Kewenangan interpretatif hakim menjadi solusi, yang lambat laun menjadi praktek lazim. Hal ini menciptakan paradoks antara karakteristik civil law dan common law di Indonesia. Ketidakpastian muncul dalam penerapan hukum dan pertimbangan etika dalam hukuman pemidanaan yang adil, menimbulkan dilema prioritas di mana putusan nihil sering kali lebih mengutamakan kepastian hukum daripada kebenaran materiil. Penelitian ini menemukan putusan nihil sebagai jawaban dari celah sistemik sistem hukum Indonesia yang berkarakter civil law. Dalam sudut pandang teori Dworkin, putusan nihil menjadi suatu dilema prioritas antara kepastian hukum dalam system hukum civil law, dengan kebenaran materiil. Akhirnya, putusan nihil menjadi bukti produk hukum yang mengutamakan prinsip kebenaran materiil.

Marriage Agreement During Marriage (A Postnuptial Agreement) Principle of Publicity as a Legal Protection for Creditors
The Constitutional Court Decision Number 69/PUU/XII/2015 has an impact on the concept of a marriage contract that has applies in Indonesia. A marriage contract is known as a pre-nuptial agreement or pre-marital agreement in accordance with Article 29 paragraph (1) of the Law on Marriage, which states that a marriage contract can only be made before or when the marriage is in progress. The Indonesian people finally recognize the post nuptial agreement or post marital agreement in accordance with the Constitutional Court Decision which states that a marriage agreement can be made at the time, before it takes place or during the marriage bond. The court's decision raises legal uncertainty regarding the time of making the contract considering the essence of the previous marriage agreement is to prevent problems arising after the marriage has taken place. The principle of publicity of a post nuptial agreement is indicated to have several weaknesses that can harm third parties or creditors. Therefore, the researcher focuses on analyzing several problems, namely regarding the nature of the marriage contract according to the perspective of legal regulations in Indonesia, the binding strength of the publicity principle in the post nuptial agreement and the formulation of the publicity principle of the marriage agreements to provide legal protection for creditors. Kedudukan Hukum Ahli Waris Penyandang Cacat Mental Dalam Memperoleh Hak Warisnya (Harta Waris)
Every human being is born with their own diversity and uniqueness, some have differences called special needs. Many people out there view that a person who is born with special needs is called an imperfect human or is commonly called a cripple. Normative legal research is used in this study to find solutions to the legal position of heirs of people with mental disabilities. The approach used is a statutory approach and a conceptual approach to the authority of guardians, inheritance management, and the rights of people with mental disabilities. People who have mental disorders or disabilities when faced with legal problems, in this case regarding the matter of inheritance, they cannot take/perform legal actions themselves. Even though he is in a state of being unable to carry out legal actions independently, he is still referred to as a legal subject. By recognizing persons with mental disabilities as legal subjects, they are included in legal subjects who are incompetent and can be assisted by guardians to receive inheritance.

Regional Autonomy Perspective on Government Affairs Division for Transportation Connectivity
The management of type B/C road transportation passenger terminal and operation/closure of weighing equipment permanently by the central government after the enactment of Act Number 23 of 2014 on Local Government is not in accordance with the principle of regional autonomy. Regarding the Provincial and district governments, according to the 1945 Constitution of the Republic of Indonesia, it is stipulated that regional governments regulate and administer government affairs themselves according to the principles of autonomy and co-administration. The division of government authority for the management of the type B/C road transportation passenger terminal has been shared by the central government to local governments. Handover of personnel, funding, facilities and infrastructure, as well as documents due to the division of Government affairs between the central, provincial and regional governments, there found regions that have not carried out the handover of government affairs as regulated by the Act Number 23 of 2014, for there are road transportation passenger terminals that the status are downgraded. As for the operation and closure of the weighing equipment permanently, namely weigh bridges, several weighing devices are still available and have not functioned regularly by the central government, especially in East Java Province. Thus this case creates legal uncertainty on the implementation of government affairs and causes society disobedience ontransportation order and smoothness as a means for a city/regency for the progress and development of infrastructure. Moreover, transportation can increase the accessibility of relations among one region and another.
