В статье дается определение понятию «владение» у глоссаторов. Автор отмечает, что они считали необязательным фактическое завладение вещью для признания приобретения права собственности. Приводится перечень упрощенных видов традиции из шести позиций. In the article the concept of "ownership" is defined from the standpoint of glossators. The author notes that actual occupation of thing for the recognition of property rights was unnecessary for them. A list of simplified forms of tradition consisted of six positions is given

Public Law in the Works of Glossators and Commentators

В статье отмечается интерес глоссаторов и комментаторов к отдельным вопросам из сферы римского публичного права, обсуждение которых велось в отсутствие разработанного понятия ius publicum. При этом перемена контекста влекла за собой изменение смысла античных правовых текстов. In the article the interest of glossators and commentators to some issues from the field of Roman public law, which were discussed in the absence of the developed concept of ius publicum, is noted. В статье обобщены разнородные высказывания средневековых правоведов о пакте. Автор отмечает, что пакт в понимании глоссаторов превратился в уникальное правовое средство справедливого урегулирования имущественных интересов. The diverse statements of the medieval jurists about pactum are summarized in the article. The author notes that pactum, from the standpoint of glossators, was the unique legal instrument of just adjustment of the property interests
