    Regulation 1049/2001 on the right of access to documents, including the digital context

    Published online: August 2024Upon request of the Committee on Petitions (PETI), the Policy Department for Citizens’ Rights and Constitutional Affairs commissioned the present study on Regulation 1049/2001 on access to documents with a twofold objective. First, to update the analysis conducted in a 2016 study for the PETI Committee with the latest developments in the case law of the CJEU and the activities led by the European Ombudsman since then – in particular focussing on access to legislative documents, documents relating to administrative proceedings, Court proceedings, infringement proceedings, protection of privacy, international relations, and special regimes. Second, to assess the possible future alignment of the Access Regulation with the evolving digital context, including a potential revision of the definition of document, access to user-friendly public registers and internet sites, access to agendas of officials and scheduled meetings with interest representatives, and access to videos of CJEU oral hearings. The research also incorporates illustrative and complementary cases and own initiatives by the European Ombudsman as indications of evolving challenges to institutional secrecy in the EU context.-- Executive summary -- 1.     A Systematic Review of Integrated Functional Near-Infrared Spectroscopy (fNIRS) and Transcranial Magnetic Stimulation (TMS) Studies

    Background: The capacity for TMS to elicit neural activity and manipulate cortical excitability has created significant expectation regarding its use in both cognitive and clinical neuroscience. However, the absence of an ability to quantify stimulation effects, particularly outside of the motor cortex, has led clinicians and researchers to pair noninvasive brain stimulation with noninvasive neuroimaging techniques. fNIRS, as an optical and wearable neuroimaging technique, is an ideal candidate for integrated use with TMS. Together, TMS+fNIRS may offer a hybrid alternative to “blind” stimulation to assess NIBS in therapy and research.Objective: In this systematic review, the current body of research into the transient and prolonged effects of TMS on fNIRS-based cortical hemodynamic measures while at rest and during tasks are discussed. Additionally, studies investigating the relation of fNIRS to measures of cortical excitability as produced by TMS-evoked Motor-Evoked-Potential (MEP) are evaluated. The aim of this review is to outline the integrated use of TMS+fNIRS and consolidate findings related to use of fNIRS to monitor changes attributed to TMS and the relationship of fNIRS to cortical excitability itself.Methods: Key terms were searched in PubMed and Web-of-Science to identify studies investigating the use of both fNIRS and TMS. Works from Google-Scholar and referenced works in identified papers were also assessed for relevance. All published experimental studies using both fNIRS and TMS techniques in the study methodology were included.Results: A combined literature search of neuroimaging and neurostimulation studies identified 53 papers detailing the joint use of fNIRS and TMS. 22/53 investigated the immediate effects of TMS at rest in the DLPFC and M1 as measured by fNIRS. 21/22 studies reported a significant effect in [HbO] for 40/54 stimulation conditions with 14 resulting an increase and 26 in a decrease. While 15/22 studies also reported [HbR], only 5/37 conditions were significant. Task effects of fNIRS+TMS were detailed in 16 studies, including 10 with clinical populations. Most studies only reported significant changes in [HbO] related measures. Studies comparing fNIRS to changes in MEP-measured cortical excitability suggest that fNIRS measures may be spatially more diffuse but share similar traits.Conclusion: This review summarizes the progress in the development of this emerging hybrid neuroimaging & neurostimulation methodology and its applications. Despite encouraging progress and novel applications, a lack of replicated works, along with highly disparate methodological approaches, highlight the need for further controlled studies. Interpretation of current research directions, technical challenges of TMS+fNIRS, and recommendations regarding future works are discussed

    Beyond Western, educated, industrial, rich, and democratic (WEIRD) psychology: measuring and mapping scales of cultural and psychological distance

    In this article, we present a tool and a method for measuring the psychological and cultural distance between societies and creating a distance scale with any population as the point of comparison. Because psychological data are dominated by samples drawn from Western, educated, industrialized, rich, and democratic (WEIRD) nations, and overwhelmingly, the United States, we focused on distance from the United States. We also present distance from China, the country with the largest population and second largest economy, which is a common cultural comparison. We applied the fixation index (FST), a meaningful statistic in evolutionary theory, to the World Values Survey of cultural beliefs and behaviors. As the extreme WEIRDness of the literature begins to dissolve, our tool will become more useful for designing, planning, and justifying a wide range of comparative psychological projects. Our code and accompanying online application allow for comparisons between any two countries. Analyses of regional diversity reveal the relative homogeneity of the United States. Cultural distance predicts various psychological outcomes

    Vitamin D receptor genotype influences risk of upper respiratory infection.

    SNP in the vitamin D receptor (VDR) gene is associated with risk of lower respiratory infections. The influence of genetic variation in the vitamin D pathway resulting in susceptibility to upper respiratory infections (URI) has not been investigated. We evaluated the influence of thirty-three SNP in eleven vitamin D pathway genes (DBP, DHCR7, RXRA, CYP2R1, CYP27B1, CYP24A1, CYP3A4, CYP27A1, LRP2, CUBN and VDR) resulting in URI risk in 725 adults in London, UK, using an additive model with adjustment for potential confounders and correction for multiple comparisons. Significant associations in this cohort were investigated in a validation cohort of 737 children in Manchester, UK. In all, three SNP in VDR (rs4334089, rs11568820 and rs7970314) and one SNP in CYP3A4 (rs2740574) were associated with risk of URI in the discovery cohort after adjusting for potential confounders and correcting for multiple comparisons (adjusted incidence rate ratio per additional minor allele ≄1·15, P for trend ≀0·030). This association was replicated for rs4334089 in the validation cohort (P for trend=0·048) but not for rs11568820, rs7970314 or rs2740574. Carriage of the minor allele of the rs4334089 SNP in VDR was associated with increased susceptibility to URI in children and adult cohorts in the United Kingdom.National Institute for Health Research (NIHR) under its Programme Grants for Applied Research Programme (Ref. no.     Racial Dynamics: The Casting of Lucian Msamati as Salieri in the National Theatre’s 2016 Production of Amadeus

    This article examines the casting of Lucian Msamati as Antonio Salieri in the 2016 production of Peter Shaffer’s 1979 play Amadeus by the National Theatre in London. This was the first time an actor of colour had played the role of Salieri in a professional production of Shaffer’s drama. How did the casting affect interpretation of the play? And what was its cultural significance in the context of current debates about demographic representation in classical music and efforts to diversify the art form and its practitioners? In order to answer these questions this article examines statements made by the production team, theories of casting, and documented responses to Msamati in this role, including professional reviews and comments made online. The article reveals a complicated picture with regard to the efficacy of this casting choice, highlighting limitations and missed opportunities for deeper engagement with the history and politics of race in classical music whilst acknowledging the positive aspects of the casting and its potential for beneficial social impact. In doing so, this article demonstrates the importance of thinking across different types of representation in both cultural production and analysis: specifically, demographic representation in classical music (i.e., whom it represents and who is missing or under-represented in its practices) and the artistic representation of classical music, specifically, in this case, in theatre
