    Why Judges Applying the Daubert Trilogy Need to Know About the Social, Institutional, and Rhetorical - And Not Just the Methodological - aspects of Science

    In response to the claim that many judges are deficient in their understanding of scientific methodology, this Article identifies in recent cases (1) a pragmatic perspective on the part of federal appellate judges when they reverse trial judges who tend to idealize science (i.e., who do not appreciate the local and practical goals and limitations of science), and (ii) an educational model of judicial gatekeeping that results in reversal of trial judges who defer to the social authority of science (i.e., who mistake authority for reliability). Next, this Article observes that courts (in the cases it analyzes) are not interested in pragmatically constructing legal science, but rather attempt to ensure that science itself, conceived pragmatically (i.e., without idealizing science), is appropriated in law. This Article concludes that trial judges who fail to appreciate the social, institutional, and rhetorical aspects of science tend to reject reliable—albeit pragmatic—science, welcome unreliable—albeit authoritative— science, and thereby create a body of legal science that is out of sync with mainstream science

    A Non-Romantic View of Expert Testimony

    The Daubert trilogy as a whole deflects attention away from abstract identifications of scientific validity (including the demarcation controversy aimed at rooting out allegedly junk science from the courtroom), and toward the application of expertise to the particular case at hand. That emphasis on application is reflected as well in post-trilogy scholarship, wherein we see three patterns or contours that both help quiet the debates and provide useful guidance to judges and lawyers. First, there is a pragmatic recognition, in various forms, that the focus should be on how science is being used rather than on science in the abstract. Second, that focus must be accompanied by a modest view of science rather than an idealized version of its capacity to produce knowledge for law. Third, the focus on the application phase of expertise must also be accompanied by a modest view of law itself, including judges, lawyers, juries, and the evidentiary rules. It is far too easy, in the post-trilogy series of debates, to romanticize the power of science, or the virtues of the legal system, or both, and to fail to recognize their practical limitations. Romantic images of science are often bolstered by demonizations of forensic scientists, plaintiff\u27s experts, or social science, just as romantic images of law often rely on demonizations of judges untrained in science, lawyers as overly zealous advocates, or jurors as emotional, uncritical, and confused. Thus the pragmatic emphasis on application needs to be mediated by pragmatic views of science and law. Fortunately, the pragmatic aspects of science and law - which we associate with their local, social, rhetorical, and institutional features - are most visible in the focus on application. Nevertheless, in the heat of debate, the limitations of law and science often recede into the background, which results in undue attention to red herrings as well as unrealistic proposals for reform

    Temporal Trends in Florida Panther Food Habits

    Once on the brink of extinction, the Florida panther (Puma concolor coryi) has reoccupied parts of its extirpated range in southern Florida, USA over the past 20 years, which has largely been attributed to genetic restoration efforts initiated in 1995 to combat inbreeding depression and subsequent deleterious traits. Concurrent to the resurgence, an increase in documented livestock depredation events has heightened concern over human– panther conflicts. We examined 312 stomach content, scat, and feces (large intestine contents) samples collected 1989 to 2014 across the endemic range in southern Florida. We compared frequency of occurrence of prey items in samples by temporal (pre- and post-genetic restoration), geographic (north and south of 26° 10.017′ latitude), and demographic (age and sex) categories. We observed an apparent temporal shift in prey item occurrence in scats, where raccoon (Procyon lotor) occurrence increased while wild hog (Sus scrofa) occurrence decreased, whereas white-tailed deer (Odocoileus virginianus) occurrence appeared constant. Post-genetic restoration, we observed a geographic difference in panther prey, where white-tailed deer and raccoons were consumed more commonly in the southern part of the study area (characterized by lower soil quality and higher hydrological fluctuations), while wild hogs were consumed more frequently in the northern part of the study area. Neither sex nor age appeared to affect frequency of prey occurrence. Pets and livestock were not frequently found in the samples we examined. Overall, our results show shifts in panther diets both temporally and geographically; however, no notable changes in frequency of livestock found in panther diets were observed

    Maternal Choline Supplementation Alters Fetal Growth Patterns in a Mouse Model of Placental Insufficiency

    Impairments in placental development can adversely affect pregnancy outcomes. The bioactive nutrient choline may mitigate some of these impairments, as suggested by data in humans, animals, and human trophoblasts. Herein, we investigated the effects of maternal choline supplementation (MCS) on parameters of fetal growth in a Dlx3+/− (distal-less homeobox 3) mouse model of placental insufficiency. Dlx3+/− female mice were assigned to 1X (control), 2X, or 4X choline intake levels during gestation. Dams were sacrificed at embryonic days E10.5, 12.5, 15.5, and 18.5. At E10.5, placental weight, embryo weight, and placental efficiency were higher in 4X versus 1X choline. Higher concentrations of hepatic and placental betaine were detected in 4X versus 1X choline, and placental betaine was positively associated with embryo weight. Placental mRNA expression of Igf1 was downregulated by 4X (versus 1X) choline at E10.5. No differences in fetal growth parameters were detected at E12.5 and 15.5, whereas a small but significant reduction in fetal weight was detected at E18.5 in 4X versus 1X choline. MCS improved fetal growth during early pregnancy in the Dlx3+/− mice with the compensatory downregulation of Igf1 to slow growth as gestation progressed.     Maternal Choline Supplementation during Normal Murine Pregnancy Alters the Placental Epigenome: Results of an Exploratory Study

    The placental epigenome regulates processes that affect placental and fetal development, and could be mediating some of the reported effects of maternal choline supplementation (MCS) on placental vascular development and nutrient delivery. As an extension of work previously conducted in pregnant mice, the current study sought to explore the effects of MCS on various epigenetic markers in the placenta. RNA and DNA were extracted from placentas collected on embryonic day 15.5 from pregnant mice fed a 1X or 4X choline diet, and were subjected to genome-wide sequencing procedures or mass-spectrometry-based assays to examine placental imprinted gene expression, DNA methylation patterns, and microRNA (miRNA) abundance. MCS yielded a higher (fold change = 1.63-2.25) expression of four imprinted genes (Ampd3, Tfpi2, Gatm and Aqp1) in the female placentas and a lower (fold change = 0.46–0.62) expression of three imprinted genes (Dcn, Qpct and Tnfrsf23) in the male placentas (false discovery rate (FDR) \u3c 0.05 for both sexes). Methylation in the promoter regions of these genes and global placental DNA methylation were also affected (p \u3c 0.05). Additionally, a lower (fold change = 0.3; Punadjusted = 2.05 x 10; FDR = 0.13) abundance of miR-2137 and a higher (fold change = 1.25–3.92; p \u3c 0.05) expression of its target genes were detected in the 4X choline placentas. These data demonstrate that the placental epigenome is responsive to maternal choline intake during murine pregnancy and likely mediates some of the previously described choline-induced effects on placental and fetal outcomes
