    The discretion of the legislator in Constitutional jurisprudence

    Il presente lavoro mira ad analizzare la questione della discrezionalità del legislatore e i limiti della revisione costituzionale. Nella prima parte dell'indagine, sono sottolineati gli elementi fondamentali oggetto di dibattito alla Costituente e la natura del giudizio di costituzionalità, con particolare riferimento all'art. 134 Cost., in cui viene esplicitata la natura del sindacato di costituzionalità, e all'art. 28 della legge. 87 del 1953, che esclude ogni valutazione di natura politica e qualsiasi sindacato sull'uso del potere discrezionale del Parlamento, vietando così, anche all'interprete istituzionale, di cambiare le regole del sistema. La seconda parte del lavoro è dedicata alla giurisprudenza costituzionale. Le decisioni acquisite sono sistematizzate secondo tre direttrici fondamentali. Innanzitutto, vie fatta una suddivisione per materia e, all'interno di questa, si pone l'accento sulla successione cronologica delle stesse (pronunce) al fine di individuare possibili tendenze idonee a delineare un (possibile) vincolo giudiziario nel suo evolversi nel tempo. Poi ci si sofferma sul tipo di pronuncia. Infine, sono studiate le motivazioni ricorrenti più in dettaglio. Nella parte finale dello studio, è affrontata la particolare dottrina della political question elaborata negli Stati Uniti in quanto parrebbe presentare numerose affinità con il limite della discrezionalità del legislatore così come elaborato dalla dottrina e dalla giurisprudenza italiana.The present work aims to analyze the issue of the discretion of the legislator and the limits of constitutional review. In the first part of the investigation, we outline the fundamental elements subject to debate at the Constituent and immediately following on the nature of the judgment of constitutionality. In the first place we analyze art. 134 Cost., in which is made explicit the nature of the syndicate of constitutionality and then deal with the discipline of art. 28 of law. 87 of 1953, which excludes any assessment of a political nature and any syndicate on the use of discretionary power of Parliament, thus prohibiting, even to the institutional interpreter, to change the rules of the system. Secondly, we deal with constitutional jurisprudence. The decisions acquired are systematized following three fundamental guidelines. First of all, a subdivision is made by subject matter and, within this, emphasis is placed on the chronological succession of the same (pronouncements) in order to identify possible trends suitable for outlining a possible) judicial restraint as it evolves over time. Secondly, attention will be given to the type of pronouncement. Finally, the most recurrent motivations will be studied in more detail. In the final part of the study, the particular doctrine of the political question elaborated in the United States will be dealt with because it seems to present numerous affinities with the limit of the legislator’s discretion as elaborated by Italian doctrine and jurisprudence

    Statistical optimization of a sustainable fertilizer composition based on black soldier fly larvae as source of nitrogen

    In the present work, a statistical optimization of a sustainable coating for core–shell NPK (Nitrogen–Phosphorus–Potassium) fertilizers was investigated. The environmental green coating was enriched in nitrogen using a biomass and renewable source, namely the nitrogen rich fraction of black soldier fly larvae (BSFL) (Hermetia Illucens, Diptera: Stratiomyidae) reared on vegetable waste. A rational approach was proposed with the aim of calculating the best formulation of the coating, considering both its manufacturing behavior, such as adhesion to the core, and its physical properties, such as homogeneity or plasticity. From a circular economy perspective, together with the nitrogen-rich fraction from BSFL (from 51 to 90 wt.%), water and glycerol were considered for the coating formulation in different proportion: from 10 to 32 wt.% and from 0 to 17 wt.% respectively. The Design of Experiments technique was implemented to limit the total number of tests for the coating formulation (18 tests). ANOVA was employed, with the aim of obtaining mathematical models to derive a better precise and objective formulation. The results show that the use of glycerol can be avoided, as well as only a limited amount of water (11 wt.%) is necessary to obtain an optimized coating formulation, thereafter, satisfying the more relevant technological and physical properties for the coating manufacturin

    Disordering of InGaAs/GaAs strained quantum well structures induced by rare gas ion implantation

    In this work we have investigated the effect of various implantation schemes on In(0.2)GaAs/GaAs/AlGaAs Single Quantum Well, where the implanted species are Argon and Helium, with doses in the range 1E12 to 1E14 at cm^2, at energy spanning 270 - 400 KeV and 30 to 50 KeV for Ar and He, respectively. Repetitive annealing processes were carried out between 735 and 870 degree(s)C and the interdiffusion was deduced by photoluminescence measurements. A maximum of 20 nm shift from He ion implanted Quantum Well with an high degree of reconstruction has been recorded, thus allowing the application of this disordering scheme for the realization of optoelectronic devices
