    Promulgating Requirements for Admission to Prosecute Patent Applications

    Among federal agencies, the U. S. Patent and Trademark Office is unique in its ability to require attorneys to submit to special requirements, such as passing a six hour examination, before being permitted to practice before it in patent cases. Indeed, the Supreme Court has held that an individual so admitted to practice before the PTO need not comply with state requirements otherwise applicable to those practicing law. The first part of this article discusses how this requirement came to be. It then discusses how the PTO determines whether an individual is fit to sit for the patent examination, focusing particularly on provisions contained in a bulletin mailed by its Office of Enrollment and Discipline (OED) to all would-be patent practitioners. It also briefly discusses rule-making requirements (and exceptions) generally applicable to federal agencies and examines the nature of the aforesaid provisions intended to affect admission to prosecute patent applications. This article concludes that the detailed provisions sent to applicants, fitting none of the rule-making exceptions, should be promulgated in accordance with the Administrative Procedure Act. It also concludes that, in the meantime, those provisions should not be regarded as binding on applicants to practice before the PTO in patent cases. Finally, the article contains an appendix that should be of particular interest to persons involved with software patents

    Methods and Compositions for Optimizing Blood and Tissue Stability of Camptothecin and Other Albumin-Binding Therapeutic Compounds

    The present invention provides methods and formulations for optimizing the anti-cancer and anti-HIV activities of a camptothecin drug, including camptothecin and its related analogs including 9-aminocamptothecin and 9-nitrocamptothecin. The invention involves methodologies and formulations that limit human serum albumin-mediated reduction of the anti-cancer and anti-HIV effects of the camptothecins, and the methods and formulations provide combination therapies in which binding of the camptothecin agent to human serum albumin can be modulated by the administration of a competing agent that also binds human serum albumin. Reduced camptothecin drug binding to human serum albumin can result in elevated camptothecin free drug levels and thus improve the effectiveness of treatment regimens involving these drugs. Further agents such as methotrexate and AZT can also be used in cancer and HIV-positive patients employing camptothecin drugs

    Implementation of HERS-ST in Iowa and Development / Refinement of a National Training Program

    The Highway Economic Requirements System (HERS) is an economic model that uses highway performance monitoring system (HPMS) data to project future highway conditions and requirements. HERS is a highly complex model that, at the national level, uses samples of the highway network taken from the HPMS data. As a result, at the national level it is only used for aggregate network-level analysis (planning-level analysis). When the Federal Highway Administration’s Office of Asset Management was established in 1999, the office began developing the state version of HERS, or HERS-ST. HERS-ST has since evolved into a model that is specifically crafted for states. A DOS version of HERS-ST was demonstrated at a workshop attended by representatives of several state transportation agencies in 2001. Since then, several improvements have been made to the software, including updates for a Windows environment and the addition of GIS capabilities. The current project will yield a HERS-ST specifically for Iowa, but one that can be used as a model for other states

    Under a certain scaling, the electron densities of finite systems become both large and slowly-varying, so that the gradient expansions of the density functionals for the Kohn-Sham kinetic and exchange energies become asymptotically exact to order 2\nabla^2. Neutral atoms of large ZZ scale similarly, but a cusp correction at the nucleus requires generalizing the gradient expansion for exchange, producing the wrong gradient coefficient in the slowly-varying limit. Meta-generalized gradient approximations (meta-GGA's) recover both the slowly-varying and large-ZZ limits.     Contemporary sports nutrition guidelines recommend that each athlete develop a personalised, periodised and practical approach to eating that allows him or her to train hard, recover and adapt optimally, stay free of illness and injury and compete at their best at peak races. Competitive triathletes undertake a heavy training programme to prepare for three different sports while undertaking races varying in duration from 20 min to 10 h. The everyday diet should be adequate in energy availability, provide CHO in varying amounts and timing around workouts according to the benefits of training with low or high CHO availability and spread high-quality protein over the day to maximise the adaptive response to each session. Race nutrition requires a targeted and well-practised plan that maintains fuel and hydration goals over the duration of the specific event, according to the opportunities provided by the race and other challenges, such as a hot environment. Supplements and sports foods can make a small contribution to a sports nutrition plan, when medical supplements are used under supervision to prevent/treat nutrient deficiencies (e.g. iron or vitamin D) or when sports foods provide a convenient source of nutrients when it is impractical to eat whole foods. Finally, a few evidence-based performance supplements may contribute to optimal race performance when used according to best practice protocols to suit the triathlete’s goals and individual responsiveness

    Formation and structural chemistry of the unusual cyanide-bridged dinuclear species [Ru-2(NN)(2)(CN)(7)](3-)(NN=2,2 '-bipyridine or 1,10-phenanthroline)

    Crystallisation of simple cyanoruthenate complex anions [Ru(NN)(CN)(4)](2) (NN = 2,2'-bipyridine or 1,10-phenanthroline) in the presence of Lewis-acidic cations such as Ln(III) or guanidinium cations results, in addition to the expected [Ru(NN)(CN)(4)](2) salts, in the formation of small amounts of salts of the dinuclear species [Ru-2(NN)(2)(CN)(7)](3). These cyanide-bridged anions have arisen from the combination of two monomer units [Ru(NN)(CN)(4)](2) following the loss of one cyanide, presumably as HCN. The crystal structures of [Nd(H2O)(5.5)][Ru-2(bipy)(2)(CN)(7)] center dot 11H(2)O and [Pr(H2O)(6)][Ru-2(phen)(2)(CN)(7)] center dot 9H(2)O show that the cyanoruthenate anions form Ru-CN-Ln bridges to the Ln(III) cations, resulting in infinite coordination polymers consisting of fused Ru(2)Ln(2)(mu-CN)(4) squares and Ru(4)Ln(2)(mu-CN)(6) hexagons, which alternate to form a one-dimensional chain. In [CH6N3](3)[Ru-2(bipy)(2)(CN)(7)] center dot 2H(2)O in contrast the discrete complex anions are involved in an extensive network of hydrogen-bonding involving terminal cyanide ligands, water molecules, and guanidinium cations. In the [Ru-2(NN)(2)(CN)(7)](3) anions themselves the two NN ligands are approximately eclipsed, lying on the same side of the central Ru-CN-Ru axis, such that their peripheries are in close contact. Consequently, when NN = 4,4'-Bu-t(2)-2,2'-bipyridine the steric bulk of the t-butyl groups prevents the formation of the dinuclear anions, and the only product is the simple salt of the monomer, [CH6N3](2)[Ru((t)Bu(2)bipy)(CN)(4)] center dot 2H(2)O. We demonstrated by electrospray mass spectrometry that the dinuclear by-product [Ru-2(phen)(2)(CN)(7)](3) could be formed in significant amounts during the synthesis of monomeric [Ru(phen)(CN)(4)](2) if the reaction time was too long or the medium too acidic. In the solid state the luminescence properties of [Ru-2(bipy)(2)(CN)(7)](3) (as its guanidinium salt) are comparable to those of monomeric [Ru(bipy)(CN)(4)](2), with a (MLCT)-M-3 emission at 581 nm

    Elevated Temperature, Residual Compressive Strength of Impact-Damaged Sandwich Structure Manufactured Out-of-Autoclave

    Several 1/16th-scale curved sandwich composite panel sections of a 10 m diameter barrel were fabricated to demonstrate the manufacturability of large-scale curved sections using minimum gauge, [+60/-60/0]s, toughened epoxy composite facesheets co-cured with low density (50 kilograms per cubic meters) aluminum honeycomb core. One of these panels was fabricated out of autoclave (OoA) by the vacuum bag oven (VBO) process using Cycom(Registered Trademark) T40-800b/5320-1 prepreg system while another panel with the same lay-up and dimensions was fabricated using the autoclave-cure, toughened epoxy prepreg system Cycom(Registered Trademark) IM7/977-3. The resulting 2.44 m x 2 m curved panels were investigated by non-destructive evaluation (NDE) at NASA Langley Research Center (NASA LaRC) to determine initial fabrication quality and then cut into smaller coupons for elevated temperature wet (ETW) mechanical property characterization. Mechanical property characterization of the sandwich coupons was conducted including edge-wise compression (EWC), and compression-after-impact (CAI) at conditions ranging from 25 C/dry to 150 C/wet.
