Docket Control in the Apex Court Exercising Constitutional Review
Globally, there was a dramatic and disproportionate increase in caseloads in the second half of the twentieth century due to the expansion of human rights jurisprudence and legal awareness among citizens. This in turn, affected the quality of justice in the Apex Court of every country involved in the process of constitutional review. It was found that there cannot be any generalization in designing a Constitutional Court and it all depended on the constitutional and legal history of that particular nation. In many countries, the legislature and executive brought timely reforms to keep the Apex Court free from backlogs, but some countries, even today, are reeling under the pressure of unresolved cases. India is one among them and of late, the discussion about the National Court of Appeal (NCA) as a solution to this problem has gained momentum. This paper analyses the feasibility of establishing the NCA, along with measures that can be adopted by India, in tackling the mounting arrears of cases in Courts, following the American model of review such as U.S., Canada, Japan, and Brazil
A Study on the Scope and Problems of Marketing Medical Insurance in Chennai Metropolitan
We see that India, world second biggest populated country which has reported as fast developing country with its liberalized industrial policy. There is an observation that more than three fourth of the public spend more towards their health care from their pockets. The Chennai metropolitan city with 4.7 million populations has its own health care issues. The objective of the current work is to recognize the reach of medical insurance concept among the buyers of the Chennai metropolitan, and the influencing variables of buyers’ purchase decision of medical insurance. The work showing the new sculpt of buyer purchase decision in medical insurance. They are: individual, organizational and societal, representing the buyer, seller and the business environment. Determining the Bench Size for Constitutional Adjudication
The Supreme Court of India acts as a Constitutional Court as well as the highest appellate court. The Constitution imposes mandatory minimum requirements for the strength of the Bench for constitutional adjudication. The apex Court has been criticized for constituting fewer number of Constitution benches, and for delaying the disposal of constitutional matters. Many Constitutional questions are being decided upon by Division benches or Constitutional benches, consisting of merely three members, due to prolific appeals in the Supreme Court. The researcher aims to analyze the question ‘whether the size of the Bench matters for constitutional adjudication?’ The article in the light of Constitutional provisions and the Supreme Court Rules, focuses on the impact of small and large benches, particularly in the highest Court of the land, where constitutional questions are decided upon. The Kesavananda Bharati case has been employed to examine the pros and cons of a large Bench, and the recent NJAC case is analyzed to bring out the problems of a smaller Bench, in overruling the decision of a larger Bench. Phonon Anomalies, Orbital-Ordering and Electronic Raman Scattering in iron-pnictide Ca(Fe0.97Co0.03)2As2: Temperature-dependent Raman Study
We report inelastic light scattering studies on Ca(Fe0.97Co0.03)2As2 in a
wide spectral range of 120-5200 cm-1 from 5K to 300K, covering the tetragonal
to orthorhombic structural transition as well as magnetic transition at Tsm ~
160K. The mode frequencies of two first-order Raman modes B1g and Eg, both
involving displacement of Fe atoms, show sharp increase below Tsm.
Concomitantly, the linewidths of all the first-order Raman modes show anomalous
broadening below Tsm, attributed to strong spin-phonon coupling. The high
frequency modes observed between 400-1200 cm-1 are attributed to the electronic
Raman scattering involving the crystal field levels of d-orbitals of Fe2+. The
splitting between xz and yz d-orbital levels is shown to be ~ 25 meV which
increases as temperature decreases below Tsm. A broad Raman band observed at ~
3200 cm-1 is assigned to two-magnon excitation of the itinerant Fe 3d
antiferromagnet.Comment: Accepted for Publication in JPC
Application of Value Stream Mapping for Reduction of Cycle Time in a Machining Process
AbstractLean manufacturing initiative is being followed by various organizations in the recent years which mainly focuses on improving the efficiency of operations by eliminating and reducing wastes. This paper aimed to explain the implementation of lean manufacturing techniques in the crankshaft manufacturing system at an automotive manufacturing plant located in south India.. A multi criteria decision making model, analytical hierarchy process is applied to analyze the decision making process in the manufacturing system. The objective of the case industry was to increase the export sales. Lean manufacturing system was selected to meet the company“s quality, cost and delivery targets. Crankshaft was manufactured in a single piece flow system with the low cost machines developed indigenously and the results are that the crankshafts have passed the testing, validation and approval by the customer to produce any variant in the company. After implementing lean manufacturing system, the manufacturing lead time reduced by forty percent, defects were reduced, higher process capability achieved, quick response to the customer demand in small lots were achieved
Raman Evidence for Superconducting Gap and Spin-Phonon Coupling in Superconductor Ca(Fe0.95Co0.05)2As2
Inelastic light scattering studies on single crystal of electron-doped
Ca(Fe0.95Co0.05)2As2 superconductor, covering the tetragonal to orthorhombic
structural transition as well as magnetic transition at TSM ~ 140 K and
superconducting transition temperature Tc ~ 23 K, reveal evidence for
superconductivity-induced phonon renormalization; in particular the phonon mode
near 260 cm-1 shows hardening below Tc, signaling its coupling with the
superconducting gap. All the three Raman active phonon modes show anomalous
temperature dependence between room temperature and Tc i.e phonon frequency
decreases with lowering temperature. Further, frequency of one of the modes
shows a sudden change in temperature dependence at TSM. Using first-principles
density functional theory-based calculations, we show that the low temperature
phase (Tc < T < TSM) exhibits short-ranged stripe anti-ferromagnetic ordering,
and estimate the spin-phonon couplings that are responsible for these phonon
anomalies
Calibration of VELC detectors on-board Aditya-L1 mission
Aditya-L1 is the first Indian space mission to explore the Sun and solar
atmosphere with seven multi-wavelength payloads, with Visible Emission Line
Coronagraph (VELC) being the prime payload. It is an internally occulted
coronagraph with four channels to image the Sun at 5000 \AA~ in the field of
view 1.05 - 3 \rsun, and to pursue spectroscopy at 5303 \AA, 7892 \AA~ and
10747 \AA~ channels in the FOV (1.05 - 1.5 \rsun). In addition,
spectropolarimetry is planned at 10747 \AA~ channel. Therefore, VELC has three
sCMOS detectors and one InGaAs detector. In this article, we aim to describe
the technical details and specifications of the detectors achieved by way of
thermo-vacuum calibration at the CREST campus of the Indian Institute of
Astrophysics, Bangalore, India. Furthermore, we report the estimated conversion
gain, full-well capacity, and readout noise at different temperatures. Based on
the numbers, it is thus concluded that it is essential to operate the sCMOS
detectors and InGaAs detectors at and C,
