Accords d'entreprise transnationaux en quête d'effectivité : étude juridique et prospective d'une norme collective du travail

    No full text
The dissertation focuses on Transnational Company agreements (TCAs), a type of text signed by the central management of multinational enterprises on the one side and representatives of their workers on the other, and regulating employment relations in these enterprises, worldwide. Our methodology is legal and prospective, it is inspired from S. Romano's pluralism, H. Hart's positivism and R. Unger's experimentalism. The dissertation develops a variety of legal tools and procedures to increase TCAs’ effectiveness that is, to allow them to better realize the promises enshrined in their clauses. These legal solutions are built from different legal disciplines: Belgian and US labor law, EU employment law, international private law, international arbitration law and CSR understood as a "normative discourse".(DROI - Sciences juridiques) -- UCL, 201
