The Relationship between Democracy and the Rule of Law ; The Relationship between Democracy and Constitutionalism: A Story of the Abolition in American History

The relationship between democracy and constitutionalism is a complicated and multi-dimensional question. This essay attempts to elucidate it from the viewpoint of the liberalism which admits fallibility and improvability. Democracy and constitutionalism are to be understood as constant procedure of improvement in the course of which the both of them are to influence each other. The author believes that liberalism is the positive interaction between democracy and constitutionalism for the political equality and human rights of the vulnerable and underprivileged. This essay finds a vivid example of such interaction in the American history of the Abolition. The original constitution drafted in 1787 failed to outlaw slavery which meant a gross defect of democracy and constitutionalism. Thereafter reforming movements continued through the Civil War to culminate in so-called Reconstruction Amendments. The history can be seen as the history of rectifying the flawed democracy and constitution The Southerners, however, had the opposite conceptions of democracy and constitutionalism. They insisted on the popular sovereignty and the constitutionality of slavery as property. They were supported even by the supreme courts holdings in Dred Scott v. Sandford. But this essay contends that they were so contrary to the liberal conception of democracy and constitutionalism that they were forced to be abrogated. Last but the least, this essay asserts the rectifying procedure should be defensive rather than aggressive. So to speak, the procedure should hold the maintenance of the basic constitutional order. It is well demonstrated at Lincolns stance on slavery..

Zusammenhang zwischen Eigentum und Menschenrecht.

이글은 현대 한국사회의 인권의 질서를 형성하는 데에 있어 인권과 재산권의 상호관계에 대한 정확한 인식이 중요하다는 전제 하에 인권과 재산권의 변증법적 관계를 규명하는 데에 초점을 맞추고 있다. 인권과 재산권의 관계에서 기본적으로 승인되어야 할 것은 칸트와 헤겔이 강조하듯이 근대 재산권의 정신은 바로 개인의 자유와 인격을 위한 것이라는 점이다. 즉 재산권은 그 바탕에서 인권적 본질을 가지고 있는 것이다. 그러나 주지하듯이 그 재산권이 제도화되면서 특히 자본주의 체제하에서는 인권의 실현이 아니라 오히려 다수의 인권의 제한과 축소로 연결되고 있다. 재산권의 불평등의 고착화에 따라 재산권의 정신인 자유와 인간의 존엄의 가치가 다수의 가난한 이들로부터 소외되고 있는 것이다. 특히 군부 정권이 종식되고 문민시대로 접어든 우리 나라에서, 인권의 질서를 확립하기 위하여 가장 절실한 과제는 바로 자본주의의 재산권의 횡포를 제어하는 일이라고 여겨진다. 물론 그렇게 재산권의 횡포를 제어하는 것은 재산권을 부정하는 것이 아니라 재산권의 원래의 정신인 자유와 인간의 존엄의 가치를 회복하는 것으로 그리고 재산권과 인권의 평화공존의 질서를 지향하는 것으로 이해되어야 할 것이다. 필자는 그러한 질서를 위하여 새삼 고전적 사회민주주의를 우리 현대 사회가 나아가야 할 대안으로 고려하여야 한다고 본다.Das Thema dieses Aufsatzes ist es, darzustellen den dialektischen Zusammenhang zwischen Eigentum und Menschenrecht. Eigentum βeruht auf Menschenrecht. Wie Hegel dargestellt hat, macht man im Eigentum semen Willen als Einzelner oβjektiv, und wird als Person wirklich. Als sich Kapitalismus entwickelt hat, sind die Verha¨ltnisse anders geworden. DaΒ wirtschaftliche Macht zu Lasten der Freiheit vieler Menschen gehen kann, kann heute fast schon als allgemein Einsicht βezeichnet werden. Eigentum βietet seinem Eigentiimer Freiheit von der Arβeit und die Verfu¨gungsgewalt u¨βer die Arβeit anderer. In der gegenwa¨rtigen Gesellschaft Koreas ist der U¨βermaΒ der Herrschaft des Eigentums die gro¨Βte eefahr βei der Durchhaltung der Menschenrechts-ordnung. Eigentum nuΒ mil Menschenrecht vereinβar sein. Der Βereich der Wirtschaft sollte gerecht geregelt werden und die Rigenturnsordung sollte auch als Freiheitsordnung in dem Sinne gestalt werden, daβ jedermanns Freiheit so weit vie mo¨glich gewahrt odor, falls verloren, wieder hergestellt wird. 비대면 학습상황에서 학업소진과 학습몰입의 관계 정서적지지와 메타인지전략의 매개효과

본 연구의 목적은 COVID-19로 인해 전면적으로 비대면 수업이 이루어지고 있는 상황에서 대학생의 학업소진과 정서적지지 및 메타인지전략과 학습몰입 간의 관계를 알아보고, 학업소진과 학습몰입 간의 관계에서 정서적지지와 메타인지전략의 매개효과를 검증하는 것이다. 이를 위해 선행연구를 토대로 학업소진, 정서적지지, 메타인지전략, 학 습몰입으로 이루어진 구조모형을 연구모형으로 설정하였고, 경기와 충청 지역 4년제 대학 3곳에 재학 중인 대학생 650명을 대상으로 2020년 12월부터 2021년 6월까지 설문조사를 실시하여 이 중 237명(회수율 36.5%)의 자료가 최 종적으로 분석되었다. 구조방정식모형 분석을 통해 자료를 분석한 결과 전반적으로 모형적합도 기준에 부합하였다. 연구 결과를 구체적으로 살펴보면, 첫째, 학업소진에서 학습몰입에 이르는 직접경로가 유의하였다 둘째, 학업소진과 학습몰입 간의 관계에서 정서적지지와 메타인지전략 모두에서 개별 매개효과가 나타났다. 셋째, 정서적지지와 메타인 지전략은 학업소진과 학습몰입 간의 관계에서 부분매개의 역할을 하고 있었으나, 학업소진에서 정서적지지, 메타인지 전략을 순차적으로 학습몰입에 이르는 매개효과는 통계적으로 유의하지 않았다. 이러한 결과와 제안된 개선점을 토대 로 후속연구에서 본 연구의 적용 가능성과 학업소진과 학습몰입과의 관계에 영향을 미치는 요인들에 대해서 다각적으 로 확인할 필요가 있다. 마지막으로 이 연구의 의의와 제한점에 대해 제시하였다
