학위논문 (박사)-- 서울대학교 대학원 공과대학 기계항공공학부, 2017. 8. 이우일.Carbon fiber reinforced plastic (CFRP) has been widely used for various industrial areas such as aerospace, automotive, civil engineering and leisure and sports goods industries because of its high strength-to-weight ratio, low density, good thermal properties and other great mechanical properties. However, in spite of these advantages, it is not suitable for some structures that have to endure much vibration due to its low damping capacity. Therefore, some researchers have been conducted about improving a damping capability of CFRP composites recently. In this research, the piezoelectric ceramic particles used as a functional particle which accelerates the loss of the vibration energy. Shape memory alloy (SMA) is commonly known as a kind of hyperelastic materials, which can improve the damping capacity of the CFRP. When the shape of the materials is changed, its phase and crystal structure are changed, therefore, the mechanical energy is converted into the thermal energy as a result. This study covers CFRP composites, which have a high damping capacity with lead zirconate titanate (PZT) ceramic particles and SMA powder dispersed between carbon fiber and epoxy matrix. The loss factor (tanδ) is measured using dynamic mechanical analyzer (DMA) to verify the structure change in vibration damping. Experimental results show that the vibration damping of CFRP containing PZT and SMA is higher than that of conventional materials. We also found that the dispersion of particles inside the CFRP is an important factor in improving vibration damping. In order to improve the dispersion of PZT and SMA particles in CFRP, we fabricated a thin resin film with dispersed particles. Because of applying this to CFRP, it is confirmed that the increase of dispersion degree positively affects vibration damping improvement. The 0-3 composites were modeled containing PZT and SMA particles and performed computational analysis on various parameters to verify the experimental results and optimize the parameters.Chapter 1. 학위논문(박사)--서울대학교 대학원 :법학전문대학원 법학과,2020. 2. 정인섭.그동안 영토분쟁재판에서 당사국들이 역사적 권원을 주장한 경우는 적지 않았으나 재판 결과 역사적 권원이 인정된 경우는 거의 없었다. 본 연구는 그 이유를 영토주권에 관련된 전통적 국제법 법리들과 국제재판소의 재판방식이 역사적 권원의 인정가능성을 근본적으로 제한하고 있기 때문이라는 점을 심층적으로 분석하고, 그럼에도 불구하고 그동안 이루어진 국제법 법리와 재판방식의 변화로 인하여 과거에 비하여서는 재판에서 역사적 권원이 인정될 가능성이 확대되었다는 점을 논증한다. 전통적인 국제법 법리들은 역사적 권원이 성립하는 데 여러 측면에서 장애가 되었다. 기존의 유럽 주권국가 중심의 국제법주체성 법리에 따르면 비유럽지역 부족은 영토권원을 보유할 자격부터 인정받기 어려웠다. 유럽 열강의 식민지화 과정에서 형성된 무주지 선점 법리는 식민지 대상 영토의 역사적 권원을 부정하는 역할을 하였다. 시제법은 국제법이 전파되기 이전의 시대와 지역에서 역사적 권원의 성립과 존속을 제한하였다. 신생독립국의 국경획정에 적용되는 현상유지원칙은 역사적 권원이 논의될 여지를 애초에 봉쇄한다. 식민지관계 종료 시 기존의 역사적 권원이 회복된다는 복구 이론도 인정되지 않고 있다. 국제재판소의 재판방식도 역사적 권원에 대체로 불리하게 작용하였다. 실효성을 강조해 온 영토분쟁판례의 입장은 충분한 실효성을 갖추지 못한 경우가 많은 역사적 권원이 상대적 권원 비교의 틀에서 우월한 권원으로 인정받기 어렵게 만들었다. 결정적 기일과 같이 비교적 최근에 발생한 사정을 중심으로 판단하는 재판방식은 역사적 권원이 판단받을 기회부터 봉쇄하였다. 판례가 역사적 사실을 입증하기 위한 증거의 증명력은 물론 어느 정도 입증된 역사적 사실도 오늘날의 영역관계에 직접 영향을 미치기에는 증명력이 부족한 것으로 평가함으로써 당사국 입장에서 역사적 권원을 입증하는 것이 매우 어려웠다. 그러나 그동안 이루어진 국제법 법리와 재판소의 판단방식의 일부 변화들이 재판에서 역사적 권원이 인정될 여지를 확대하여왔다. 탈식민지화를 배경으로 한 자결원칙과 서부사하라 권고적 의견 등은 원주민 부족이 역사적 권원을 보유할 수 있는 여지를 넓혔다. 망끼에르 에끄레오 판결은 중세에 성립된 역사적 권원에 대하여 미성숙권원으로서의 지위를 인정함으로써 향후 실효적 점유를 갖추어서 온전한 권원으로 인정받을 수 있는 여지를 남겼다. 부르키나파소-말리 판결 이후 상당수 판례들은 권원이 effectivités보다 우선시된다는 점을 명확히 하였다. 역사적 권원을 입증하는 데 있어서도 판례에 의해 조약, 지리적 상황, 외부의 인식, 권원의 응고과정 추론, 지역민들과의 관계 등 다양한 방식들이 제시되고 격오지에 대한 입증기준의 완화 법리도 적극 활용되어 당사국 입장에서 역사적 권원의 입증가능성도 높아졌다. 2008년 페드라브랑카 판결이 이례적으로 비유럽지역 고대국가의 역사적 권원을 인정한 것은 그동안의 이러한 변화들이 축적된 결과이다. 역사적 권원을 제한하는 전통적 국제법 법리들과 재판소의 판단방식 중 상당 부분이 여전히 적용되고 있는 만큼 오늘날에도 영토분쟁재판에서 역사적 권원의 역할이 획기적으로 확대되었다고는 할 수 없다. 그러나 상기 변화들로 인해 과거에 비해서는 역사적 권원이 인정될 가능성이 확대되었다고 할 것이다.Although there have been many territorial dispute cases in international courts in which State parties claimed historic titles, the courts have hardly acknowledged that any of the historic titles was established. This study analyzes the reason behind this phenomenon from two perspectives. First, under the traditional international laws involving subject of international law and inter-temporal law, historic titles are fundamentally hard to be established or remain effective over time. Second, the conventional standards that international courts employed in presiding over territorial disputes have not been favorable toward historic titles. For example, international courts have tended to focus on the issues around the critical date, depriving historic titles of the opportunity to be reviewed. Also in comparing relative strength of titles, international courts tended to set a high value on effectiveness, making historic titles which usually lack enough effectiveness ineligible for a so-called better title. However, as the international law and judging standards employed by international courts developed over such a long time, some of the changes expanded the likelihood that historic titles are to be acknowledged in the judgments. The changes were observed in legal principles concerning subject of international law, inter-temporal law, critical date, law of evidence and so forth. These changes also facilitated the ICJ judgment concerning Sovereignty over Pedra Branca to acknowledge unprecedentedly that the original title of an Asian ancient kingdom was established.
