A Legislative Study on the Introduction Certificate System on Dangerous Cargo Handling Facilities

The Social concern of the Safety has been reached a zenith these days of Korea through the past few decades. After Korean Independence, Development is more important and efficient than safety in Korean peninsula because of nothing to take place to eat for living. As a result of ignored safety, Industry is always chased more efficient than safety. Recently, Hot issued safety accidents in our society are as follows Firstly, the Lunar New Year morning in 2014 a Singapore-registered Oil Tanker WUISAN, VLCC(Very Large Crude Oil Carrier), collided with GS-Caltex Crude Oil Dolphin and pipelines caused spillage at a quay off Yusu, happened almost 20 years after some 5,000 tons of oil washed onto the same coast in 1995. Secondly, domestic passager boat "Sewol", the sinking of the Sewol ferry has also brought into focus the safety problems of coastal liners. In case of Ulsan port, a small amount of oil leaked off the coast of Ulsan from a cracked floating hose run by Korea’s major refiner, SK Energy in 2013. In oil handling facilities, there are many potential problems such as lacking and ambiguity of safety regulations, unconcerned and ignorance of dangerous cargo handling tanker and facilities - Dolphin, SPM, Tandem mooring etc. This Study aims for enhancing safety system on dangerous cargo handling facilities and makes a legislative Certificate System through investigation of maritime accidents on collision dangerous berths, questionnaire for workers and investigation regarding Self-Safety Management System on dangerous cargo handling and operating companys which transport dangerous cargo through tanker, the study of Safety Guidelines and Good Industry Practices for Oil Terminal in E.U, Marine Terminal Information System in OCIMF, CDI-T Today, Self-Safety Operation Management System in company is not core value of Dangerous cargo handling berths because of Lacks of willings of owners managing it safely in Dangerous cargo operation industry, safety monitoring processing system operating by Authorities. We need to be addressed promptly to avoid potential maritime disasters in the future through the Certificate System in Dangerous cargo handling facilities as similar with PSM(Process Safety Management) in Industry Fields and change of the Marine Safety Regulation. - 散積液體危險物 荷役을 中心으로-

우리나라는 6.25전쟁 이후 황폐한 대한민국의 재건을 위해 경제개발정책을 정부 최우선 과제로 추진하여 급속한 경제성장을 이룩하였다. 그렇지만 경제성장의 역기능 중의 하나로 '안전 불감증'을 야기하며 안전이 경제성장의 장애물로 인식되기 시작하였다. 1988년 서울올림픽 이후 더욱 경제성장에 매진하면서 사회 각 분야에서는 정부규제 완화를 지속적으로 요구하였고, 이에 따라 1993년 7월 1일「기업 활동 규제 완화에 관한 특별조치법」과 1998년 3월 1일 「행정규제기본법」이 제정 및 시행되었다. 그리고 위험물 관련 업계의 자율성 확보와 불필요한 정부규제 개선을 위한 취지에서 무역항의 수상 구역 등에서의 위험물 하역에 대한 안전관리제도인 「선박의 입항 및 출항 등에 관한 법률」의 '자체안전관리계획'이 1999년 2월 8일 시행되었다. 이러한 우리나라 정부규제 완화 정책에 따라 산적액체위험물 하역 시설인 전문부두와 공용부두에서 발생한 주요 해양사고는 '유조선 우이산호 부두시설 접촉사건'과 '화학물질 운반선 스톨트 그로앤랜드호 폭발사고'라고 할 수 있다. 2014년 1월 31일 여수에서 발생한 우이산호 사고는 도선사의 부적절한 조선이 주요 원인이지만 하역 시설물의 운영자가 평소 안전관리에 대한 소홀도 일부 원인이었다. 그리고 2019년 9월 28일 울산항 공용부두에서 발생한 스톨트 그로앤랜드호 사고는 우리나라 공용부두의 이중 접안(Double Banking)에 대한 법적 규정의 부재 및 안전관리에 대한 불감증을 확인할 수 있다. 또한 우리나라 안전관리 패러다임에 근본적인 영향을 준 2014년 4월 16일에 발생한 '내항 여객선 세월호 전복사고'의 사고 원인으로 많은 학자는 잘못된 '선령 규제 완화', 이익집단과 관련 공무원의 결탁으로 인해 '형식적인 검사·감독' 및 '운임규제' 등 정부 규제의 실패라고 한다. 다른 표현으로는 대한민국 국민의식에 차지하고 있는 배려심, 책임감 및 정직성 결여로 인한 '사회적 시스템의 파괴'라고도 한다. 이와 관련하여 정부 규제적 측면에서의 세계적 동향은 기업의 영리활동과 관련된 경제적 규제에 대한 완화와 사회적 규제인 환경, 안전 및 보건에 대한 강화 추세이다. 환경·안전·보건에 대한 국가적인 관심은 통상적으로 국민소득에 따라 달라진다고 한다. 2019년 1인당 국민소득이 약 31,250불임을 감안하면 우리나라는 선진국의 초입에 들어섰다고 할 수 있다. 이제는 국민의 환경, 안전 및 보건의 정책은 우리나라 정부의 중요한 과제이다. 특히 '내항 여객선 세월호 전복사고' 이후 사회 전반의 안전에 대한 국민의 갈망은 지속해서 증가하고 있다. 이러한 측면에서 대형해양오염사고를 유발시킬 수 있는 산적액체위험물의 하역과 관련하여 현황 및 문제점을 파악하고 개선방안을 도출하고자 다양한 관점에서, 특히 안전 규제적 측면에서 검토하였다. 근래의 사회적 규제 강화의 관점에서 국내 산업안전관련 법령, 선진국의 입법례, 국제기구 및 국제 산업안전 자율규제의 기초연구를 통해 우리나라 산적액체위험물 하역 관련법인「선박입출항법」의 안전관리 문제점을 파악하고자 하였다. 문제점에 대한 개선방안을 도출하고자 이와 유사한 「산업안전보건법」의 '공정안전보고서', 「화학물질관리법」의 '위해관리계획서', 「위험물안전관리법」의 '예방규정' 및 「고압가스 안전관리법」의 '안전성향상계획'에 대해 검토하였으며, 그 결과로 '위험평가', '위험물 안전관리자' 등에 대한 관련 법률의 연계강화의 중요성을 확인하였다. 그리고 산적액체위험물 하역 운영 및 하역 시설의 안전관리에 대해 국제적 동향 및 수준에 맞추고자 유엔유럽경제위원회의 '터미널의 안전 및 실천 지침', 국제해사기구의 각종 규정, 미국, 일본, 호주의 관련 규정 및 국제 산업안전 자율규제인 '유조선 및 터미널에 관한 국제안전지침', '석유, 케미컬, 액화가스의 선박대선박 이송 지침(2013)', 국제 산업안전 민간기구의 산적액체위험물 하역 관련 자율인증규제 등을 검토하여 개선방안을 도출하고자 하였다. 결론적으로 이 논문은 산적액체위험물 하역 관련 안전관리의 개선방안으로 위험물 안전관리를 포장위험물과 산적액체위험물로 이원화하고, 포장위험물과 급유선에 대한 안전관리 규정은 현행 「선박입출항법」상의 '자체안전관리계획'으로 존치하고 산적액체위험물 하역 안전관리를 위해 해상공정안전관리제도의 도입을 제안한다. 해상공정안전관리제도는 산적액체위험물 하역 시설의 계획, 설계, 운영 및 해양오염방지와 관련된 법률인 「항만법」, 「선박입출항법」, 「해양환경관리법」, 「항만운송사업법」의 상호연계를 통한 산적액체위험물 하역 안전을 근본적으로 확보하고자 하는 제도이다. 아울러 이 제도는 「산업안전보건법」의 '공정안전보고서'를 비롯한 산업안전규제, 유엔유럽경제위원회의 '터미널의 안전 및 실천 지침'과 미국, 호주의 관련 법령 및 국제 산업안전 자율규제의 내용을 반영한 산적액체위험물 하역 관련 종합안전관리제도라고 할 수 있다. 그리고 효율적인 해상공정안전관리제도의 운영을 위해서 「선박입출항법」을 비롯한 각종 산적액체위험물 하역 시설과 관련된 법령 등의 개정안과 하역 관련 규정의 연계를 강화하는 방안에 대해 검토하여 개정안을 제시하였다. 이를 통해 산적액체위험물 하역 시설에서 발생하는 각종 안전사고의 예방을 위해, 특히 울산항에서 발생한 스톨트 그로앤랜드호 폭발사고와 유사한 사고의 예방대책으로 일환으로 활용할 수 있을 것이다. 그러나 산적액체위험물 하역 관련 안전관리의 강화를 위해서는 법과 제도만으로는 그 목표를 달성하는데 한계가 있다. 근본적으로는 오랜 시간이 소요되더라도 국민의 안전의식 고취와 생활화, 안전 문화의 확산 및 지속, 기업가 정신 함양과 정부의 효율적인 규제정책 관리가 수반되어야 할 것이다.The Republic of Korea has achieved the most dramatic economic development, with the government prioritizing policies for economic development to rebuild the barren country after the Korean War. However, the rapid economic growth entailed insensitivity to safety as one of the side effects, for recognizing safety regulations as an obstacle to economic growth. Since the 1988 Olympics in Seoul, all works of business around the country have called for alleviation of regulatory standards in light of faster economic growth. Accordingly the 「Act on Special Measure for Deregulation of Corporate Activities」 in July 1, 1993 and 「Framework Act on Administrative Regulations」 in March 1, 1998 were enacted to support government's deregulation efforts. In order to secure the autonomy of the dangerous goods industry and improve unnecessary government regulations, the Safety Management Plan of 「Act on the Arrival, Departure, ETC. of Ships」, which is a safety management system for loading and unloading dangerous goods in the water zone, etc. of trade port was established in February 8, 1999. Along with the Korean government's trends of deregulation policy, the major marine accidents at Specialty pier and Public pier, which are loading and unloading facilities for liquid dangerous substances in bulk, are the 'Tanker Wu Yi San touching pier facilities Accident' in 2014 and 'Chemical Carrier Stolt Groenland Explosion Accident' in 2019. The 'Tanker Wu Yi San touching pier facilities Accident' that occurred at specialty pier in Yeosu on January 31, 2014 was mainly caused by inappropriate piloting towards the pier but the operator's usual negligence in safety management was also part of the cause. In addition, 'Chemical Carrier Stolt Groenland Explosion Accident' that occurred at the public pier of Ulsan Port on September 28, 2019 can be confirmed the absence of legal regulations for double banking and the lack of safety management system. Many researchers reported that the reasons for 'Domestic Ferry Sewol Accident' on April 16, 2014 were faulty deregulation in ship's age standards, cronyism between interest groups, bureaucracy that led to ineffective inspection and supervision and state-controlled fares. In other words, it would seem to be the collapse of the social system, based on multi-faceted selfishness which our lifestyle bears, and lack of responsibility and honesty. In this regard, the global trend in terms of government regulation is the relaxation of economic regulations related to commercial activities of companies and the strengthening of social regulations such as environment, safety and health. It is said that national interest in the environment, safety and health usually depends on national income. Considering that the per capita national income in 2019 is about 31,250 USD, it can be said that Korea has just joined the ranks of advanced nations. From now on, the policy of the environment, safety and health of the people is an important task of the Korean government. In particular, the public's desire for safety in society has continued to increase since 「Domestic Ferry Sewol Accident」. In this respect, in order to grasp the current status and problems related to the loading and unloading of liquid dangerous substances in bulk that can cause large marine pollution accidents, and to draw improvement measures, it was reviewed from various viewpoints, especially in terms of safety regulations. From the perspective of strengthening social regulations in recent years, through the basic research on domestic industrial safety laws, developed countries' legislations, international organization's recommendation, and international industrial safety autonomous guidelines, it is intended to grasp the safety management problems of the loading and unloading of liquid dangerous substances in bulk related laws such as 「Act on the Arrival, Departure, ETC. of Ships」. In order to derive improvement measures for the identified problems, a similar sort of the Process Safety Report of the 「Occupational Safety and Health Act」, the Risk Management Plan of the 「Toxic Chemical Control Act」, the Preventive Regulations of the 「Dangerous Goods Safety Management Act」 and the Safety improvement Plan of the 「High Pressure Gas Safety Management Act」 was reviewed. As a result, the importance of strengthening the linkage of related laws for Risk Assessment and Safety Manager for liquid dangerous substances in bulk was confirmed. In addition, to meet international trends and standards for the loading and unloading operation regarding liquid dangerous substances in bulk and safety management of facilities, I reviewed the 'Terminal Safety and Practice Guidelines' in United Nations European Economic Committee, American/Japanese/Australian rule, various regulations of the International Maritime Organization and international industrial safety autonomous such as including International Safety Guidelines on Oil Tankers and Terminals, Ship-to-Ship Transport Guidelines for Oil, Chemical and Liquid Gas(2013) and drew improvement measures for the safety management system of the loading and unloading of liquid dangerous substances in bulk. Therefore, in the study of this paper, as a plan to improve the safety problem of loading or unloading liquid dangerous substances in bulk the safety management of dangerous goods I suggest to dualize into packaging dangerous goods and liquid dangerous substances in bulk and to make the safety management regulations for packaged dangerous goods and bunkering tanker remain as the Safety Management Plan under the current 「Act on the Arrival, Departure, ETC. of Ships」 and to institute the Maritime Process Safety Management System for the safety management of the loading and unloading liquid dangerous substances in bulk. The Maritime Process Safety Management System is fundamentally securing the safety of loading and unloading liquid dangerous substances in bulk through linkage between related laws on the planning, design and operation of dangerous liquid substances handling facilities such as 「Harbor Act」, 「Act on the Arrival, Departure, Etc. of Ships」, 「Harbor Transport Business Act」, 「Marine Environment Management Act」. In addition, the system includes industrial safety regulations, such as 'Process Safety Report' in 「Occupational Safety and Health Act」, 'Terminal Safety and Practice Guidelines', in United Nations European Economic Committee, and related laws in the United States, Australia and international industry safety guidelines. It can be said to be a comprehensive safety management system related to loading and unloading of liquid dangerous substances in bulk. For operating an efficient Maritime Process Safety Management System, I reviewed and proposed ways to strengthen the linkages between the amendments to laws and regulations related to the loading and unloading facilities used for liquid dangerous substances in bulk. Through this, it can be used as a preventive measure against accidents similar to the 'Stolt Groenland Explosion Accident' in Ulsan Port, in order to prevent various safety accidents occurring in the loading and unloading operation in Public pier. However, in order to strengthen safety management related to the loading and unloading liquid dangerous substances in bulk, there is a limit to achieving the goal with the law and the system alone.
