This paper made a critical analysis of the sexuality discourses, focusing on the patriarchal attitude to the sexuality in trials during the late Chosun dynasty, with special references to the sexuality-related crimes in Shimnirok (Royal trial records, ๅฏฉ็†้Œ„). Royal trial records, a collection of law cases, included 1,112 serious criminal offenses, occurred in the period of King Jung-Jo (1776-1800), among them, 148 cases were directly or indirectly related to the sexuality. In this paper, the cases were classified as adultery, rape, sexual slander, according to the degree of subjectivitiy of the female agent. And the patriarchal attitudes to the women who enjoyed sexuality were explored in relation with the psychological aspects and institutional apparatus. The patriarchal dynasty supported the women who amount to death in the course of resistance against sexual violences, by institutional apparatus such as Cheongryo (ๆ—Œ้–ญ) and Bokho (๏ฅฆๆˆถ), because the resistances against sexual offence, suicide or murder, coincide with the ideology of dynasty which put a stress on chastity. In conclusion, this paper revealed that the sexuality of women in late Chosun dynasty period was not only managed but also used by interests of patriarchal state and family

    Through the Chosun Dynasty the Confucian understanding of women continued, and yet each period showed its own particularity within the limits of the universality of Confucianism. This paper aims to explore the cultural-political meaning of understanding of women in the middle period of Chosun Dynasty, focusing on the conception of chastity. I revealed that the two factors played the major role of reconstructing the conception of chastity. The one is Confucian stress on the integrity and fidelity in the middle period of the Chosun Dynasty, The other is the occurrence of Korean-Japanese war(Imjin waeran) and Korean-Chinese war(Byeongja horan)

This paper attempted to reexamine the rumor of a womans adultery, which raised a disturbance in academic and political sectors in the 16th century Chosun Dynasty period. The woman, whose family name is Lee and whose family clan is Haman, and is directly concerned with the rumor, became the second wife of Ha Jong-Ak, a rich, upperclass man in Jinju(ๆ™‰ๅทž) county in Kyung-sang province. She became a widow at the age of 28. The rumor that she had engaged in an obscene act with her slave developed into a great controversy between those who advocated for her and those who opposed her. Cho Sik(ๆ›บๆค, 1501-1570), a great scholar, was a representative of the group that opposed her. Many political leaders of the central government, including prominent figures of Kyung-sang province, also took part in the controversy. This great dispute reminds of a drama in which all of the major figures of the Chosun Dynasty appeared. A trivial rumor about a woman increasingly expanded into public opinion, and finally developed into an affair, which had various political implications. This paper explored the meaning of this rumor and affair by concentrating on the social context of the latter part of the 16th century
