Tradition and Modernity in Sexuality Discourses in The Open-Door Period in Korea

性 담론을 통해 본 개항기는 개인에 주목하라는 새로운 지식과 三綱五常의 인륜적 질서를 강조하는 기존 이념이 복잡하게 얽혀있어 분명한 방향성이 보이지 않는다. 한편에서는 중세적 여성인식이 지속되면서 더욱 보수화하고, 다른 편에서는 사회적 변동과 맞물려 근대적 여성관에 접근해 가는 이중적인 양상을 띤다. 이러한 개항기의 性 담론은 상반된 가치를 가진 改嫁와 烈女를 통할 때 그 전모를 파악할 수 있다. 여기서 개가와 열녀는 각각 근대성과 전통성을 표상한다. 개항기의 改嫁 논의는 禁制의 역사 4세기를 청산하면서 부녀 개가를 법적인 차원 뿐 아니라 의식과 습속으로 정착해야 한다는 내용을 담고 있다. 개가 금지의 제도와 이념에는 烈女不更二夫에 표현된 바, 여성 섹슈얼리티에 대한 가부장적 소유욕이 반영되었다. 개항기 언론 매체를 통해 전개된 개가 허용론은 이전 시대와는 달리 喪配한 여성의 심리적 외로움과 性的 소외에 주목했다는 점에서 의미가 있다. 개항기의 烈女 담론은 조선후기의 연장선상에서 지속적인 열녀 및 열부 발굴이 이루어진 것에 주목했다. 성(sexuality)의 문제를 놓고 볼 때, 이 시기 열녀는 정절을 극단적으로 체화한 從死型과 性을 탈각한 완벽한 여성들로 유형화된다. 특히 烈女 또는 烈婦의 이름으로 傳記化된 완벽한 여성이란 윤리의 수호자, 집안을 일으키고 지킨 자, 국가를 위해 忠을 행한 주체, 남편을 보호하는 아내 등으로 구체화되었다. 남편이 죽은 후 수절하거나 따라죽는 등의 烈行은 일차적으로 여성 性에 관한 문제이다. 그런데 개항기에는 유독 性的 이미지와 무관하거나 無性의 존재를 열녀로 호명하고 있다는 사실이다. 이에 性의 과잉이든 性의 탈각이든 개항기 열녀 담론은 여성 섹슈얼리티 문제를 내포한 것으로 보았다

The Discourses on Sexuality in the Period of King Jung-Jo in the Mirror of the Sex-Related Crime Cases: With Special Reference to Shimnirok

이글은 『심리록』의 성관련 범죄 사건을 중심으로 조선후기 성에 대한 인식과 담론을 비판적으로 분석한 것이다. 『심리록』은 정조대(1776~1800)에 발생한 重犯罪 사건 1112건에 대한 판례집이다. 이 중 성과 직․간접적인 관련이 있는 사건은 148건인데, 여기에 나타난 여성 성에 대한 가부장적인 인식과 태도에 주목하였다. 여성의 행위성을 기준으로 삼을 때, 『심리록』의 성 관련 범죄는 간통․강간(미수)․성적 음해 등으로 나뉘어진다. 다시 말해 성의 향유 또는 외부 폭력의 형태에 속하는 것들이다. 성의 향유 혹은 음행으로 이해되는 간통, 이 범주에 연루된 여성을 심리하는 가부장의 분노는 심리적 이유와 제도적 장치를 통해 합리화되었다. 그리고 성 관련의 외부폭력에 저항하다 죽음에 이른 여성들에 대해 가부장 국가는 旌閭와 復戶로 응답했는데, 그녀들의 선택은 정절을 권장하는 국가의 이념에 부합하기 때문이었다. 한편 강상윤리와 성 관련 사건이 갈등하는 상황에서는 강상윤리가 우선되었다. 예컨대 자신의 성적 태도를 둘러싼 왜곡이나 음해에 대해 적극적인 조치를 취한 여성의 경우, 대체로 그 기개가 높이 평가되었지만 그것이 남편을 불리한 상황에 놓이게 한 경우는 오히려 처벌되었던 것이다. 『심리록』을 통해 본 여성의 성은 가부장 국가 및 가족에 의해 관리되면서 그들의 利害에 따라 활용되었음을 논증하였다. This paper made a critical analysis of the sexuality discourses, focusing on the patriarchal attitude to the sexuality in trials during the late Chosun dynasty, with special references to the sexuality-related crimes in Shimnirok (Royal trial records, 審理錄). Royal trial records, a collection of law cases, included 1,112 serious criminal offenses, occurred in the period of King Jung-Jo (1776-1800), among them, 148 cases were directly or indirectly related to the sexuality. In this paper, the cases were classified as adultery, rape, sexual slander, according to the degree of subjectivitiy of the female agent. And the patriarchal attitudes to the women who enjoyed sexuality were explored in relation with the psychological aspects and institutional apparatus. The patriarchal dynasty supported the women who amount to death in the course of resistance against sexual violences, by institutional apparatus such as Cheongryo (旌閭) and Bokho (復戶), because the resistances against sexual offence, suicide or murder, coincide with the ideology of dynasty which put a stress on chastity. In conclusion, this paper revealed that the sexuality of women in late Chosun dynasty period was not only managed but also used by interests of patriarchal state and family

조선중기 사회의 여성인식

Through the Chosun Dynasty the Confucian understanding of women continued, and yet each period showed its own particularity within the limits of the universality of Confucianism. This paper aims to explore the cultural-political meaning of understanding of women in the middle period of Chosun Dynasty, focusing on the conception of chastity. I revealed that the two factors played the major role of reconstructing the conception of chastity. The one is Confucian stress on the integrity and fidelity in the middle period of the Chosun Dynasty, The other is the occurrence of Korean-Japanese war(Imjin waeran) and Korean-Chinese war(Byeongja horan)

Rumor and Power: An Intimate Approach to Rumor of Adultery by an Upper-class Woman during the 16th Century Chosun Dynasty Period

이 글은 16세기 중ㆍ후반의 조선에서, 학계와 정계에 풍파를 일으킨 한 사족 부인의 음행 소문을 재조명한 것이다. 소문의 주인공 함안 이씨는 상당한 재력을 가진 晋州의 진사 하종악의 후처로 들어와 28세의 나이에 과부가 되었다. 家奴와 음행을 저지른다는 그녀에 대한 소문은 곧 獄事로 전개되었다. 이에 이씨 배후의 권력과 南冥 曺植(1501∼1570)의 권력이 충돌하면서 陰謀說과 庇護說이 제기된 가운데 논쟁으로 격화되었다. 여기에 경상 지역의 명사들은 물론 중앙 정계의 인사들이 대거 참여하게 되는데, 이 논쟁은 조선의 주연급 인사들이 총출연한 한편의 드라마를 연상케 한다. 한 여성에 관한 사소한 소문이 공론화되고 지역적으로 확대되면서 다양한 권력 관계를 함축하는 사건이 된 것이다. 함안 이씨의 사건은 남명의 편지글과 정인홍의 글 그리고 진주 옥사에 대한 조정의 회의 기록, 퇴계의 편지글 등을 통해 그 대강을 파악할 수 있다. 소문에서 촉발된 이 사건은 그 자체로 존재하기보다 각자의 방식대로 재구성되고, 인용의 인용을 통해 끊임없이 생성되었다. 소문의 구성은 여성의 性(sexuality)이 소재가 되지만, 혈연과 학연에 따라 입장과 주장이 서로 대립되었다. 이씨의 소문에 대해 남명으로 대표되는 하종악 전처 측근과 李楨(1512∼1571)으로 대표되는 하종악 후처 측근이 서로 달랐고, 남명 문인과 퇴계 문인이 서로 달랐다. 소문 사건 이후에는 소문 그 자체의 문제보다 소문이 사건화되면서 발생한 문제들에 대한 상반된 기억과 주장들이 제기되었는데, 남명과 이정의 손자들의 조부 옹호론과 노론계열 인사들의 남명론이 있다. 소문을 보는 관점과 내용의 차이는 시간이 흐를수록 첨가되고 각색되는 양상을 보인다. 소문은 사회의 도덕적 기준과 이데올로기를 생산하고 유통시키는 매개역할을 하는데, 특히 여성에 관한 소문은 성별화된 위계질서를 지지하는 지식과 권력의 긴밀한 공조 속에서 이루어진다. 그런 점에서 함안 이씨의 소문 사건은 여성의 性에 대한 유교의 정치학과 사림 정치가 열리는 16세기 후반의 사회적 특성을 통해 의미화될 수 있을 것이다. This paper attempted to reexamine the rumor of a womans adultery, which raised a disturbance in academic and political sectors in the 16th century Chosun Dynasty period. The woman, whose family name is Lee and whose family clan is Haman, and is directly concerned with the rumor, became the second wife of Ha Jong-Ak, a rich, upperclass man in Jinju(晉州) county in Kyung-sang province. She became a widow at the age of 28. The rumor that she had engaged in an obscene act with her slave developed into a great controversy between those who advocated for her and those who opposed her. Cho Sik(曺植, 1501-1570), a great scholar, was a representative of the group that opposed her. Many political leaders of the central government, including prominent figures of Kyung-sang province, also took part in the controversy. This great dispute reminds of a drama in which all of the major figures of the Chosun Dynasty appeared. A trivial rumor about a woman increasingly expanded into public opinion, and finally developed into an affair, which had various political implications. This paper explored the meaning of this rumor and affair by concentrating on the social context of the latter part of the 16th century
