King Yeong-jos Crisis Overcoming Leadership: Focused on the Lee In-jwa's Rebellion in 1728

이인좌의 난은 1728년 3원 15일부터 3월 28일까지 약 보름간 진행된 전국적인 발란으로, 출범할지 얼마 안되는 영조 정권에게 큰 타격이자 도전이어다. 이인좌, 박필현, 정희량 등 비(非)노론계 세력들이 중심이 되어 일으킨 이 반란은 연이은 기근으로 인해 흉흉해진 민심과 경종독살설을 등에 업고 충청도와 경기도, 경상도와 전라도 이래를 장악해 갔다. 하지만 오명향 등 관군 지휘부의 주도면밀한 대응과 영조 정권의 적극적인 소통 및 정보통제로 애초 목표였던 지역별 연대를 통한 반정(反正)까지 나가지 못하고 괴멸되었다. 이 논문은 그 동안의 연구를 기반으로 하되, 기존 연구와 달리 주로 국왕 영조의 관점에서 반란이라는 중대한 위기를 극복해 가는 리더십에 초점을 맞추었다. 그 결과 다음과 같은 결론에 이르게 되었다. 첫째, 영조는 반란 발발 소식을 듣고 초기에는 반군의 주동자와 규모를 파악하지 못했지만 오광운, 오명응과 같은 비(非)노론 신하들의 조언을 받아들여 적극적으로 대응을 해 나갔다. 특히 반란군과 같은 당파(소론)이며 친분관계에 있었던 오명항 등을 중용하는 모험을 했는데, 오명항·박문수 등은 그에 보답이라도 하듯 반군을 진압하는데 결정적인 역할을 했다. 둘째, 영조는 반란이 진행되는 동안 여러 차례 난의 발생 원인이 조정의 잘못, 즉 붕당의 폐단에 있음을 언급하면서, 난 진압 후 초당파적 인재를 등용하는 탕평책과, 온 나라가 한 동포와 같이 화합하고 협력하는 새로운 정치를 이끌어가겠다는 정치비전을 제시했다. 바로 그러한 영조의 인재경영과 비전 제시가 이인좌의 난이라는 중차대한 위기를 성공적으로 극복하게 했다. Lee In-Jwa's Rebellion was one of the most dangerous crises in King Yeong-Jo's regime. The Rebellion was raised by prestigious families such as Lee In-jwa (Yoon Hue's grandson-in-law), Jeong Hee-ryang (Jeong-on's descendant), and Jeong Se-yoon (Jeong In-ji's descendant). They broke out rebellion in the middle and southern area Korea: ChungChong-do, Kyungsang-do, and Jeolla-do simultaneously. How King Yeong-jo had overcome it? First, he had an adventure which he placed full confidence in his subjects like Oh Kwang-wun[NamIn], Oh Myung-hang[SoRon], and Park Mun-su[SoRon] who could had been his political rivals. Second, he diagnosed in early stage cause of rebellion as the severe political cleavage. He, thus, suggested Grand Harmony policy [Tang Pyong Policy] as a new solution. He promised that he would appoint personnel to positions according to their ability, not the political background. He had tried to inform his new political vision to his people through translating into Korean Alphabet version in every corner of the land. A Study on the Confucian State projects of the Kyǒngguk Taeǒn

본 논문은 경국대전에 반영된 조선 전기의 정치이념과, 경국대전의 예치 국가적 성격이 이후 조선의 정치 및 사회에 미친 영향을 구명(究明)하는데 목적이 있다. 이를 위해서 먼저 경국대전의 편찬자들의 정치적 동기와 주례(周禮)적 세계관을 고찰한 다음, 예전(禮典)에 대한 집중적 분석을 텅해 조선왕조의 외유내법(外儒內法)적인 성격을 규명하였다. 이 과정에서 경국대전은 태종·세조 등의 국왕중심론 과 정도전·세종 등의 재상중심론 의 타협의 산물이라는 점, 국왕의 지위와 권한에 대한 법률적 침묵이 뜻하는 왕의 법, 그러나 신료에 의한 국정운영이라는 상징적 의미, 그리고 국왕의 친족과 공신에 대해서 후히 존대하되 정치에 개입하지 않는다(尊位重祿 不 任以事)의 원칙이 갖는 경험적 지혜 등을 밝혀냈다. 다른 한편 경국대전 체제가 형성된 이후 조선은, 조선전기의 經世家들의 의도와 달리, 점차 예(禮)보다는 치(治)률 중시하는 체제로 변질되는 측면도 있었음을 지적하였다. 경국대전(1460~1485)은 우리에게 익숙한 용어이면서도 사실은 낯선 대상이다

A Study of the King Young-jos Notion on the Law and People: Focused on the Judicial Precedents

영조시대의 법과 재판에 대한 종래의 연구는 「속대전(續大典)」 이라는 법전 편찬과정이나, 역모나 괘서 사건과 같은 정치재판에 대한 것에 머물러 이싿. 일반 백성들의 생활상이 나타나 있는 생활범죄에 대한 왕의 판결에 대한 연구가 없다. 이 논문은 이러한 연구의 공백을 보완하는 한편, 국왕 영조의 백성관을 드러내는 데 목적을 두고 「영조실록」의 사죄(死罪)판결. 즉 사형에 해당하는 범죄에 대한 왕의 판결을 분석했다. 그 결과 첫째, 영조는 국가나 가정의 질서에 도전하는 강상범죄에 대해서는 엄형(嚴刑)을 내렸고, 둘째, 굶주림 등 민생의 어려우믕로 죄를 저지른 자에 대해서는 관형(寬刑) 판결을 내렸다. 셋째, 영조는 법을 기계적으로 적용하기보다는 사회기풍을 진작하는 방향으로 판결내렸고, 넷째, 고문제도를 폐지하는 등 사법제도를 개선했는데, 이는 하늘로부터 백성 보호를 위탁 받은 백성 부모로서의 책무를 다해야 한다는 보민(保民)의식에서 비롯되었음을 밝혀냈다. 영조는 무엇보다 범죄사건이 일어나면 자기부터 반성하는 자세를 가졌으며, 백성이 어리석어 보이나 실로 신명한 존재라는 경외하는 백성관을 가지고 재판과 국사에 임했다. 그의 시대는 국왕의 정당성을 부정하는 역모와 괘서사건이 발발하고, 기근과 전염병으로 기민이 속출하는 위기의 연속이었다. 하지만 많은 백성들이 청계천 준천과 균역법 등 국가시책에 참여한 것은 그럼 흠휼(欽恤)정신에 공감했기 때문이라는 게 본 논문의 요지다. King Young-jo, the 21st king of Chosun Dynasty, adjudicated upon the 130 cases of murder during his reign (1724-1776). The characteristics of judicial verdicts are as follow: first, he, on the one hand, sentenced to severe punishment on the prisoners who had transgressed moral laws and committed the treacherous behavior. A Study of Yi Seong Gyes Leadership Moment during the Wehwado-hoegun in 1388

이성계의 위화도회군(1388년)은 상반된 평가를 받는 역사적 사건이다. 그를 비판하는 사람들은 동아시아 힘의 공백기에 잃어버린 고구려의 고토를 되찾을 수 있는 절호의 기회였다고 말한다. 반대로 위화도회군이 불가피했다고 보는 사람들은, 고려군이 압록강 을 건너 요동지역으로 진군했더라면 강대국 명나라와의 대규모 전쟁은 불가피했으며, 만일 패전했을 경우 한반도에 제2의 한사군 설치와 같은 치욕적인 일이 발생했을 거라고 말한다. 위화도에서 회군하지 않았더라면 한반도의 왕조가 패망하고 말았을지, 아니면 동아시아의 강성대국, 즉 제2의 고구려가 성립되었을지는 알 수 없다. 이 글이 주목하는 것은 그보다는 지도자의 결단과 실천이다. 이성계의 언행과 상황전개를 리더십모멘트(leadership moment)라는 관점에서, 즉 위화도회군을 감행할 때의 전환의 리더십과, 회군 이후의 돌파의 리더십의 시각으로 고찰하였다. 아울러 이성계와 그리고 그 뒤의 세종이 『태조실록』 『용비어천가』 등이 위화도회군 과정을 자세히 기록한 것의 역사적 의미도 살펴보았다. The Purpose of this article is to explore Yi Seong Gyes leadership in the Wehwadohoegun (troop withdrawal), 1388. The dissenter who opposed Yi Seong Gyes troop withdrawal said Yi missed the chance that Koryo could recapture Goguryos old territory. Yi, however, was the judge of that if troops advanced on Ming dynastys territory across the Yalu river, Koryo would defeat and ended in Another Hansaguns rule. So he turned his troops and went back Gaegyung (Goryos capital) at Wehwado island. He won through obstructions on the road for about four years (1388. 6-1392. 7). From Kingdom to Empire: Birth of the Daehan Empire and the Dismantling of the Gyeongguk daejeon System

이 글은 1897년 10월에 성립된 대한제국의 정치적 의미를 크게 두 측면에서 살피려는 시도이다. 그 하나는 국내 정치체제의 변화로서 이른바 경국대전체제의 해체이다. 경국대전체제는 국왕을 중심으로 강력한 중앙집권체제를 지향하는 체제이자 동시에 국왕 및 고위 관료에 대한 내적 견제장치를 특징으로 한다. 그런데 1899년 8월에 반포된 대한제국의 헌법에 해당하는 는 황제의 무한한 군권(君權)을 규정하고 있다. 대한제국의 황제는 육해군 통솔권을 갖고, 법률을 제정·집행·사면할 수 있을 뿐만 아니라, 관료들의 임명·평가·봉급 등까지 정할 수 있게 되어 있었다. 한마디로 황제의 군권은 불가침의 것으로서(제3조0 조선조의 국왕과 달리 어느 누구도 견제하거나 도발할 수 없는 것이었다. 다른 하나는 대외관계의 변화로서 왕조(Kingdom)에서 제국(empire)으로의 국격(國格)상승이다. 은 사대(事大) 즉 대국(大國)인 중국을 섬기는 조선왕조의 규정들을 명시하고 있다. 예컨대 조선의 왕과 문무백관(文武百官)은 주요 절기 때마다 중국 황제에 대한 예(禮)를 갖추어야 했으며, 왕과 왕비, 그리고 왕세자 등은 형식적이지만 황제의 승인(冊封)을 얻어야 했다. 이에 비해 는 대한제국이 외교관을 파송하고 외국에 선전포고를 하고 강화조약을 체결하는 등 자주독립한 제국(帝國)이라고 규정하고 있다. 종래 조선왕조의 위계적인 사대질서가 대한제국의 탄생으로 수평적인 공법질서로 바뀐 것이다. 본고는 아울러 이러한 대한제국 탄생의 한계로서 인재 활용의 실패를 지적하고자 한다. 즉 고종은 왕위에 오른 지 34년 만에 대한제국을 수립했는데, 친정(親政)하기까지의 유예기간을 제외한다하더라도 적지 않은 기회가 있었는데, 새로운 국가에 필요한 인재를 양성, 배치하는 데 성공하지 못했다. 당시 존재했던 인재들을 제도 안으로 끌어들이거나 서로 연결시키는 정치력을 발휘하지 못했으며, 만민공동회 등에서 볼 수 있는 백성들의 소리를 소통시킬 수 있는 제도적 장치를 마련하지 못한 점도 아쉽다. 19세기의 격변기에 적응해 나가려는 고종의 노력이 끝내 좌절되고 만 배경에는 비단 일본의 침탈 외에 국내정치의 실패가 있었음을 본 논문을 통해 밝히고자 한다. Joseon dynasty, based on its about 500year-long Gyeongguk daejeon system, maintained its two governmental features: internationally "respecting the senior state" (sadae) with China and "keeping friendship with neighboring countries" (Jurchin and Japan) on the one hand, domestically pursued respect for Confucian proprieties and conceded only relative sovereignty to the Joseon king on the other hand. This political system, however, was dismantled in 1897, following the birth of the Daehan Empire, which proclaimed itself as a self-reliant independent nation in international community and in which unlimited sovererign was granted to the emperor. How is the Daehan Empire difference form the Joseon Dynasty? For this, I compared the provisions of the Daehanguk gukje (hereafter, Gukje), which was established with the birth of the Daehan Empire in 1897, with those of the Gyeongguk daejeon as follows. First, Gukje states that the Daehan Empire is independent enpire that can make its own decision regarding important matters of the Empire such as dispatch of diplomats, declaration of war, and conclusion of peace treaty. In comparison, Gyeongguk daejeon accepted a junior status to China and scrupulously observed the ritual practices of tributary state, based on the tradition of "the respect for the senior state (sadae) diplomacy". Second, another point to be noted is the stipulation that grants unlimited power to the Emperor. According to the Gukje, the emperor has the command of the military and naval forces, the right of enacting and enforcing laws, and even the pardon power (Article 6). As compared with this, the royal authority prescribed in the Gyeongguk daejeon in relative. Unlike the Gukje according to which the emperor is supposed to assume all responsibilities from the enactment of laws to the appointment of government official, the Gyeongguk daejeon system makes it a principle to entrust all those responsibilities to ministers. The third difference is found in the upgrading of state rituals. Whereas the Gukjo oryeui established the norms for the state rituals on the level of a feudal country, the Daehan Empire raised its all state rituals to the level of those of an empire and stipulated the norms in the Daerye uigwe (Ceremony Manual for the Grand Rites). For example, the Daerye uigwe assigns to the country a different status form that specified in the Gukjo oryeui, which is counterpart of the Gyeongguk daejeon. A Study of King Sejongs Confucian Spirit of Law : A Focus on His View of Law and Fair Judgment

세종은 살맛나고 올바른 나라, 즉 그의 정치 비전인 생생지락(生生之樂)의 나라를 만들기 위하여 사법(司法)분야에서 어떤 노력을 기울였나? 법과 질서를 어기는 자에 대해서 그는 엄격한 처벌을 내렸는데(사형집행률 86%), 그것을 어떻게 정당화하였나? 이러한 일련의 질문에 대답하기 위하여 본 연구는 『세종실록』에 있는 100여 개의 법에 대한 기록과 536건에 달하는 그의 사죄(死罪) 판결을 분석하였다. 그 결과 세종이 생각하는 좋은 판결은 인의(仁義)로운 판결이라는 결론에 도달하였다. 즉 그는 죄인을 형벌로 다스리는 것은 사회질서를 유지하고 정의를 구현하기 위하여 불가피한 일이지만, 법 맡은 관리가 형벌을 남용하여 인격과 생명을 침해하는 것은 불가하며, 그 경우에도 만의 하나 억울한 사람이 생기지 않도록 차마 하지 못하는 마음을 가지고 세심히 살펴판결을 내려야 한다고 강조하였다. 의(義)를 세우는 것도 중요하지만, 차마 하지 못하는 인(仁)의 마음이 빠진 정의는 곤란하다는 게 세종의 재판 판결 정신이었다. 세종은 법률이나 감옥이 사람들이 모여 사는 현실에서 불가피한 제도이고 기구이지만, 백성들이 법을 잘 알아서 죄를 짓지 않게 하는 데 궁극 목적이 있다고 보았다. 그래서 최종적으로는 감옥이 텅 비게 하는 나라를 만들겠다는 꿈을 가지고 있었다. 그는 무엇보다 감옥제도에서 백성들이 억울하게 죽는 일이 많다는 것을 개탄하고, 나라에서 가장 취약한 처지에 놓여 있는 감옥 죄수의 삶의 질을 개선하기 위하여 노력하였다. 그렇다면 구체적으로 억울함이 없는 재판을 만들기 위하여 세종이 기울인 노력은 무엇이었나? 첫째, 감옥제도의 개선이다. 세종은 죄수들이 감옥에서 더위나 추위 또는 병으로, 그리고 고문이나 남형으로 죽게 해서는 안 된다고 누차 강조하고 또 확인하는 행정을 하였다. 둘째, 이런 어진 마음은 억울하게 벌을 받은 사람의 누명을 풀어주는 조치로도 나타났다. 1433년(세종 15년) 7월의 약노(藥奴) 사건 등이 그 예다. 셋째, 세종은 백성들이 잘 모르고 한 범죄나, 규정이 만들어지기 전의 잘못인 경우 처벌하는 것을 반대하였다. 세종실록에서 이렇게 세종시대판 죄형법정주의라고 할 수 있는 여러 사례를 찾을수 있다(재위 18년의 사헌부의 요망한 무당 처형주장을 세종이 반대한 사례, 재위 22년의 사헌부 관리 안순기 죄지은 궁녀를 변호한 사례 등)This paper investigates King Sejongs political conception of justice by analysing 536 cases that was dealt with during his reign (1418-1450). King Sejong emphasized that officials in charge of enforcing the law must refrain from misusing punishments and violating human dignity and life, and that the law must be enforced in such a way as to avoid even a single incident where a person is punished by an unwarranted judgment. It is important that justice be upheld, but justice without benevolence was to be avoided at all cost. Sejong wished to make a country with justice and benevolence, not just a country with justice. Sejong saw the law and prison as an indispensable system in a reality where all kinds of people live together, but he also thought that the ultimate purpose of the system was to make people have a good understanding of the law and have them refrain from committing crimes. He had a dream to make a country with an empty prison. He deplored the fact that quite a number of inmates suffered death on an unfounded charge and tried to improve the quality of life of prison inmates, people whose situation was most vulnerable in the country. Then, what did Sejong do in his endeavor to ensure the prevention of unfair judgments? First, he improved the prison system. Sejong repeatedly emphasized that there should be no deaths of inmates from severe hot or cold weather, sickness, punishment out of the law, or torture, and he carried out an administration that confirmed no such deaths. Second, this benevolence showed itself in the measure he took to clear a person of false charges. The case of Yak No that took place in July 1433, in the 15th year of Sejongs reign, is a good example. Third, Sejong was opposed to punishing the people for their innocence about the law and for their acts of violation before the law was enacted. Forth, he made sure that not only the criminal himself but also the people around him knew the essence of the crime committed and punished accordingly so that people took caution against the crime. And fifth, he requested his law officials to put themselves in anothers place before adjudging. This is the essence of King Sejongs Confucian spirit of law

正祖の聖王論と更張政策

정조시대의 公論 연구: 臺諫의 활동과 儒生들의 집단상소를 중심으로

이 글은 正祖의 정치운영방식을 당시 公論의 양상을 통해 이해하는 데 목적이 있다. 이를 위해서 먼저 조선조 정치에 있어서 공론의 의미와 위상을 살펴보았다. 정조시대의 공론의 양상은 언론三司의 활동(在朝언론)과 재야 유생들의 정치적 참여(在野언론)를 실증적인 자료를 가지고 분석해보았다. 그 결과 정조시대의 공론은 在朝 차원이나 在野 차원에서 모두 위축된 것으로 나타났다. 대간들의 활동은 언관권을 제한하는 국왕의 조치나 금령 설치로 인해 점차 약화되었고, 재야 사림(또는 산림)의 활동 역시 특정 붕당의 정치적 목적에 이용되거나 분열되는 등 그 권위를 인정받지 못하게 된 것이다. 정조는 특히 집권 후기로 갈수록 과도한 금령설치를 통해서 언로를 폐쇄하는 한편, 재야 유생들의 집단상소를 국왕의 정치적 목적을 위해서 동원하거나 산림들의 권위를 실추시키곤 했는데, 이는 결국 국왕의 자의적인 통치와 독주, 그리고 공론정치의 붕괴를 초래했다. 조선조 정치체계의 중요한 견제장치였던 대간권이 약화되고 재야의 비판세력이었던 산림들의 위상이 실추됨으로써 왕권 그 자체는 강화되었을지 모르나, 유교국가체제의 기반을 붕괴시키는 결과를 초래한 것이다
