Law on Promoting Green Purchasing as the Information System in the Environmental Policy

今日,大量生産・大量消費・大量廃棄型の社会から循環型社会への転換は,いまや時代的要請といえる。また,従来,環境政策における法的手法として主に用いられてきた規制・監督手法は機能不全を起こしていることを踏まえて,環境政策においても,情報手法が注目されている。いわゆるグリーン購入法は,循環型社会への転換を意図して策定された法律てあり,また,情報手法として位置づけることができる。環境政策における情報手法としてグリーン購入法をうまく機能させる「鍵」は,情報の「質」といえる。グリーン購入法においては,(1)国等の公的部門における環境物品等を調達する段階では,環境物品等の調達要件や調達実績を明確にするとともに公表することによって,当該情報の「透明性」を確保することが要求され,(2)環境物品等に関する情報を提供する段階では,できる限り独立した第三者機関が実施する認証・審査登録制度を充実させることによって,提供される環境情報の「信憑性」を確保することが要求される。There is much demand for the circulatory society in this times. The command-and-control system fails to function properly, so the information system has lately attracted considerable attention. Law concerning the Promotion of Procurement of Eco-Friendly Goods and Services by the State and Other Entities (Law on Promoting Green Purchasing) is the information system that intends to change to the circulatory society. The key word that Law on Promoting Green Purchasing functions properly is the quality of the information. In this law, the procurement policy for eco-friendly goods, etc. and the summary of procurement track record are published without delay. And those who provide the information on eco-friendly goods, etc. shall endeavor to provide effective and appropriate information. So in the information system, the transparency and reliable information is requested

Reflections on Legal Evaluation of the Reclamation Work of Isahaya Bay and a Direction in Future

Public works which include the reclamation work of Isahaya Bay make an issue of environ-mental disruption and a waste of the budget. They make an issue of law. Concretely, I can point out, (1) non-democratic procedure of overall development plan of the national land and long-range plan of land improve, (2) a functional disorder of policy evaluation system, (3) a functional disorder of evaluation system from environmental point of view, (4) a functional disorder of revaluation sys-tem, (5) a lack of system which withdraw from public works.So I think that (1) overall development plan of the national land and long-range plans of public works should be abolished. Next, I think that the following legal system should be built in. Con-cretely, I want to make a point of (2) democratic procedure of work plan, (3) the preceding policy evaluation system, (4) the preceding evaluation system from environmental point of view, (5) the regular revaluation system, (6) the system which withdraw from public works.諌早湾干拓事業を中心とする公共事業は、環境破壊と予算の無駄遣いという2つの問題点があることは周知の事実であるが、そのはか、法的な視点からは、（1）民主的統制なく国土総合開発計画、土地改良長期計画などの計画が策定されるという策定手続き、（2）事業計画の目的の妥当性や費用対効果比などの政策評価を行なう法システムの機能不全、、（3）環境保全の視点から評価するシステムの機能不全、（4）公共事業を再評価するシステムの機能不全、（5）公共事業の中止・撤退システムの欠如などの問題点が指摘できる。　そこで、今後どのような法システムにすべきかであるが、次のような法システムが考えられよう。(1)国土総合開発計画・公共事業関連長期計画を廃止し、(2)幅広い利害関係人を事業計画の策定手続きに加えて事業計画を策定し、(3)その策定された事業計画について事前に政策評価するとともに、(4)環境保全の視点からも事前評価する。その際、地域住民等の利害関係人もその手続きに参加させる。以上のチェックを経たうえではじめて事業が行うこととするが、そうして行われた事業であっても、(5)定期的に事情の再評価を行うこととする。その再評価は、できるかぎり事業主体とは異なる第三者が行うこととし、評価の結果については公表する。最後に、(6)事前の政策評価、環境面からの事前評価、事業の再評価において、事業を見直すべきだという結果がでた事業については、事業の中止を含めた事業を見直す規定を法律の文言に盛り込む

Reflections on Environmental Information Control of PRTR Law

"Law concerning reporting，etc，of releases to the environment of specific chemical sub-stances and promoting improvements in their management"，so－called PRTR Law，was promul-gated on 13th July 1999.By the implementation of a PRTR system，this new law is intended to promote the inprovements in the voluntary management of chemical substances by the businesses and to prevent any imprediments in environmental protection，based on a different idea from theexisting environmental laws．Various environmental information play an important part in the PRTR Law．In this paper，I regard the PRTR system as an information method and reflect on en-vironmental information control of the PRTR Law
