The Role of the Conditionality of EU Membership in Migrant Criminalization in the Western Balkans

Odzivanje Evropske unije (EU) na migracijske izzive presega ozemlje njenih držav članic. Prek pozunanjenja mejnega nadzora se preliva na ozemlje Zahodnega Balkana (ZB), ki ga preči ena najpomembnejših migracijskih poti s Srednjega vzhoda in Afrike proti Evropski uniji. Medtem ko države ZB ne kažejo interesa za migrante in jih štejejo za problem EU, ta evropsko integracijo pogojuje z vzpostavitvijo struktur upravljanja z migracijami, podobnimi tistim v EU. Prenos prava EU pa povečuje tudi stopnjo kriminalizacije migracij, kar kaže na problematično vlogo EU in nacionalnih zakonodajalcev na ZB v razmerju do temeljnih pravic migrantov.The EU’s responses to migration challenges exceed the territory of its memberstates. Through externalization of border control they spill over into the countries ofthe Western Balkans (WB), which is crossed by one of the most important migration routes from the Middle East and Africa to the EU. While the WB countries show indifference towards migrants and consider them an “EU problem”, the latter conditions European integration with the establishment of migration management structures similar to those in the EU. The transposition of the EU acquis also increases the criminalization of migrants, which highlights the problematic role of the EU and national legislators in WB in relation to the fundamental rights of migrants

Zakonodajni in pravosodni odzivi na »begunsko krizo« v Sloveniji in Avstriji: primerjalna perspektiva

The article compares key normative and judicial responses to the 2015–2016 “refugee crisis” in Slovenia and Austria. It does so by comparing the asylum statistics, the main changes to the legislation reflecting populist reactions to the “refugee crisis,” and judicial responses to these changes and reactions. The qualitative legal analysis is based on examples of the most important changes and responses. The article considers the populistic context of these changes, as discussed by some political scientists, who demonstrate that with the crisis, a new wave of populism—“the populist Othering of migrants”—emerged.Avtorica primerja ključne normativne pristope k obravnavanju »begunske krize« v obdobju 2015–2016 ter odzive sodstva na te pristope v Sloveniji in Avstriji. K temu pristopi s primerjavo statističnih podatkov na področju azila, najpomembnejših zakonodajnih sprememb, ki odražajo populistične odzive na »begunsko krizo«, ter odgovorov sodišč na te spremembe in odzive. Analiza je kvalitativna in temelji na izbranih primerih najpomembnejših zakonodajnih sprememb. Članek upošteva populistični kontekst teh sprememb, kot ga razumejo politologi. JAVNI ODGOVOR NA 9/11 U POLITICI: PATRIOTIZAM, STRAH I JEZIČNI PROBLEMI

The paper with the title “Public Response to 9/11 in Politics: Patriotism, Fear and Language Issues” examines the immediate responses that emerged in American political administration after the terrorist attacks on 11 September, 2001 in New York City and Washington, D.C. Moreover, the paper analyzes the speech “We Have Seen the State of Our Union” given before the Congress on September 20, 2001, by the former U.S. President George H. W. Bush, showing the prevalent manner of the rhetoric of the then current government administration. Seeking to explain the rhetoric of the politicians after 9/11, the analysis explores several parameters. This kind of rhetoric addressed the issues connected to 9/11, and employed a great deal of patriotism-related words as well as a language that could help instigate fear and paranoia in Americans and their culture.Rad s naslovom "Javni odgovor na 9/11 u politici: patriotizam, strah i jezični problemi" istražuje neposredne reakcije koje su se pojavile u američkoj političkoj administraciji nakon terorističkih napada 11. rujna 2001. u New Yorku i Washingtonu. U članku se analizira govor "Vidjeli smo stanje naše zajednice" koji je pred Kongresom 20. rujna 2001. godine dao bivši američki predsjednik George H.W. Bush, koji pokazuje prevladavajući način retorike tadašnje vladine administracije. U potrazi za objašnjavanjem retorike političara nakon 11. rujna, analiza istražuje nekoliko parametara. Ova vrsta retorike govorila je o pitanjima vezanim za 11. rujna, a koristila je mnogo riječi povezanih sa patriotizmom, kao i jezik koji bi mogao potaknuti strah i paranoju kod Amerikanaca i u njihovoj kulturi

Impact of Management Ethics on Payment Discipline

A company\u27s ethics is one of the key factors of its effectiveness. Having poor business ethics usually lead to the lack of payment discipline. The main purpose of the study was to identify the possible impact of management ethics on the financial discipline of companies. The study involved 273 Slovenian public and private companies, which represented 9.1% of all companies invited to take part in the survey. The data on management ethics were collected using the Corporate Ethical Virtues measurement instrument questionnaire and the data concerning average late payments were obtained from the database of the Slovenian rating agency “I d.o.o.”. Statistical analysis was carried out using SPSS 20.0 for Windows. We conducted a factor analysis and a regression analysis using the stepwise method. We found that management ethics has a positive impact on payment discipline. At the end of the article, we give suggestions for improvement of payment discipline. Eksperimentalno određivanje otpora serije brzih poludeplasmanskih katamarana

Problem određivanja ukupnog otpora katamarana daleko je složeniji od istog problema prisutnog kod jednotrupnih brodova. Složenosti hidrodinamičkog sadržaja ukupnog otpora katamarana doprinosi i pojava interferencije trupova koja može biti i viskozna i valna. Na temelju rezultata ispitivanja četiri modela katamarana provedenih u Brodarskom institutu u Zagrebu određen je faktor forme primjenom metode Prohaske. Određene su komponente ukupnog otpora ispitane serije katamarana primjenom metode Froudea i metode Insela i Mollanda. Dobiveni rezultati su ekstrapolirani na katamarane u naravnoj veličini i izračunate su vrijednosti ukupnog otpora. Relativne pogreške između vrijednosti dobivenih metodom Froudea i metodom Insela i Mollanda prikazane su dijagramom. Na temelju ukupnog otpora katamarana odabrana je najpovoljnija forma katamarana sa stajališta otpora

Can an ethical work climate influence payment discipline?

Purpose: All European companies are faced with the lack of payment discipline, which often affects even their survival. One of the key reasons for the lack of payment discipline is poor business ethics, which is primarily introduced with the subject of ethical climate in the literature. For this reason, we wanted to determine whether a company%s ethical climate influences its payment discipline. Design/methodology/approach: In the research, we used Arnaud%s measurement instrument (2010) that helped us to identify six dimensions of ethical climate. The data about a company%s ethical climate were later compared with the data about its payment discipline, calculated using the Dun & Bradstreet rating agency methodology. We included in the sample 273 Slovenian companies, which represented 9.1% of all companies invited to take part in the survey (2978 Slovenian enterprises with 10 or more employees). Findings: We established that (among the six dimensions of the ethical climate) the dimension %moral sensitivity % the lack of norms of empathetic concern% had statistically significant influence on the average delay of payment, and the more significant for the company the lack of norms of empathetic concern was, the longer the delay of the payment to suppliers would be. Our conclusion is that the appropriate forms of the incorporation of training and education on ethical subjects into business studies may increase the payment discipline of companies. Originality/value: The present study represents an important contribution to understanding the causes of payment defaults. The study also includes non-financial antecedents of payment discipline, which represents a new, important contribution of the research
