Épistémologie du risque : la troisième voie d'Ulrich Beck et son influence sur la doctrine environnementaliste
"En 1986, était publiée la première édition en langue originale de La Société du risque du sociologue et philosophe allemand Ulrich Beck. Un quart de siècle après cette édition séminale et dix ans après sa première parution en français, il semble pertinent de jauger dans quelle mesure cet ouvrage, l’un des plus importants dans le champ des sciences sociales de ces vingt dernières années, a pu ou non influencer la doctrine juridique en particulier, celle consacrée au droit de l’environnement. En effet, Ulrich Beck, dont les réflexions s’inscrivent dans le sillage des préoccupations écologiques contemporaines, prit les risques environnementaux comme point de départ de sa théorie. Dans le cadre limité de cette introduction, il s’agira de se pencher exclusivement sur les tensions épistémologiques traversant les analyses orientées vers la gestion du risque. Sur ce point, Ulrich Beck a développé une pensée originale, traçant ce que l’on pourrait qualifier de troisième voie entre les options réalistes d’une part, constructivistes d’autre part, options que l’on observe généralement dans la littérature de sciences sociales consacrée au risque et à sa gestion. Après cette présentation succincte, cette contribution constatera le peu d’influence que l’analyse produite par Ulrich Beck présente dans le champ des études juridiques relatives au droit de l’environnement. Plusieurs hypothèses explicatives de cette absence seront avancées. Surtout, il s’agira de regretter le peu d’ancrage épistémologique de la plupart des travaux juridiques portant sur l’environnement ; en particulier, le potentiel d’une réflexion environnementaliste fondée sur une approche davantage constructiviste du risque sera brièvement exploré."In 1986, the first edition of Risk Society, by German sociologist and philosopher Ulrich Beck, was published. Twenty-five years after this seminal edition and ten years after it was published in French, it seems relevant to analyze how this work, among the most important in the social sciences studies of the last twenty years, affected the law, especially the one dedicated to the environment. Ulrich Beck, whose thinking align with contemporary environmental questioning, used the ecological preoccupations as the base for his theory. Within the limits of this introduction, we will focus on the epistemological tensions in the works about risk management. Ulrich Beck developed an original thought on the subject, neither realist nor constructivist, which are the two options usually found in the social sciences literature about risk management. Then, this contribution will record how limited the influence of Ulrich Beck’s theories have been on the teaching of the environmental laws and propose several hypotheses as for why it is the case. Above all, we’ll analyze how little the environmental judicial work focus on epistemology and eventually discuss the potential of an environmentalist reflection based on a constructivist approach

In the book of Distant Love Beck and Beck continue the work which was written in the Normal Chaos of Love by arguing that the classic family has begun to give away to the multiplicity of new type of families. Normal Chaos of Love has showed how single parent families and patchwork families have emerged due to successive marriage and divorce. Distant Love also focuses on new type of families, but it considers the global pictures by introducing the concept of world families. As Beck and Beck summarize it, the aim of the book is to “focus on the globalization of love”; however, it does not rely on own research or empirical results but illustrates its points with several examples taken from other studies

From what the legal world does for environmental protection to what environmental protection does for the legal world – considerations in a climate of metamorphosis in the European legal framework
A presente análise tem por mote o último trabalho de Ulrich Beck – A
metamorfose do mundo: como as alterações climáticas estão a transformar a
sociedade. Nele o Autor explica que o mundo está a passar por um processo
de metamorfose que “[desafia] a nossa maneira de estar no mundo, de pensar
sobre o mundo e de imaginar e praticar a política”. Se bem que o trabalho de
Ulrich Beck se concentre sobretudo nas alterações climáticas como agente
deste processo de metamorfose, propomo-nos, por um lado, ter por escopo de
análise a proteção do ambiente e, por outro, delimitar o quadro de referência
para a proteção jurídica do ambiente no quadro do direito da União Europeia. O
objetivo é trazer à colação e propor para reflexão algumas questões atinentes às
interconexões entre a proteção jurídica do ambiente e a regulação das relações
económicas no quadro do mercado interno, bem como o seu impacto no desenho
jurídico-democrático no contexto europeu.The present analysis focuses on the latest work by Ulrich Beck – The
Metamorphosis of the World: How Climate Change is Transforming Our Concept
of the World. Therein the Author explains that the world is undergoing a process
of metamorphosis that challenges our way of being in the world, of thinking about
the world and of imagining and practicing politics. Although Ulrich Beck’s work
mainly focuses on climate change as an agent of this process of metamorphosis,
we propose, on the one hand, to consider environmental protection as the scope
of analysis and, on the other hand, to limit the frame of reference to the legal
protection of the environment within the framework of European Union law. The
objective is to propose for reflection some issues concerning the interconnections
between the legal protection of the environment and the regulation of economic
relations within the framework of the European internal market, as well as its
