Stipulatio argentaria. La intervención del argentarius en las subastas según la lex metalli Vipascensis, capítulo I

La presente comunicación versa sobre la intervención del argentarius en las subastas según la Lex Metalli Vipascensis capítulo I, en el cual se alude a la centesima argentariae stipulationis. En este trabajo analizamos las diversas interpretaciones que han surgido respecto a qué es la indicada centesima, así como la necesaria presencia del argentarius en las auctiones contempladas en la Lex Metalli.This article deals with the intervention of the argentarius in the auctions according to the Lex Metalli Vipascensis chapter I, which refers to the centesima argentariae stipulationis. We analyze various interpretations that have emerged regarding what is the centesima Indicated, as well as the necessary presence of the argentarius in the auctiones referred to in the Lex Metalli

Conflict of Laws in the Uniform Commercial Code

Pulsatilla vernalis is one of several endangered plant species that benefit from wildfires and small scale disturbance events that repel competing vegetation and create open patches in the vegetation cover. Previous studies argue that Pulsatilla vernalis is decreasing in numbers due to vegetation changes associated with the decrease in wildfires, forest grazing and changes in forest management. In this study, 17 populations of P. vernalis were inventoried in order to examine if soil and/or vegetation structures affect the population structure of P. vernalis (i.e. population size, presence of flowering individuals, density of juveniles) and if performed conservation attempts in the populations have been positive for P. vernalis. This was done by counting the number of vegetative, flowering and juvenile individuals and examining soil and vegetation structure in the populations. The population sizes were then compared with estimates of population sizes from earlier inventories of P. vernalis at the same localities. The study also presents specific recommendations for an improved conservation management of P. vernalis. The results of this study show that mechanical conservation management had a positive effect on the population size and that open areas in the vegetation cover provided better conditions for viable populations of P. vernalis. To prevent the trend of decreasing population sizes of P. vernalis, conservation measures must be carried out to repel competing vegetation and to restore or maintain open patches in existing populations

"VAS APPELLATUS QUI PRO ALTERO VADIMONIUM PROMITTEBAT ". PER UNA LETTURA DI VARRO, DE LING. LAT., 6.74.

La ricerca ha ad oggetto l’analisi della testimonianza, in materia di vas, contenuta in Varro, De ling. lat. 6.74. Secondo l’autore, per descrivere l’antico vas Varrone aveva impiegato una definizione utile a descrivere il garante del vadimonium, l’adpromissor che assicurava la comparizione del convenuto in giudizio, aggiungendo la propria promissio (adpromissio) a quella prestata (vadimonium) dallo stesso convenuto. La ragione di tale equiparazione tra le due figure era costituita dal fatto che lo sviluppo storico aveva determinato la trasformazione del vas, nel suo stadio ultimo, proprio nel garante del vadimonium. Nella seconda parte del testo Varrone aveva inteso prospettare due esempi, in due campi diversi, processuale e negoziale, di uno stadio di tale sviluppo storico, quello che aveva determinato il passaggio dal vas come status al vas come sponsor. Nell’impiego in campo processuale, cui si riferisce la parte centrale del testo, tale stadio aveva portato all’emersione della figura del vadimonium e, con essa, grazie all’impiego della adpromissio, di quella del c.d. garante del vadimonium. Il vas era diventato il garante del vadimonium. Nel campo negoziale della venditio di publica praedia, cui si riferisce la parte finale della testimonianza, tale stadio determinò il venir meno dell’impiego dei vades. Non fu più obbligatorio per i compratori di publica praedia dare vadem per garantire il pagamento del pretium
