    Marriage a la mode

    Get PDF
Marriage a la Mode is the fourth chapter in the biography of Thomas, Marquess of Wharton (Tom to his family and eventually to the political world of England). The chapter picks up the narrative about 1666, when young Tom returns from three years in France; and it deals with the attempts of Lord Wharton, his father, to negotiate a suitable seventeenth-century style marriage for him. Though the episodes deal with the Wharton family in particular, they illustrates some of the general problems of aristocratic marriages during the Restoration era; and they form a complete story in themselves. The tables of abbreviations and short titles which are included to help the reader through the (voluminous) notes are the lists for the whole biography, not merely Marriage a la Mode.</p

As part of Indonesian society, Chinese society prosseses unique custom and tradition. Although Chinese society has settled for centuries in Indonesian and has adapted to Indonesia culture, they still carry out their marriage ceremony called “cio tao”. The marriage sense for Chinese society is “xiao” i.e. the respect to their parent, ancestors and the welfare for both families. It is recognized that Chinese society in Indonesia can be classified into two groups, i.e. pure-blooded and half-bred. Both groups organize different marriage custom. Pure-blooded group still follow the traditional custom while the half-bred left the traditional custom and attached either to their religion or Western style. At the present time the Chinese society tends to follow the traditional style as the consequence of the decree of president Abdurachman Wachid No.6/2000

Varieties of Constitutional Experience: Democracy and the Marriage Equality Campaign

Beginning in the 1970s, the overwhelming success of anti-gay ballot questions made direct democracy the most powerful bête noire of the LGBT rights movement. It is thus deeply ironic that, more than any other factor, an electoral politics-style campaign led to the national mandate for marriage equality announced by the Supreme Court in Obergefell v. Hodges. This occurred because marriage equality advocates set out to change social and constitutional meanings not primarily through courts or legislatures, but with a strategy designed to win over moveable middle voters in ballot question elections. Successful pro-gay litigation arguments, followed by supportive reasoning in judicial victories, grew directly out of the messaging frames that tested best with voters. A new variation on popular constitutionalism was born. The lawyers who led the marriage equality campaign succeeded by decentering litigation until after opinion polls registered majority support for allowing same-sex marriage. In developing and implementing this strategy, they were assisted by professionals skilled in communications research and enabled by large-scale, coordinated funding. These dimensions of the marriage equality effort both validate and contradict much of the law and society scholarship predicting that court-centered rights discourse will inevitably dominate law reform campaigns. In this Article, I argue that the same-sex marriage campaign is likely to foreshadow sophisticated social change efforts in the future that look less like traditional impact litigation strategies and more like social marketing campaigns, one component of which may be constitutional interpretation. Whether this model has major potential for significantly progressive change will turn on its effectiveness for issues that involve claims for redistribution of material resources or greater openness in governance, challenges with which the marriage equality effort was not forced to engage. In the marriage campaign, voter-tested messaging led to two major discursive innovations. The first was the jettisoning of rights arguments in favor of storytelling models that were grounded in emotions rather than rights. Advocates stopped enumerating the legal benefits of marriage and talked more about the bonds of commitment exemplified by same-sex couples. Second, ballot question campaign ads increasingly featured the construction of a storytelling arc centered on how opposition to same-sex marriage of older or more conservative voters could morph into acceptance (even if not endorsement) of it. These narratives guided conflicted, moveable middle voters (and others) along a path toward a different sense of moral awareness about homosexuality and same-sex marriage than the manichean version of morality arguments used by conservatives. The new approaches were calibrated, tested, and refined for particular audiences, producing empirical evidence to support a new addition to the language of law: data-driven arguments. The most significant limitations of this approach operated at the level of social and constitutional meanings. Several discursive pivot points that emerged from the messaging strategy led to the shrinkage of what might have been greater emphasis on the pluralism of family forms as the foundation for equality and liberty in the realm of personal relationships. These pivot points include: The shift from an equality frame based on analogies to other social minorities to a universalized sameness approach; The shift from an emphasis on the material consequences of being denied access to the legal incidents of marriage to an emphasis on commitment, child raising, and the relational and emotional motivations for wanting to marry; and The avoidance of arguments for “expanding” or “changing” marriage and the stress of the desire for “joining” marriage. This new frame reassured moderate voters and judges that the traditional norms and practices associated with marriage were not being threatened, producing a kind of cultural interest conversion. This was brought about through a discourse that was mined from the rhetoric of popular constitutionalism but suffused with the resonance of respectability

The study assessed the factors contributing to expected ages of marriage in two student populations that are presumed to differ in academic achievement and goals. A primarily goal of this study was to describe the influence that adult attachment style has upon a person\u27s expected age at marriage. A secondary goal was to explore other social and goal-oriented influences on timing of marriage in the two populations. There were no significant differences in attachment style for men and women. The more Avoidantly a person ranked, the later the age at which they expected to get married. University students\u27 ideas about marriage were more influenced by educational goals than the community college sample. There were significant differences between men and women in expected age at marriage and the degree of influence of certain goals. It was found was that the community college students considered themselves to be adults at a younger age than the university group and ideally wanted to start a family at an earlier age

Achieving Amicable Settlements and Possible Reconciliations : The Role of Forensic Accountants in Equitable Distributions

This book is focussed on investigating how a proper implementation of forensic accounting tools could serve as a means and channel whereby such techniques as valuations, equitable distribution and evidence could be employed in avoiding unnecessary break ups and emotional breakdowns. Through the exploration of options which are available to marital couples considering separation or divorce during periods of crises, the book aims to emphasise the theme that a break from the relationship may be the step required to avert a break-up. The role of forensic accounting in facilitating an amicable process during such a break - which could result in the possible restoration of relationships involved during such crucial stage also constitutes a recurring theme of the book. It is a well known fact that financial problems constitute the source of break-downs in many relationships. Whilst other factors may contribute to failures in relationships and whilst some couples may have finalised their intentions and require very little assistance in getting through such painstaking processes, others may have their decisions influenced by court procedures, counselling sessions and the proper application of equitable distribution procedures – such equitable distribution procedure being considered a preferred technique in resolving marital asset distributions than the community property concept. Further this book highlights factors which need to be taken into consideration – not only in averting unnecessary break-ups, but also in facilitating harmonious and amicable settlements which may eventually pave the way for reconciliation, as well as restoration of broken down relationships. Whilst planning of marital asset distribution should not constitute the focus of any marriage, planning when the need arises may serve not only as a channel whereby a relationship can be restored eventually, but as a temporary means of weathering the storms during the difficult times in the relationship
