Habeas Bargaining

Habeas Bargaining: This paper asks whether defendants exchange their habeas rights in return for shorter sentences much as they do with their trial rights in plea bargains. It finds that federal defendants frequently do so when they plead guilty and that some state and federal prisoners even do so after conviction and sentencing if they have identifiably serious state or federal habeas claims. However, such "habeas bargains" are not as common as ordinary plea bargains. The paper offers a number of explanations, e.g., that state prosecutor offices are structured such that they do not internalize the benefits of habeas bargains and that the rigidity of the U.S. Sentencing Guidelines and mandatory minimums in federal criminal statutes rules out many sentencing compromises at the federal level. However, it ultimately finds that there are a significant number of cases where bargains could have been struck but were not because the parties simply did not think to trade habeas rights. The paper concludes with a recommendation that defense attorneys and prosecutors more frequently consider bargaining over habeas rights because such deals can mitigate the growing overall cost of habeas litigation. Expansion and Acquisition: The Built Environment Under Gettysburg College President, Gordon Haaland, 1990 to 2004

Gordon Haaland presided over Gettysburg College from 1990 to 2004. His goals included improving the national status of the college by increasing the student body, developing the academic departments, and creating a dynamic campus community. This paper outlines Haaland\u27s attempts to fulfill these goals through a plethora of construction projects, ranging from building a state of the art science center and extensively renovating a historic theater, to updating dormitories and revitalizing the appearance of campus. Some of the construction included projects that were planned under the previous president and carried out by Haaland, as well as scandals that accompanied these efforts. In addition, the paper covers the fundraising and planning processes, as well as the campus and community reactions to the building projects. Ultimately, this paper weighs the successes and challenges of Haaland\u27s construction plans during his highly productive presidency

The Revolution Will Be Televised But Not Supported: Student Protest at Marquette University

This project examines the factors that affect the presence of student activism and student protest at Marquette University. The current social and political environment of the United States has created an exigence to discuss how students at Marquette critique their surroundings. Data is collected from a variety of sources including the author’s auto-ethnography, a review of historical and scholarly data, institutional data, and student and faculty interviews. Overall, the data shows that student protest and student activism at Marquette University exists amid a series of conflicting influences. The prioritization of donor-based funding and positive publicity, the ambiguity in the meaning of Marquette values, and the prevalence of repressive tolerance create an environment in which meaningful student activism is stifled.https://epublications.marquette.edu/english_3210ur/1036/thumbnail.jp
