The political dimension of animal ethics in the context of bioethics: problems of integration and future challenges
Animal ethics has reached a new phase with the development of animal ethical thinking. Topics and problems previously discussed in terms of moral theories and ethical concepts are now being reformulated in terms of political theory and political action. This constitutes a paradigm shift for Animal Ethics. It indicates the transition from a field focused on relations between individuals (humans and animals) to a new viewpoint that incorporates the political dimensions of the relationships between human communities and non-human animals. Animals are no longer seen as a heterogeneous group of sentient beings or simply as species, but as part of a common good that is simultaneously human and animal. In order to participate in this new phase, bioethics will have to face a series of challenges that have hindered the integration of animal ethics within its field. It will also need the development of a new theoretical framework based on relations between communities of individuals. This framework will be able to highlight the ethical and political dimensions that arise from interactions between human communities, non-human animals and the ecosystem
Managing the Ethical Dimensions of Brain-Computer Interfaces in eHealth: An SDLC-based Approach
A growing range of brain-computer interface (BCI) technologies is being employed for purposes of therapy and human augmentation. While much thought has been given to the ethical implications of such technologies at the ‘macro’ level of social policy and ‘micro’ level of individual users, little attention has been given to the unique ethical issues that arise during the process of incorporating BCIs into eHealth ecosystems. In this text a conceptual framework is developed that enables the operators of eHealth ecosystems to manage the ethical components of such processes in a more comprehensive and systematic way than has previously been possible. The framework’s first axis defines five ethical dimensions that must be successfully addressed by eHealth ecosystems: 1) beneficence; 2) consent; 3) privacy; 4) equity; and 5) liability. The second axis describes five stages of the systems development life cycle (SDLC) process whereby new technology is incorporated into an eHealth ecosystem: 1) analysis and planning; 2) design, development, and acquisition; 3) integration and activation; 4) operation and maintenance; and 5) disposal. Known ethical issues relating to the deployment of BCIs are mapped onto this matrix in order to demonstrate how it can be employed by the managers of eHealth ecosystems as a tool for fulfilling ethical requirements established by regulatory standards or stakeholders’ expectations. Beyond its immediate application in the case of BCIs, we suggest that this framework may also be utilized beneficially when incorporating other innovative forms of information and communications technology (ICT) into eHealth ecosystems
The employee as 'Dish of the Day’:human resource management and the ethics of consumption
This article examines the ethical implications of the growing integration of consumption into the heart of the employment relationship. Human resource management (HRM) practices increasingly draw upon the values and practices of consumption, constructing employees as the ‘consumers’ of ‘cafeteria-style’ benefits and development opportunities. However, at the same time employees are expected to market themselves as items to be consumed on a corporate menu. In relation to this simultaneous position of consumer/consumed, the employee is expected to actively engage in the commodification of themselves, performing an appropriate organizational identity as a necessary part of being a successful employee. This article argues that the relationship between HRM and the simultaneously consuming/consumed employee affects the conditions of possibility for ethical relations within organizational life. It is argued that the underlying ‘ethos’ for the integration of consumption values into HRM practices encourages a self-reflecting, self-absorbed subject, drawing upon a narrow view of individualised autonomy and choice. Referring to Levinas’ perspective that the primary ethical relation is that of responsibility and openness to the Other, it is concluded that these HRM practices affect the possibility for ethical being
Clinical Pathways to Ethically Substantive Autonomy
There is no shortage of support for the idea that ethics should be incorporated into the academic and professional curriculum. There is a difference, however, between, on the one hand, teaching professionals about ethics, and, on the other, demanding that they give ethical expression to the range of professional skills they are expected to apply daily in their work. If this expression is not to be perfunctory, ethical judgement must be genuinely integrated into the professional skill set. The mark of integration in this regard is the capacity for autonomous judgement. Ethical autonomy cannot be achieved by a mechanical, rule-bound and circumstance-specific checklist of ethical do’s and don’ts, and it is only partially achieved by a move from mechanistic rules to ‘outcome based’ processes. Rather, professional ethical autonomy presupposes not only a formal understanding of the requirements of an ethical code of conduct, but a genuine engagement with the substantive values and techniques that enable practitioners to interpret and apply principles confidently over a range of circumstances. It is not then, that ethical skill is not valued by the legal profession or legal education, or that the shortfall of ethical skill goes unacknowledged, it is rather that the language of professional ethics struggles to break free from the cautious circularity that is the mark of its formal expression. To require a professional to ‘act in their client’s interests’, or ‘act in accordance with the expectations of the profession’ or act ‘fairly and effectively’ are formal, infinitely ambiguous and entirely safe suggestions; to offer a substantive account of what, specifically, those interests might be, or what expectations we should have, are rather more contentious. Fears of dogma and a narrowing of discretion do, of course, accompany the idea of a search for ethical substance, and caution is to be expected in response to it. Notwithstanding these anxieties, there would appear to be no coherent alternative to the aspiration to substantive autonomy, and this must remain the goal of teaching legal ethics. In light of this, the problem facing educationalists is then perhaps expressed more diplomatically in terms of how ethical skill might be substantively developed, imparted, and integrated into a genuinely comprehensive conception of professional skill.
Clinical education can go a long way to solving this problem: exposure to the practical tasks of lawyering is the surest and best way of raising consciousness in this regard: ‘Hands-on’ is good - and consciousness-raising is a step in the direction of autonomy, but raw experience and elevated awareness is not enough. We know that our most influential theories of learning tells us that it is in the process of reflection upon problem solving that the practitioner begins to take autonomous control of skill development. In the view of the author, reflection, requires content and direction, and in this paper, with the aid of three models of skill integration inspired by Nigel Duncan’s detailed analysis and video reconstruction of the ethical and technical skill deficiencies brought to light by R v Griffiths, we attempt to specify what might be understood in this regard: Reflective content refers to the discrete interests and values that compete to produce tension in what we will refer to the ‘matrix’ of concerns that feature in all forms of dispute resolution; reflective direction points to an engagement with the resources and techniques that can empower critical and autonomous judgment. In the context of a clinical process broadly structured by the insights of Wenger and by Rest’s model of ethical skill, guided reflection so specified thus serves as an interface between on the one hand, indeterminate ethical form, and, on the other, the substantive ethical wisdom to be found in the repository of values that underpin the very idea of the legal enterprise
The Ethical Dimension of Economic Choices
In general, capitalist countries display sustained growth, dynamism and innovation, and a high adaptability in response to external shocks. Yet in the last twenty years discontent over the notorious drawbacks of capitalism – corporate frauds, corruption, abuses of market power – has grown continually. In this paper, we argue that no remedy to these difficulties can be found if ethical dilemmas are not anticipated and addressed at the individual, firm and economy-wide level. While pro-ethical changes in business regulation would help, government action alone may not be effective enough. Given that the social sciences provide the general framework of reference for human action, better integration of the ethical dimension by these disciplines would bring about additional benefits. Attitudes on Medical Ethics of Criminal Neurointerventional Treatment
As contemporary scientific advancements offer the opportunity to manipulate processes of the human body at a higher degree of invasiveness than ever before, a number of bioethical concerns are raised. One significant concern is how to discern the acceptable integration of advancements in neurologically-based interventions into the criminal justice system. Past literature supports the idea that there are several variables that interact to form a global conversation on the ethics of compromising a criminal’s freedom of mind for the purposes of sentencing or rehabilitation. Attitudes toward the current criminal justice system and the current uses of neurointerventions are significantly influential, and the public attitudes of such topics have been well-recorded through the literature. An experienced physician was interviewed in order to gain the perspective of a professional who regularly implements neurologically-based treatments. The results of the interview suggested that professionals have a moderate level of confidence that the current relationship between the criminal justice system and neurointerventional methods has generally remained within ethical boundaries. The results also suggested that medical practitioners are tasked with balancing the dignity and the safety patients, which can cause frequent ethical dilemmas. The varying responsibilities of medical professionals keep them equipped to implement expert-level care while simultaneously considering the ethical ramifications of their decisions
Intellectual evolution of strategic management and its relationship with ethics and social responsibility
The main purpose here is to present an overview of the historical development of strategic management, through a critical review of the most relevant theoretical proposals, and to consider its links to ethics and corporate social responsibilities. From the very beginning of strategic management thought attempts have been made to fuse ethical aspects such as values of senior management or social values or social expectations to strategic management. More recently the stakeholder view of the firm has permitted the introduction of ethical theories into strategic management, and the resources-based view of the firm has lead to the consideration of competences, including moral virtues. Here it is argued that in spite of some advances, the integration of ethics into strategic management is not yet entirely satisfactory. Balancing and integrating basic values in the development of organic regulations and standards: proposal for a procedure using case studies of conflicting areas
The basic aim of the report is to develop a procedure for the integration of the ethical value base of organic farming into standards and regulations. For this it is necessary to identify the core ethical value of organic production, consider their coherence and relate them to existing practice of organic food and farming. Ethical values are per se in need of interpretation. It is therefore also necessary to consider the process of decision-making, when aiming to achieve a coherent integration of such values in the structure of a standard or regulation.
In line with the European Action Plan for organic food and farming from 2004 the Project EEC 2092/91 (Organic) Revision supports the idea that delegating a larger role to values and basic principles will help to harmonise the rules, provide room for flexibility in implementation and to simplify the European Regulation for organic production.
It is important to include basic values in standards and regulations, because organic farming is value based and all actors/stakeholders have value expectations, including consumers who the regulation wants to protect. Standards and regulations form the basis of a virtual contract between the consumer and the producers. By following the practices set out in the standards, producers give a promise to the consumer to deliver on additional ethical values, beyond the legal minimum standards for conventional agriculture and food.
The growing and globalised organic market and the involvement of large companies have resulted in renewed interest in the values and principles of organic farming. There has been concern that the organic food and farming sector is becoming more conventionalised, and has lost touch with its basic values. Thus it will no longer function effectively as a real alternative to general agriculture for consumers, producers and also for policy makers.
The report analyses what core ethical value are associated with organic agriculture and should therefore be considered for inclusion in a regulation. This value base is contrasted with the existing Regulation (EEC) 2092/91 and with examples of current practice of organic agriculture in Europe. The implications of including ethical values in the structure of a regulation for decisionmaking are considered. Following on from the European Action Plan a process of total revision of the EU regulation on organic production is underway. A new European Regulation for organic production was adopted by the European Council of Ministers in June 2006 and will come into force in Jan 2009. The text of the near final proposal from December 2006 has been considered
in several sections of the report. The report finishes with some conclusions and recommendations for the EU Commission and other standard setting bodies regarding the choice and roles of values in organic standard, the rules for decision-making processes in relation to integrating values, and regarding the ongoing revision of the organic regulation in Europe
Duty to Warn and Intervention with HIV-Positive Clients
Complex ethical and legal issues are involved when an HIV-positive client presents a danger to others as a result of engaging in unprotected sex or needle sharing. This article presents a detailed assessment-and-intervention model that is based on the integration of ethical and legal principles with information about the level of risk associated with a client\u27s behavior, the HIV status of the client, and the sexual or needle-sharing partner\u27s awareness of the client\u27s HIV status. Appropriate interventions, including the duty to warn, are identified for each of the risk levels
