Citační analýza judikatury a maximalismus v soudním rozhodování

Článek reflektuje, v návaznosti na teorii amerického autora Casse Sunsteina, úsilí zejména vrcholných soudů na formulování šířeji a hlouběji odůvodněných rozhodnutí, tak aby to odpovídalo jejich roli v soudní soustavě. Koncept optimální relevance, se kterým pracují autoři knihy Citační analýza judikatury, tak nabývá podle našeho názoru nový rozměr, když minimalizace úsilí ohledně zahrnutí soudního rozhodování je příznačná pro minimalistickou argumentaci, naopak hluboká a do jisté míry i široká argumentace příznačná pro maximalismus se vyznačuje podrobnějším zdůvodněním podstaty problémů, což se může projevit v míře odkazů na judikaturu a literaturu v soudním rozhodnutí. V druhé části se článek pokouší otestovat některé jednoduché hypotézy s využitím schématu rozpoznávání referencí, v čemž navazujeme na výzkum prováděný autory výše citované knihy

Tento text představuje odpověď na příspěvky Ondřeje Kadlece, Jaroslava Benáka, Lukáše Králíka a Arkady Alexandrova a Pavla Ondřejka reagující na knihu Citační analýza judikatury. Jejich reakce a podněty diskutujeme napříč čtyřmi kategoriemi: Povinnost následovat judikaturu a stare decisis, silné a slabé stránky konceptu optimální relevance, silné a slabé stránky „makropohledu“ na české citační prostředí, které pak úzce souvisí s otázkami proveditelnosti navrhovaných cest dalšího výzkumu a reflexe navazujícího výzkumu provedeného Alexandrovem a Ondřejkem

Annotated corpus of 350 decision of Czech top-tier courts (Supreme Court, Supreme Administrative Court, Constitutional Court). Every decision is annotated by two trained annotators and then manually adjudicated by one trained curator to solve possible disagreements between annotators. Adjudication was conducted non-destructively, therefore dataset contains all original annotations. Corpus was developed as training and testing material for reference recognition tasks. Dataset contains references to other court decisions and literature. All references consist of basic units (identifier of court decision, identification of court issuing referred decision, author of book or article, title of book or article, point of interest in referred document etc.), values (polarity, depth of discussion etc.)
