Alienação parental: uma discussão a partir dos direitos fundamentais da criança e do adolescente

O presente trabalho tem por objetivo analisar os direitos fundamentais da criança e do adolescente frente à prática de atos de alienação parental, com o fito de identificar quais direitos da criança e do adolescente podem ser violados pelo instituto da alienação parental, buscando alcançar possíveis soluções jurídicas para este problema eminentemente psíquico. Partindo de uma verificação da evolução dos direitos da criança, bem como da abertura constitucional para o reconhecimento desses direitos, será analisada a estrutura dos direitos fundamentais através de sua teoria geral, para, enfim, alcançar o estudo dos direitos fundamentais em espécie, passíveis de violação pela prática de alienação parental. Também com este intuito, serão elucidados os princípios de proteção à criança e ao adolescente, dispostos na Constituição Federal de 1988, no Estatuto da Criança e do Adolescente, e ainda, nos documentos internacionais, como a Convenção sobre os Direitos da Criança de 1989. Realizadas tais considerações, por fim, cumpre verificar as questões atinentes à alienação parental. Para tanto, será realizada a distinção entre a Síndrome de Alienação Parental e a alienação parental, concluindo-se que interessa ao direito a tutela jurídica da alienação parental, a fim de evitar as consequências psíquicas e, até mesmo, coibir tal prática. Aponta-se a guarda compartilhada como possível instrumento auxiliador na resolução destes conflitos.This study aims to analyze the fundamental rights of children and adolescents across the acts of parental alienation, with the aim of identifying which rights of children and adolescents may be violated by the Institute of parental alienation, seeking to achieve possible legal solutions for this highly psychological problem. Starting from an examination of the evolution of children's rights, and constitutional openness to the recognition of these rights, we will analyze the structure of fundamental rights through his general theory, to finally get to the study of fundamental rights in kind, capable of being impaired the practice of parental alienation. Also for this purpose, will be elucidated the principles of protection of children and adolescents, disposed in Federal Constitution of 1988, the Statute of Children and Adolescents, and also in international documents such as the Convention on the Rights of the Child 1989. Performed such considerations, finally, we need to check those relating to parental alienation issues. Therefore, the distinction between the Parental Alienation Syndrome and parental alienation will be held, concluding that interests the right to legal protection of parental alienation in order to avoid psychological effects, and even curbing this practice. It is pointed out shared custody as a possible helper tool in resolving these conflicts

Alienação (Entfremdung) e Estranheza (Fremdheit) : dois paradigmas culturais do ocidente

Alienation and strangeness could be understood as markers of cultural paradigms. The first term is related to modernity as the second is to postmodernity. One stands for identity, the other for alterity. While the existence of the phenomenon of alienation becomes disputable, the discourse of strangeness becomes intensified in the European academic sphere. In a way, the discourse of strangeness is labeled by a cultural critic, which tries to justify "strange" for centuries dispelled by the European culture. Meanwhile, a phenomenology of alienation is developed to re-structure the term. Both phenomena are connected insofar as alienation can be understood as a temporary moment of strangeness. Both theories turned out to be productive in literary analysis.Entfremdung (alienação) e Fremdheit (estranheza) podem ser entendidos como demarcadores de paradigmas culturais. A primeira está para a modernidade, assim como a segunda está para a pós-modernidade. Uma está para identidade, e a outra para alteridade. Enquanto a existência do fenômeno da alienação tornou-se questionável na atualidade, o discurso sobre estranheza vem se consolidando no âmbito acadêmico europeu. Tal discurso é, em certa medida, marcado por uma crítica cultural que tenta fazer justiça ao "estranho" recalcado por séculos pela cultura europeia. Enquanto isso, uma fenomenologia da alienação começa também a se desenvolver, a fim de reformular o conceito. Os dois fenômenos relacionam-se na medida em que a alienação é entendida como um momento transitório da estranheza. Ambas as teorias têm se mostrado produtivas no campo da análise literária

A alienação escolar como fator preditor dos problemas de comportamento em alunos do 2º e 3º ciclo de escolaridade

Dissertação de mestrado em Psicologia da Educação, Desenvolvimento e Aconselhamento, apresentada à Faculdade de Psicologia e de Ciências da Educação da Universidade de CoimbraAo constructo de alienação está associado a falta de um sentimento de pertença, uma separação de quatro mundos: a família, os amigos, o trabalho e a escola (Bronfrenbrenner, 1986). A presente investigação procura perceber as características e expressões desta condição em contexto escolar, assumindo como objetivo principal o estudo da relação entre a alienação escolar e os problemas de comportamento, bem como a existência de um valor preditivo da alienação face a estes mesmos problemas. Para tal, recolheu-se uma amostra de 410 sujeitos (56.6% do sexo feminino e 43.4% do sexo masculino), entre os 10 e os 15 anos (M= 12.88; DP=1.44). O instrumento eleito para avaliar as dimensões da alienação face à escola foi a Escala de Alienação Escolar (EAE), e para a avaliação dos problemas de comportamento, de cariz externalizante e internalizante, utilizou-se o Questionário de Capacidades e Dificuldades (SDQ-Por), um instrumento de autorrelato que visa analisar a forma como o adolescente perceciona o seu comportamento. Os resultados obtidos sugeriram, uma associação entre a alienação escolar e os problemas de comportamento, particularmente com os de tipo externalizante. As variáveis sociodemográficas que mais parecem predizer esta relação são o sexo, com os rapazes a apresentar pontuações mais elevadas; a idade, com os adolescentes mais velhos (13-15 anos) a mostrarem-se mais propensos; e o nível socioeconómico, com adolescentes oriundos de um nível socioeconómico baixo e cujos pais se encontram desempregados a obter scores mais altos. Deixa-se em aberto para estudos futuros uma compreensão mais profunda da relação entre a alienação escolar e os problemas de cariz internalizante, visto que não se registaram associações estatisticamente significativas. Também o papel do comportamento pró-social enquanto variável protetora na expressão do problema levanta questões a explorar.The alienation construct is associated to a lack of belonging, a four world’s separation: family, friends, work and school (Bronfrenbrenner, 1986). This investigation aims to understand the characteristics and expressions of this condition in school context, assuming as main goal the study of the relation between school alienation and behavioral problems, as well as the existence of an alienation’s predictive value towards them. For that purpose, a sample of 410 subjects (56.6% female subjects and 43.4% male subjects), between ages 10 and 15 (M=12.88; SD=1.44). The selected instrument to evaluate alienation dimensions towards school was the School Alienation Scale (EAE). To evaluate externalizing and internalizing behavioral problems, the Strengths & Difficulties Questionnaire (SDQ) was used, a self-report instrument to analyse how the adolescent perceives his/her behavior. The obtained results do suggest an association between school alienation and behavioral problems, specially with the externalizing type. The sociodemographic variables which seems to better predict this relation are sex, with boys presenting higher scores; age, with the oldest teens (13-15 years) obtaining higher scores; and sociodemography, with adolescents coming from a low socioeconomic status and which parents are currently unemployed, obtaining higher scores. Future studies must attend in a deeper compreension of the relation between school alienation and externalizing behavioral problems, considering the inexistence of significative statistical associations. The role of prossocial behavior as a protective variable in the problem’s expression also brings questions to explore in future works

Alienação parental: as falsas acusações e o efeito alienador na atuação do Poder Judiciário

On the present paper it’s faced the question of Parental Alienation by a bibliographic review, elaborated from a multidisciplinary perspective, essential to the comprehension of the subject, added by a documental research of four concrete cases. After the first introduction chapter, it’s performed a brief analysis of the family. Starting by a historical perspective, it’s punctuated questions about the national legislation in regard the family, as well as the State’s intervention on the family plan. Finally, it’s elaborated an overview of family relationships conflicts and the family psychodynamics conflicts, approaching, more specifically, the unconscious contract on the couple relationship and the conflict’s influence on the well-being of the sons. On the third chapter, entering on the discussion about the Parental Alienation, it’s faced the problematics of the Parental Alienation Syndrome. Information’s about international’s diplomas and national legislation’s dispositions of children’s and adolescent’s protection are also exposed. After, we bring legal aspects of the Parental Alienation, especially the law nº 12. 318/10 and the difficulties resulting from false accusations. On the fourth chapter, are described four judgements by Rio Grande do Sul’s Court of Justice in witch its noticed the existence of a criminal proceeding against one of the parents, which was established due to an accusation resulting from an context of family disaggregation, permeated by Parental Alienation acts. It’s studied the State’s intervention as a fact that, in some cases, especially when it’s determined the separation of parent and son, increases the Parental Alienation. In the last chapter, some considerations about the search of a reflection about what was faced in the paper are made, in order to, by the bibliographic review and by the analysis of the studied cases, conclude that the State can be an instrument of increasing Parental Alienation.Na presente dissertação é abordada a questão da alienação parental mediante uma revisão bibliográfica, realizada a partir de uma perspectiva multidisciplinar, essencial para a compreensão do tema, aliada a uma pesquisa documental concernente a quatro casos concretos. Após o primeiro capítulo introdutório, é realizada uma breve análise acerca da família. Iniciando por uma perspectiva histórica, são pontuadas questões concernentes à legislação pátria no que diz respeito à família, bem como à intervenção estatal no âmbito familiar. Por fim, é construído um panorama dos conflitos na relação familiar e da psicodinâmica dos conflitos familiares, tratando, mais especificamente, do contrato inconsciente nas relações de casais e da influência dos conflitos no bem-estar dos filhos. No terceiro capítulo, adentrando na discussão a propósito da alienação parental, é tratada a problemática da instauração da Síndrome de Alienação Parental e são apresentadas informações relativas a diplomas internacionais e a dispositivos da legislação nacional de proteção à criança e ao adolescente. Posteriormente, são trazidos aspectos jurídicos da alienação parental, com ênfase na Lei nº 12. 318/10 e nas dificuldades oriundas das falsas acusações. No quarto capítulo são descritos quatro julgados do Tribunal de Justiça do Rio Grande do Sul, nos quais se percebe a existência de um processo penal em desfavor de um dos progenitores, instaurado em face de acusação oriunda de um contexto de desagregação familiar, permeado por atos de alienação parental. É estudada, ainda, a intervenção do Estado como um fator que, em alguns casos, em especial quando determina o afastamento do genitor da prole, potencializa a alienação parental. Por fim, são tecidas algumas considerações na busca de uma reflexão tangente ao que foi abordado, de forma que, pela revisão bibliográfica e pela análise dos casos estudados, conclui-se que o Estado pode acabar sendo um instrumento potencializador da alienação parental

Since the conquest of hyperinflation, with the Real Plan, in 1994, the Brazilian financial system has grown from early infancy to late adolescence. We describe the process of maturing with emphasis on the defining features of the Brazilian financial system over the last 20 years: 1) stabilization and the subsequent financial crisis; 2) universality of banks; 3) market segmentation through public lending; 4) institutional improvement. Parental alienation: when parents and children need help

As transformações sociais que têm levado à modificação da estrutura familiar, também têm, entre outras, estado associadas ao aumento de divórcios e às dificuldades dos pais em exercerem as suas responsabilidades parentais. Neste contexto, surgem problemas específicos, como é o caso da alienação parental, onde um dos progenitores, através de estratégias e manobras manipuladoras, denegrindo a imagem do outro, o procura excluir da vida do filho, destruindo o vínculo entre este a criança. Estas ações culminam muitas vezes em denúncias falsas de maus-tratos que tornam ainda mais relevante a sensibilização para esta problemática.
