El poliamor a debate

Abstract

Aquest treball pretén aprofundir en una nova forma de vida familiar, el poliamor, així com en el seu encaix en els diferents ordenaments jurídics de la Unió Europea. Amb aquest fi, s'ofereix una definició en positiu i una altra en negatiu, prenent com a context l'evolució del model de família tradicional als actuals models de vida familiar que coexisteixen en les societats occidentals. D'altra banda, amb l'objectiu d'aclarir la inclusió o no del poliamor dins del concepte de família que regulen tant el Conveni Europeu de Drets Humans com la Carta de Drets Fonamentals de la Unió Europea i sobre el qual la jurisprudència ha tingut oportunitat de pronunciar-se en nombroses ocasions, es procedeix a fer una anàlisi d'aquesta i es reflexiona sobre l'enquadrament del poliamor en aquest concepte. També es fa referència al cas concret d'Espanya a través de l'estudi de la Constitució de 1978 i de la jurisprudència que el Tribunal Constitucional ha elaborat al voltant d'aquesta en relació amb el concepte constitucional de família. Finalment, com a conclusió es deixen plantejades una sèrie de qüestions jurídiques que presenta el poliamor com a nova forma de vida familiar.This paper aims to introduce a new model of family life, the polyamory relationship, and its place in the different legal systems of the European Union. To do this, the definition of polyamory will be provided from the positive and negative standpoints, taking as a context the evolution of the traditional form of family life into the current forms of family life that coexist in Western societies. Likewise, in order to clarify whether or not the polyamorous personal relationship could hold a place in the concept of family that regulates both the European Convention on Human Rights and the Charter of Fundamental Rights of the European Union, on which the Courtshave had the occasion to rule, we will proceed to its analysis, reflecting on whether polyamory can be included in this concept. We also make reference to the specific case of Spain through a study of the 1978 Constitution and of the jurisprudence that the Constitutional Court has built around the concept of family. Lastly, as a brief conclusion, some legal issues posed by polyamorous families as a new form of family life are presented
