A LEGISLAÇÃO COMO FONTE DE PESQUISA PARA A HISTÓRIA DA EDUCAÇÃO

Abstract

In general, legislation is understood as a set of laws that govern social praxis. Considered in common sense as harsh, unfair and insurmountable, laws reveal a look at cultural, historical and social contexts. For legislators, laws are living and dynamic, they establish norms and aim to protect society. In this article, we aim to contribute to the reflection on the use of legislation as a source of research in the field of History of Education, presenting possible articulations and analyzes through educational legislation. To this end, we developed a bibliographical research subsidized in books and articles, as well as a documentary research, whose sources were the Laws of Guidelines and Bases of Brazilian Education. We conclude that legislation, in the educational sphere, is an important field of research to understand the historical and social context of its production, as well as to reveal the social practices that drove its creation and/or restructuring. Em geral, legislação é entendida como um conjunto de leis que regem a práxis social. Considerada no senso comum como dura, injusta e intransponível as leis revelam um olhar sobre contextos culturais, históricos e sociais. Para legisladores, as leis são vivas e dinâmicas, estabelecem normas e visam a proteção da sociedade. Neste artigo, objetivamos contribuir com a reflexão acerca do uso da legislação como fonte de pesquisa no campo da História da Educação, apresentando as possíveis articulações e análises por meio da legislação educacional, para tanto desenvolvemos uma pesquisa bibliográfica subsidiada em livros e artigos, bem como uma pesquisa documental, cujas fontes foram as Leis de Diretrizes e Bases da Educação Brasileira. Concluímos que a legislação, no âmbito educacional, se configura como um importante campo de pesquisa para se entender o contexto histórico e social de sua produção, bem como revelar as práticas sociais que impulsionaram sua criação e/ou reestruturação
