TINJAUAN YURIDIS TERHADAP KEKERASAN ANAK YANG BERIMPLIKASI PSIKOLOGIS: ANCAMAN REVENGE PORN DALAM PERSPEKTIF PELAKU DAN KORBAN BERDASARKAN UNDANG- UNDANG PERLINDUNGAN ANAK

Abstract

In this thesis, the author will briefly summarize a legal analysis of legal protection for children as victims of revenge porn, focusing on the provisions of the Child Protection Law and the Electronic Information and Transactions Law. The author has two research questions that serve as the core topics of this research. These two questions are:First, What is the criminal responsibility for perpetrators of revenge porn threats according to the Child Protection Law which regulates the protection of children who are victims of revenge porn threats?Second, What are the psychological impacts on children as victims of revenge porn, and how does the legal aspect view this case? In order to carry out this research perfectly and to obtain accurate data, the author applies a normative research method by reviewing the laws related to the problem topic being researched by the author. The normative research method through a statutory approach is a research method that leads to applicable legal regulations, both within the hierarchy of statutory regulations and with their harmonious relationship (horizontal). This normative legal research can be used to find legal principles formulated either explicitly or implicitly, as well as to draw legal principles related to certain fields that have been regulated by law. The results of the research that has been carried out show thatRevenge porn is a form of technology-based sexual violence often perpetrated by perpetrators motivated by revenge, humiliation, or threats against victims, who are often children or women. The psychological impact on victims is very serious, including shame, stress, anxiety, depression, mental disorders, and the risk of suicide due to social stigma and mental pressure experienced. Legal protection for victims is regulated in the Child Protection Law, the ITE Law, and the Pornography Law, but there is still a lack of specific norms that comprehensively regulate criminal acts.revenge porn so that law enforcement is not optimal. Factors causing the emergence of this crime include patriarchal culture, a lack of gender understanding among law enforcement, and the perpetrator's motives, which are based on hurt or disappointment. Legal protection efforts include preventive and repressive measures, including legal assistance, psychological counseling, restitution, and restoration of the victim's rights. A multidisciplinary approach is needed to address the psychological impact on victims and effectively prevent this crime from occurring.
