¿Por qué cuidar los recursos naturales? Construcción jurisprudencial de una constitución verde en clave del paradigma ecocéntrico en Colombia

Abstract

This paper presents the conclusions drawn from the study of nine judicial decisions that declared natural expressions as subjects of law. The decisions and their arguments were discussed from a legal-philosophical perspective. The objective of this study was to identify, throughout each judgment, the ratio decidendi, expressed in a double direction. On the one hand, there is the connection between the defense of nature as the most suitable means for the conservation of communities and future generations, an anthropocentric paradigm. On the other hand, the protection of nature and its vital network as an end in itself, ecocentric paradigm. These judgments were selected for three reasons: they are recent, the legal impact of the decision, and the philosophical substratum that guided the jurisdictional argumentative basis to talk about the protection of natural resources.Este trabajo recoge las conclusiones derivadas del estudio de nueve decisiones judiciales que declararon expresiones naturales como sujetos de derecho. Las decisiones y sus argumentos se discutieron bajo una perspectiva iusfilosófica. El objetivo del mismo consistió en identificar, a lo largo de cada sentencia, la ratio decidendi, expresada en una doble dirección. Por un lado, la conexidad que existe entre la defensa de la naturaleza como el medio más idóneo de conservación de las comunidades y de las generaciones futuras, paradigma antropocéntrico.  Por otro, la protección de la naturaleza y su red vital como fin en sí mismo, paradigma ecocéntrico. Estas sentencias fueron seleccionadas por tres razones: (i) lo reciente en el tiempo; (ii) el impacto jurídico de lo resuelto, y (iii) el sustrato filosófico que orientó la base argumentativa jurisdiccional para hablar del cuidado de los recursos naturales
