Una relación singular: Los vínculos entre gestantes y comitentes de gestación por sustitución entre Ucrania y Argentina

Abstract

Surrogacy is a practice that generates controversy, especially in contexts where regulation is scarce or nonexistent. In Argentina, although there is no specific legislation, this practice involves significant judicial mediation and various legal strategies for its implementation. Local legal uncertainties have led many Argentine families to pursue surrogacy procedures in other countries, with Ukraine standing out as a prominent destination due to its accessibility and specific characteristics. This study aims to analyze, from the perspective of intended parents, the relationships between married cisheterosexual women who seek or have become mothers (intended parents) through surrogacy and Ukrainian gestational carriers. Using a qualitative-exploratory design, between 2022 and 2024, 18 in-depth interviews were conducted with individuals who had undergone surrogacy and traveled internationally for the process. The results show that the established bonds transcend geographical boundaries and are enriched by a bidirectional exchange of objects (photos, gifts, songs, among others) and emotions, shaping singular relationships. These findings contribute to a more nuanced understanding of surrogacy, moving beyond simplistic views that reduce it to the instrumentalization of women’s bodies and highlighting the relational and affective dimensions of these experiences.La gestación por sustitución es una práctica que genera controversias, especialmente en contextos donde la regulación es escasa o inexistente. En Argentina, aunque no se encuentra legislada, esta práctica cuenta con significativa intermediación judicial y diversas estrategias legales para su consecución. Las inseguridades jurídicas locales han llevado a muchas familias argentinas a optar por realizar procedimientos de gestación por sustitución en otros países, siendo Ucrania un destino destacado por su accesibilidad y características específicas. Este estudio tiene por objetivo analizar, desde la perspectiva de las comitentes, las relaciones entre las mujeres cisheterosexuales casadas que buscan ser o han sido madres (comitentes) a través de gestación por sustitución y las gestantes ucranianas. Desde un diseño cualitativo-exploratorio, entre 2022 y 2024, se realizaron 18 entrevistas en profundidad a personas que hubieran realizado gestación por sustitución y que se hubieran desplazado geográficamente para ello. Los resultados muestran que los vínculos establecidos trascienden las geografías y se nutren de un intercambio bidireccional de objetos (fotos, regalos, canciones, entre otros) y emociones, configurando relaciones singulares. Estos hallazgos permiten complejizar los análisis de la gestación por sustitución, alejándose de las visiones simplistas que la reducen a la instrumentalización del cuerpo de las mujeres, y destacan las dimensiones relacionales y afectivas de estas experiencias
